Abstract

Abstract Local elections led to debate whether done directly or indirectly through the election or by the parliament. Indonesia has had the experience of regional heads directly elected by people through election and elected by parliament. Each model has a power and strength. This paper explore the local elections and argues that local elections held directly by popular vote, by reason of the election of regional heads have a strong constitutional basis and ensure the implementation of the people's sovereignty. Keywords: local election, democracy. Abstrak Pemilihan kepala daerah memunculkan perdebatan apakah dilakukan secara langsung lewat pemilu atau tidak langsung oleh DPRD. Indonesia selama ini memiliki pengalaman kepala daerah dipilih oleh DPRD maupun dipilih lewat pemilu. Masing-masing model tersebut memiliki kekuatan dan kekuatan. Tulisan ini menelusuri pemilihan kepala daerah dan mengargumentasikan agar pemilihan kepala daerah dilaksanakan secara langsung melalui pemilu, dengan alasan pemilu kepala daerah memiliki dasar konstitusional yang kuat dan lebih menjamin pelaksanaan kedaulatan rakyat. Abstract

ABSTRACT   Since the passing of reforms in 1998 has brought changes to the constitutional system of centralized to decentralized Indonesia, it means a government authority handed over to autonomous regions, except for the central government affairs. The principle of autonomy emphasizes providing government authority to local governments to regulate and manage their own affairs within the unity state of framework. Follow-up of these reforms have also been carried out by the 1945 Amendment to change the power to make laws that are on the government initially submitted to parliament. National legal and political system was changed to affect the formation of the orientation and priorities of legislation, including legislation as part of program activities inherent in the process of formation of national law. Accordingly, any establishment of legislation to do with the deepening of the material, the synchronization and harmonization with other legislation, as well as open access and dissemination to increase community participation. One of the priorities that must be done within the framework of the development of national law is to harmonize legislation to establish a form of regulatory legal instruments that guarantee the implementation of the rule of law while providing the broadest possible benefits for thewelfare of the people, namely the Local Legislation Program. ABSTRAK   Sejak bergulirnya reformasi tahun 1998 telah membawa perubahan pada sistem ketatanegaraan Indonesia dari sentralistik menjadi desentralistik, artinya sejumlah wewenang pemerintahan diserahkan kepada daerah otonom, kecuali urusan pemerintahan pusat. Prinsip otonomi daerah menekankan pada pemberian kewenangan pemerintahan kepada pemerintahan daerah untuk mengatur dan mengurus sendiri urusan pemerintahan yang menjadi kewenangannya dalam kerangka NKRI. Tindak lanjut dari reformasi ini juga telah dilakukan Perubahan  UUD 1945 dengan merubah kekuasaan membentuk undang-undang yang pada mulanya berada pada Pemerintah diserahkan kepada DPR. Sistem dan politik hukum nasional pun berubah yang mempengaruhi orientasi dan prioritas pembentukan peraturan perundang-undangan termasuk kegiatan program legislasi sebagai bagian yang inheren dalam proses pembentukan hukum nasional. Sejalan dengan hal tersebut, maka setiap pembentukan peraturan  perundang-undangan harus dilakukan dengan pendalaman materi, sinkronisasi dan harmonisasi dengan peraturan perundang-undangan lain, serta diseminasi untuk membuka akses dan meningkatkan partisipasi masyarakat. Salah satu prioritas yang harus  dilakukan  dalam  rangka pembangunan hukum nasional adalah melakukan harmonisasi peraturan perundang-undangan dengan membentuk suatu instrumentasi hukum berupa peraturan yang lebih menjamin terlaksananya kepastian hukum sekaligus memberikan kemanfaatan yang seluas-luasnya bagi kesejahteraan rakyat, yaitu program legislasi daerah. Abstract

