Abstract

Based on the provisions of Article 14 in PP No. 18 of 1965 which regulates the liability of motorized vehicle owners in Indonesia, its implementation to date has not been fully realized. This is due to the complexity of the legal subjects responsible for the implementation of these provisions, which causes injustice to motorized vehicle owners. In certain situations, vehicle owners are not involved in an accident at all, as the vehicle is under their control. The core cause of this problem lies in the vagueness of the applicable regulations, which do not explicitly distinguish between individual and collective responsibility for traffic accidents. Therefore, research was sought to reconstruct the relevant norms, rules and regulations so that the implementation of Article 14 in PP No. 18 of 1965 can be carried out effectively. Several other regulations, including but not limited to Act No. 22 of 2009 and related regulations, have accommodated provisions regarding traffic law violations and accidents comprehensively. The results show that there was injustice for motorized vehicle owners because the accident did not occur when the vehicle was under their control. The arrangements in other regulations also indicated that the party who must be responsible for a traffic accident is the driver of the vehicle that caused the accident, regardless of his status as a vehicle owner or not. This phenomenon occurred due to the failure to clearly separate individual and collective responsibility for traffic accidents in the context of Article 14-PP No. 18 of 1965. In an effort to achieve balanced and accurate legal justice, it is necessary to revise and improve the relevant regulations to ensure a balance in the determination of responsibility in traffic accident cases.

Abstract

Regulations pertaining to the liability of motorized vehicle owners in Indonesia, as stipulated by Law Number 34 of 1964 concerning Traffic Accident Funds and Government Regulation Number 18 of 1965 regarding the Implementation Provisions of Road Traffic Accident Funds, have yet to be implemented since enactment. This is due to the lack of justice for motorized vehicle owners or operators whose vehicles are involved in accidents, but are not under their immediate control. The prevailing regulations do not adequately differentiate between individual and collective liability for traffic accidents. This study aimed to analyze the weaknesses inherent in the existing regulations, particularly in regards to the liability of motorized vehicle owners for accidents, which have not been handled with due fairness. The research paradigm seeks to examine the existing state (das sein) and the ideal state (das sollen) related to the legal liability of motorized vehicle owners.

Abstract

Business judgment rule adalah suatu immunity doktrin yang memberikan perlindungan hukum dan kepastian hukum bagi Direksi BUMN dalam melakukan tugasnya terkait dengan pengambilan Keputusan strategis bagi BUMN. Salah satu tujuan pembentukan BUMN adalah memperoleh keuntungan (profit oriented), baik keuntungan dari aspek pengelolaan aset maupun hasil investasi, namun dinamika usaha tidak semua BUMN memperoleh keuntungan. Kewenangan tersebut dilindungi hukum sehingga tidak dapat diganggu gugat/diadili siapapun meskipun keputusannya merugikan perseroan selama diambil dengan itikad baik sesuai ketentuan yang berlaku, rasional, tidak mengalami benturan kepentingan. Business judgment rule adalah perintah yang tertuang dalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas pasal 97 ayat (5) untuk memberikan perlindungan hukum dan kepastian hukum kepada Direksi BUMN. Pada umumnya aparat penegak hukum masih banyak yang belum memahami doktrin business judgement rule, sehingga tidak sedikit Direksi/pengurus BUMN pada saat mengambil langkah bisnis mengalami kerugian kemudian dianggap melakukan perbuatan melawan hukum dengan delik merugikan keuangan negara.

Abstract

The complexity and challenges of military conscription for Generation Z in Indonesia are crucial topics in national defense discussions. This article analyzes the implementation of Law Number 23 of 2019 on National Resource Management for State Defense in enhancing Generation Z’s national defense awareness. According to Litbang Kompas data, 57.6% of Generation Z are uninterested in joining the Indonesian National Armed Forces (TNI). Factors such as generational differences, psychosocial challenges, and misalignment with career aspirations pose significant obstacles to implementing military conscription. Additionally, the multi-actor dynamics and complexities of defense policy coordination further complicate human resource management in the national defense system. This article recommends a more flexible approach to conscription, including a voluntary system, incentives for participants, and the integration of technology in training programs. Thus, the national defense program can be more adaptive and inclusive for Generation Z. This study highlights the importance of balancing national defense obligations with individual rights and strengthening technology-based defense strategies to address modern threats.
