Abstract

Law Number 6 of 2023 on Employment provides a strong legal foundation for upholding the rights of female workers, including the right to menstrual leave. This study delves into the right to menstrual leave from the perspective of Fiqh Siyasah within the context of the principle of Mabda al-Musawah (equality) and responsive law. This principle emphasizes the importance of equal treatment without gender discrimination and the need for laws that are responsive to social changes to ensure regulations can protect the rights of female workers and create an inclusive work environment. In Islamic law, the principles of mabda al-musawah and responsive law underscore the importance of justice for female workers and emphasize equality before the law regardless of gender. The research method involves literature studies with qualitative descriptive analysis. The results of the study show that the principle of mabda al-musawah emphasizes the importance of equality and fair treatment for all workers without gender discrimination and provides opportunities for female workers to rest without losing their right to wages. The principle of responsive law emphasizes the adaptability of laws to social changes and community needs, which is relevant to the specific needs of female workers related to the menstrual cycle. Thus, it can be concluded that the implementation of the principles of mabda al-musawah and responsive law in menstrual leave rights is not explicitly regulated, indicating that the law does not adequately meet the needs of female workers. Additionally, the payment of wages during leave, which depends on agreements with employers, can disadvantage workers. The legislative process that lacks the involvement of society, especially workers and women, shows that this law is not fully responsive

Abstract

There are 3 things that want to be explained further in this research, namely: how are traffic practices regulated in traffic fiqh in Aceh, and how are ideas and implementation of human security values through traffic fiqh in Aceh? Apart from that, this research also reviews the background to the birth of traffic fiqh for the Acehnese public. This research is qualitative with a descriptive analysis approach. The results found that driving practices regulated in traffic fiqh also strengthen what is regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation, but by using a religious approach to touch the public's awareness of the importance of protecting a sense of security for themselves and others.

Abstract

Tulisan ini mencoba menguraikan bagaimana peran perempuan dalam proses pemulihan perdamaian di Burundi melalui penerapan resolusi 1325 Dewan Keamanan PBB. Peran perempuan menjadi objek dalam tulisan ini yang bertujuan untuk mengetahui bagaimana kontribusi perempuan Burundi pada proses pemulihan perdamaian paska perang saudara dengan menggunakan metode deskriptif. Lebih lanjut dapat diuraikan bahwa eksistensi dan kontribusi perempuan Burundi begitu penting pada proses pemulihan paska konflik dengan penerapan resolusi 1325 sesuai dengan amanat Dewan keamanan PBB.

Abstract

Customary forests are forests that are located within the area of a Customary Law Community. In theory, only people who live in forest areas are able to maintain forest areas well because they have a reciprocal relationship that cannot be separated. These communities are often referred to as indigenous communities or customary law communities. Aceh Besar has a very large forest area, there are three forest areas that have been categorized as customary forest areas with three customary law communities that are included in the indicative customary forest map of the Indonesian Ministry of Environment and Forestry. This research examines: Efforts that can be made by customary law communities in Aceh Besar to obtain their rights to customary forests and how optimizing customary forest management can provide protection to customary law communities and customary forest areas in Aceh Besar. The results of the research show that currently three customary forest areas in Aceh Besar have been removed from the indicative customary forest map, this is because during the verification period the customary law communities (Mukim) files were unable to provide evidence in the form of regional regulations in Aceh Besar which designated them as customary law communities recognized in accordance with the requirements. in the Minister of Environment and Forestry's regulations, so that the three mukims in Aceh Besar do not have legal rights to manage customary forests. Optimizing protection for forest areas and Mukim in Aceh Besar is also not going well.

Abstract

Maraknya penolakan dari masyarakat terhadap pemberian dana pensiun bagi pejabat tinggi negara yang hanya menjabat selama 1 periode (5 Tahun) namun mendapatkan hak pensiun seumur hidup, hal ini tentu bertentangan dengan kondisi masyarakat indonesia saat ini. Sangatlah tidak etis memberikan hak kepada kelompok atau perorangan secara berlebihan, tanpa mempertimbangkan aspek keadilan, dan kemanfaatannya. Berdasarkan permasalahan tersebut, Penelitian ini bertujuan untuk mengetahui bagaimana penerapan pemberian dana pensiun bagi Pimpinan dan Anggota Lembaga Tinggi Negara di Indonesia, dan bagaimana tinjauan maqāsid syarīah terhadap pemberian dana pensiun bagi pimpinan dan Anggota Lembaga Tinggi Negara. Dalam penelitian ini penulis menggunakan metode Yuridis Normatif, dengan pendekatan Perundang-undangan, pendekatan konsep, dan pendekatan perbandingan. Penelitian ini menggunakan kajian pustaka (library research). Adapun hasil penelitian yang didapat adalah Besaran uang pensiun Pejabat Tinggi Negara didasarkan pada Surat Menteri Keuangan No S-520/MK.02/2016 dan Surat Edaran Setjen DPR RI No KU.00/9414/DPR RI/XII/2010. Besaran uang pensiun Pejabat Tinggi Negara yakni 60 persen dari gaji pokok setiap bulan. Adapun besaran uang pensiun menurut Surat Menteri Keuangan yaitu setiap mantan anggota MPR, dan DPR akan mendapat sebesar Rp 2.5 juta hingga Rp 3.02 juta per-bulannya setelah tidak menjabat. Selanjutnya hasil penelitian ini menunjukkan bahwa Pemberian dana pensiun bagi pejabat tinggi negara belum sesuai dengan konsep maqāṣid al-syarī’ah, karena pemberian dana pensiun tersebut lebih banyak mendatangkan mudaratnya, seperti bertambahnya beban APBN, pembengkakan utang negara, pemborosan dana, serta kesenjangan sosial.
