Abstract

Technological developments to date have had a rapid impact on all aspects of life, including economic aspects and aspects of government administration; many things have arisen and have had positive impacts, such as ease of access to information and simplification of services by the government. So that technology-based services can be prepared and implemented based on a policy that cannot be separated from the legal theory that binds it. In order to support ease of investment services, the Government has initiated an Online Single Submission (OSS) system since October 2017 as an implementation of Presidential Regulation Number 91 of 2017 concerning the Acceleration of Business Implementation and has conducted concept trials in three locations, namely: Purwakarta, Batam, and Palu. The design of this Information Technology-based system is basically by interconnecting and integrating the existing licensing service system at BKPM/Central PTSP (SPIPISE), a regional PTSP that uses the Ministry of Communication and Information's SiCantik system. In practice, the licensing implemented uses a one-door system, which makes it quicker for investors to process port permits. In this case, BP Batam provides services in the form of Indonesia Batam Online Single Submission or IBOSS. Licensing that previously used manual or conventional methods has switched to an electronic system connected directly to the national system. Port permits are now also handled directly by the BP Batam One-Stop Integrated Services (PTSP) Directorate, which impacts the speedy completion of port permit processing. However, in implementing technology-based services, it is essential to pay attention to regulatory or legal aspects so that implementation remains safe and does not cause material or non-material losses. To safeguard data, the application guarantees that the data recorded by Business Actors is only for Business Licensing services. However, even though there are guarantees or clauses, comprehensive research must still be carried out regarding technology-based services in order to support increased investment, considering that data security is an essential thing in running services.

Abstract

The determination of minimum wage is one of the instruments of state policy to realise social justice for workers, especially in guaranteeing a decent income and protecting weak economic groups. The Wage Council, as a tripartite institution consisting of elements of government, employers, and labour unions, has a strategic role in formulating minimum wage recommendations to regional heads. This research is motivated by the reality that although legal arrangements on the role of the Wage Council have been regulated in various regulations, the implementation in the field, especially in Batam City, has not fully reflected the principles of social justice as referred to in Articles 27 and 28D of the 1945 Constitution. This research aims to juridically analyze the role and function of Wage Council in the process of determining minimum wage for workers in Batam City, assess the obstacles faced, and provide solutions based on the theoretical approach of justice, legal system, and legal certainty. The research methods used are normative juridical and empirical juridical, with primary data obtained through interviews with government elements, trade unions, and employers, as well as secondary data in the form of legislation and legal literature. The results show that normatively the role of the Wage Board has a clear legal basis, but in its implementation there are still obstacles such as imbalance in bargaining position, political intervention, and weak supervision of the application of wage structures and scales. Solutions offered include strengthening regulations based on legal certainty, increasing the technical capacity of Council members, and participatory strategies that involve workers more actively. The research recommends institutional reform and strengthening transparency to ensure a fairer and more sustainable wage system.

Abstract

The Military Police serve as the internal law enforcement within the Indonesian National Armed Forces (TNI), strategically maintaining order and discipline among soldiers as part of the military justice system. The increasing issue of disciplinary violations within the military environment, especially in strategic areas such as Batam, presents a real challenge for the Military Police Detachment I/6 Batam in carrying out its duties. This study aims to analyse, from a legal perspective, the legal regulations, the effectiveness of task implementation, and the obstacles and solutions that can be applied to enforce military discipline. This research employs normative and empirical juridical approaches. Primary data were obtained through direct interviews with PM officers, field observations, and internal document studies, while secondary data were sourced from legislative regulations such as Law No. 34 of 2004, Law No. 25 of 2014, and the Military Criminal Code. The analysis used supervisory theory, legal system theory, and the theory of legal certainty as analytical tools. The research results show that, normatively, the legal basis for the role of the Military Police is already quite strong; however, in practice, the effectiveness of task implementation still faces internal obstacles such as limited personnel, operational facilities, and training, as well as external obstacles in the form of the influence of social dynamics, civil-military interactions, and weak inter-agency coordination. Enhancement efforts are being made through strengthening technology-based supervision systems, technical training, reinforcing military ethical values through daily orders from the Commander of the Indonesian National Armed Forces (TNI), and cross-agency synergy. It is recommended that the TNI institution and the government provide greater support in the form of policies, budgeting, and structured training to improve the effectiveness of the Military Police as disciplined law enforcers within a professional and dignified military body.