Abstract Corruption is an act that violates the law, harm the people and state finances. Corruption is done by way of abuse of power not only applies to government agencies, but also can occur in institutions outside the government. Efforts have been made in order to prevent and combat corruption had been still less than optimal. Therefore, it required the application of a good governance with the establishment of Integrity Zone Region Free of Corruption to minimize corruption effectively. Keywords: Good Governance,  Integrity Zone, Corruption. Abstrak Tindak pidana korupsi adalah perbuatan yang melanggar hukum, merugikan rakyat sekaligus keuangan negara. Korupsi yang dilakukan dengan cara menyalahgunakan kekuasaan tidak hanya berlaku pada institusi pemerintahan, akan tetapi juga dapat terjadi pada institusi di luar pemerintahan. Upaya yang telah dilakukan dalam rangka mencegah dan menanggulangi korupsi selama ini masih kurang optimal. Oleh karena itu diperlukan penerapan pola pemerintahan yang bersih disertai penetapan Zona Integritas Wilayah Bebas Korupsi untuk meminimalisir korupsi secara efektif. Abstract

Technological developments to date have had a rapid impact on all aspects of life, including economic aspects and aspects of government administration; many things have arisen and have had positive impacts, such as ease of access to information and simplification of services by the government. So that technology-based services can be prepared and implemented based on a policy that cannot be separated from the legal theory that binds it. In order to support ease of investment services, the Government has initiated an Online Single Submission (OSS) system since October 2017 as an implementation of Presidential Regulation Number 91 of 2017 concerning the Acceleration of Business Implementation and has conducted concept trials in three locations, namely: Purwakarta, Batam, and Palu. The design of this Information Technology-based system is basically by interconnecting and integrating the existing licensing service system at BKPM/Central PTSP (SPIPISE), a regional PTSP that uses the Ministry of Communication and Information's SiCantik system. In practice, the licensing implemented uses a one-door system, which makes it quicker for investors to process port permits. In this case, BP Batam provides services in the form of Indonesia Batam Online Single Submission or IBOSS. Licensing that previously used manual or conventional methods has switched to an electronic system connected directly to the national system. Port permits are now also handled directly by the BP Batam One-Stop Integrated Services (PTSP) Directorate, which impacts the speedy completion of port permit processing. However, in implementing technology-based services, it is essential to pay attention to regulatory or legal aspects so that implementation remains safe and does not cause material or non-material losses. To safeguard data, the application guarantees that the data recorded by Business Actors is only for Business Licensing services. However, even though there are guarantees or clauses, comprehensive research must still be carried out regarding technology-based services in order to support increased investment, considering that data security is an essential thing in running services.

Abstract

The granting of Batam Island management rights is stated in Article 6 paragraph (2) letter a of Presidential Decree Number 41 of 1973, stating that all land areas located on Batam Island are handed over with management rights to the Chairman of the Batam Island Industrial Area Development Authority (later called the Batam Authority). Referring to Article 4 of Government Regulation Number 46 of 2007, Management Rights over land under the authority of the Batam Authority and Management Rights over land under the authority of the Batam City Government located in the Batam Free Trade Zone and Free Port are transferred to BP Batam by statutory regulations. Invitation. The areas in question are Batam Island, Setokok Island, Watch Island, Nipah Island, Galang Baru Island, Rempang Island, and Galang Island. However, replacing the subject of management rights does not end existing rights on Management Rights land; these rights remain in effect until the validity period ends. Thus, currently, Batam City Management Rights are owned by BP Batam. Problems with management rights also occur in the community of Batam City. This is, of course, a result of the development of Batam City, where the land rights are mainly allocated to industrial areas, housing (residential), government, and protected forests. One of the purposes of granting Management Rights to BP Batam was to accelerate investment. However, during the process, it was discovered that the land allocated to a third party (Investor) had yet to be physically developed as agreed upon at the time of allocation. This then becomes the basis for BP Batam to carry out evaluation and control over land that is not built and built not by its intended use.

Abstract

Children and teenagers are the next generation of the nation and are family and state assets that must be safeguarded and protected in all aspects of their lives, including physical, psychological, intellectual, their rights, and their dignity. Protecting children is not only the responsibility of parents but also the responsibility of all of us. The purpose of this research is to determine the legal basis for the formation of policies for implementing compulsory school hours at night, the differences between the implementation of study hours at night and study hours during the day, goals and objectives, infrastructure, implementation, task force, duties and functions of the task force, and the sanctions and obstacles faced in implementing compulsory education at night. The specification method of this research is analytical descriptive, which describes finding legal facts systematically with the aim of making this research easier to understand and conclude. The results of the research show that there are efforts to protect and prevent juvenile delinquency from the Bintan Regency Government in the form of regional head policy, namely Regent's Regulation Number 66 of 2014 concerning Compulsory Night Study Hours for Children in Bintan Regency, which is in accordance with applicable regulations but is not yet effective because there are several obstacles in its implementation.

