Abstract

Wage regulations are designed with the main objective of protecting the welfare of workers and providing a sense of justice for all workers. One form of wage that is a right for workers in Indonesia is the provision of Religious Holiday Allowance as non-wage income. The implementation of the provision of Religious Holiday Allowance has several problems such as being underpaid, not paid, paid late, and paid in installments as much as possible. In addition, there are also gaps and legal issues for casual workers with work intensity below 21 working days in a month and who have worked for more than 3 consecutive months, so they do not get Religious Holiday Allowance. The purpose of writing this journal is to analyze the regulation of the provision of Religious Holiday Allowance to casual workers under existing positive laws in Indonesia. The writing of this journal uses the normative juridical method through conceptual and statutory approaches. Based on the analysis that has been done, it shows that the Religious Holiday Allowance for casual workers who work with a working period of more than or less than 12 months and or work not full for 21 working days in a month, can cause legal problems due to unclear calculations so that the impact is not paid Religious Holiday Allowance. The sanctions for employers who do not pay Religious Holiday Allowance on time are fines and administrative sanctions. However, many casual workers do not settle the dispute, both litigation and non-litigation, due to the need for work in addition to the unequal position in the employment agreement.

Abstract

The advancement of information technology, which renders digital footprints permanent, has generated new problems in the protection of personal data, including for public officials who possess narrower privacy boundaries than private citizens. Research aims to explore the potential conflicts between the right to be forgotten and long-standing principle of transparency in Article 28F of the 1945 Republic of Indonesia's Constitution. Additionally, this paper looks at which public servants should be protected by the Right to Forget Law under Indonesian national laws or administrative regulations. This research deals with the difference between Indonesian National Laws for public servants and the right to be forgotten. It also discusses laws from “Republic of Indonesia No. 19/2016 Electronic Information Transactions Law of Republic of Indonesia No. 14/2008 Disclosure of Public Information Laws”. EU policy as well as the direction taken in member states such as France. The findings of the research show that the applicability of the Right to be Forgotten for public servants cannot be in an absolute form since information about their tasks of offices, track records, alleged ethical or legal violations, and actions that have an impact on the public is information that must remain accessible as part of public accountability. Additionally, this research reveals discrepancies in the court's and the Information Commission's authority when it comes to responding to information removal requests, which may lead to jurisdictional disputes.  In conclusion, the public interest must be considered when evaluating any use of the Right to be Forgotten by public officials. Considering the proportionality principle and regulatory harmonization is required to sustain transparent and accountable government by ensuring the proper finding a balance between protecting people's privacy and giving the public the right to know.

Abstract

Penelitian ini bertujuan untuk mengkaji ketidaksesuaian regulasi yang memengaruhi implementasi perlindungan legislatif atas hak cuti hamil bagi pekerja perempuan. Hak ini tidak selalu terwujud karena berbagai kendala institusional dan normatif. UU No. 13/2003 tentang Tenaga Kerja dan UU No. 4/2024 tentang KIA tidak selaras, sehingga menimbulkan ambiguitas dan inkonsistensi dalam perlakuan terhadap hak-hak maternitas di tempat kerja. Studi yang diterapkan dalam penelitian ini adalah penelitian hukum normatif, yang mengambil perspektif konseptual, komparatif, dan perundang-undangan. Norma hukum positif, asas keadilan, dan standar internasional digunakan dalam studi kualitatif data hukum. Menurut temuan studi ini, aturan nasional belum maksimal dalam menjalankan gagasan perlindungan sosial dan kesetaraan gender, yang dituntut oleh hak asasi manusia. Hak atas kepastian, keadilan, dan tunjangan bagi pekerja perempuan hanya dapat dijamin melalui harmonisasi regulasi dan penguatan penegakan hukum. Penelitian menunjukkan bahwa pemberian cuti orang tua berbayar bermanfaat bagi masyarakat secara keseluruhan, membantu memastikan perempuan diperlakukan dengan hormat, dan berfungsi sebagai langkah kebijakan ketenagakerjaan.