Abstract

The purpose of the protection of Indonesian Migrant Workers as stated in Article 3 of Law Number 18 of 2017 concern the Protection of Indonesian Migrant Workers is to ensure the fulfillment and enforcement of Human Rights as Indonesian citizens and migrant workers as well as to ensure legal, economic, and social protection. Indonesian migrant workers and their families. This research uses the library research method or library research.  The data sources used are primary and secondary data from press releases, as well as data from the Batam City Placement and Protection Service Post for Indonesian Migrant Workers (P4MI), then the data were analyzed by descriptive analysis method. Every prospective Indonesia Migrant worker has the same rights and obligations to get a job abroad and choose a job according to his competence, gain access to self-capacity through education and job training, and obtain correct information about the job market, placement procedures, and conditions. Based on the data analysis conducted, it is concluded that the government’s efforts to provide legal protection for Indonesian   Migrant Workers so far can be seen from the form of legislation issued in response to the needs of Indonesian Migrant workers.

Abstract

BP Batam has very broad authority to manage Batam Island in order to attract investors to invest their capital in Batam Island. Land problems that occur in the city of Batam must be resolved by BP Batam as the authority holder for management rights in Batam in accordance with Head of BP Batam Regulation No. 26 of 2021 concerning Implementation of Land Management. The study's goal is to find out how BP Batam's duties to people who receive land allocations for problematic land are carried out and what factors affect those duties. This research uses empirical juridical qualitative methods, using one legal action against problematic land as a sample. Findings from the study show that BP Batam's duties and goals have been met in how they handled their responsibilities to people who were given problematic land. The obstacles faced so far are due to the lack of communication between BP Batam and the communities that receive problematic land allocations in the city of Batam. BP Batam's obligations are stated to be limited to planning the allocation and use of land and exploiting or using land for purposes of carrying out its duties. Implementation is proven by monitoring and taking action against problematic land, which is the authority of BP Batam.

Abstract

The police are law enforcement agencies that are given the authority to carry out investigations and investigations of criminal acts which are then faced with legal developments in the form of the concept of resolving criminal cases using restorative justice which aims to provide legal certainty, benefit, and justice. Therefore, this study aims to find out how the legal arrangements, implementation, and constraint factors as well as solutions related to the application of a Restorative Approach to the Settlement of Criminal Cases by the Directorate of General Criminal Investigation of the Riau Islands Police are made. This study uses empirical legal research (field) using a normative juridical approach, namely in the form of an analysis of the legal arrangements that regulate matters that become problems to obtain secondary data, and a sociological juridical approach to obtain primary data through field research. The results of this study indicate that the legal arrangements in this writing are the Circular Letter of the Chief of Police Number SE/8/VII/2018 concerning the Application of Restorative Justice in the Settlement of Criminal Cases, the Regulation of the Chief of Police Number 6 of 2019 concerning Investigation of Criminal Acts Article 12 and the State Regulation of the Republic of Indonesia Number 8 2021 on Handling Crimes Based on Restorative Justice.

Abstract

One of the cross-border crimes that often utilize Indonesian territory as a transit point is human smuggling, popularly known as people smuggling. Human smuggling is classified as a transnational organized crime with a wide area of operation. Indonesia is one of the areas of the country targeted by illegal immigrants before being smuggled to their destination, namely countries on the Australian continent. This phenomenon has made human smuggling a criminal offense taken very seriously by all levels of the world community. In less than two decades, significant changes in Indonesia's strategic environment in the form of upheaval in the Asian region have encouraged human smuggling crimes and become one of the most exciting types of transnational crimes. Riau Islands, as one of the provinces in Indonesia, is a strategic area that has sea borders with Singapore and Malaysia, causing Riau Islands to become a stopover place for illegal migrants and the perpetrators so that there are many human smuggling mafias roaming around looking for victims. One of the factors triggering human smuggling that is difficult to eradicate and still occurs today in the Riau Islands is the existence of sectoral egos and various forms of modus operandi carried out by human smugglers.
