Abstract

One of the regions in Indonesia that has experienced delays in the Pilkades several times due to government policies and regulatory uncertainty is Banyuwangi Regency. After experiencing uncertainty, finally the Simultaneous Pilkades during the COVID-19 Pandemic has a legal umbrella with the presence of Permendagri No. 72 of 2020. In 2021, the Simultaneous Pilkades in Banyuwangi Regency can finally be held. This research will examine how the implementation of Permendagri No. 72 of 2020 in the implementation of the Simultaneous Pilkades in Banyuwangi Regency in 2021. This research combines normative-empirical, normative data that issupported by the addition of data or empirical elements through a statutory approach and a case approach.materials (primary, secondary, tertiary) collected are then analyzed using content analysis methods The results of the study indicate that the follow-up to the presence of Permendagri No. 72 of 2020, the Banyuwangi Regency Government issues the Banyuwangi Regional Regulation No. 13 of 2021 concerning Implementation Guidelines on Guidelines for Election, Appointment, Inauguration and Dismissal of Village Heads, then the Banyuwangi Regent also issued Decree No. 188/72/Kep/429.011/2021 regarding the formation of district election committees and sub-district committees and based on interviews with representatives of several villages that held Pilkades, basically the implementation of Pilkades in the field has implemented the protocol according to the provisions of Perbup No. 188/72/Kep/429.011/2021. 13 of 2021 and Permendagri No. 72 of 2020. So based on the results of the study it can be concluded that the Banyuwangi Regency Government has implemented Permendagri No. 72 of 2020 is in the implementation of Simultaneous Pilkades in their area.

Abstract

The presence of four new autonomous regions (DOB) in Papua completes the number of provinces in Indonesia to 38. This study examines the formation of the new autonomous region in Papua from the perspective of state administrative law. This type of research is juridical normative with a statutory, concept, and case approach. The study results show Law Number 2 of 202,1, which eliminates preparation areas, even though the preparation areas are crucial in forming a new autonomous region. With asymmetric decentralization, special autonomy will be imposed on the new autonomous regions in Papua, which have specificity regarding authority, finance, and institutions. However, there are several notes, such as the Governor and DPRP formed from the results of the 2024 simultaneous elections & regional election; as a result, the acting governor is equipped with crucial authority that is prone to conflict of interest. This article also provides ideas and recommendations regarding the formation of the Papua new autonomous region as follows: 1) The implementation of primary areas in the process of forming the Papua new autonomous region; 2) The government immediately issued government regulation of Desartada; 3) Maximizing the participation of indigenous Papuans in the establishment of the new autonomous region in Papua.

Abstract

The COVID-19 pandemic has implications for the postponement of the Simultaneous Pilkades in Indonesia. It's interesting to examine more deeply how the Simultaneous Pilkades policy arrangements during the COVID-19 Pandemic are viewed from the aspect of legal certainty and the legal consequences of postponing the Pilkades during the COVID-19 Pandemic. The research method uses a normative juridical approach with the statute approach and case approach. Legal materials (primary, secondary ,tertiary) were collected through literature study and analyzed in depth using content analysis. Research shows that prior to the pandemic in the laws and regulations the rules regarding the postponement of Simultaneous Pilkades due to force majeure had not been regulated. The authority of the Ministry of Home Affairs to determine the postponement of the Simultaneous Pilkades also has multiple interpretations. The government's policy of issuing the Mendagri Circular is also inaccurate and does not provide legal certainty, the circular is not classified as a statutory regulation. The presence of Permendagri No.72 of 2020 provides legal certainty, the substance clearly regulates the authority of the Regent/Mayor to postpone the Simultaneous Pilkades. The legal consequence of postponing the Pilkades during the Pandemic Period is that many villages will be led by an Acting Village Head. In the future, the provisions regarding the postponement of Simultaneous Village Head Elections due to force majeure are clearly regulated in the legislation and in carrying out tasks by the Acting Village Head must be carried out with full responsibility, because the Acting has the same duties, authorities, obligations and rights as the definitive Village Head. Abstrak Pandemi COVID-19 berimplikasi pada penundaan Pilkades Serentak di Indonesia. Namun pengaturan ihwal penundaan Pilkades Serentak dalam peraturan perundang-undangan ternyata kurang jelas. Menarik untuk mengkaji lebih dalam bagaimana pengaturan kebijakan Pilkades Serentak di masa Pandemi COVID-19 ditinjau dari aspek kepastian hukum dan akibat hukum dari adanya penundaan Pilkades di masa Pandemi COVID-19. Metode penelitian menggunakan yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Bahan-bahan hukum (primer, sekunder, tersier) dikumpulkan melalui studi kepustakaan dan dianalisa secara mendalam menggunakan metode analisis konten. Penelitian menunjukan bahwa sebelum pandemi dalam peraturan perundang-undangan (UU, PP, Permendagri) aturan mengenai penundaan Pilkades Serentak karena force majeur (bencana non alam) belum diatur. Kewenangan Kemendagri menetapkan penundaan Pilkades Serentak juga multitafsir. Kebijakan pemerintah mengeluarkan Surat Edaran Menteri Dalam Negeri juga kurang tepat dan tidak memberikan kepastian hukum, surat edaran bukan dikelompokkan sebagai sebuah peraturan perundang-undangan. Akhirnya kehadiran Permendagri No. 72 Tahun 2020 memberikan kepastian hukum, subtansinya mengatur secara jelas kewenangan Bupati/Walikota menunda Pilkades Serentak karena situasi darurat COVID-19 serta mekanisme dan teknis pelaksanaan Pilkades Serentak dalam situasi darurat COVID-19. Akibat hukum dari penundaan Pilkades di Masa Pandemi adalah banyak desa yang akan dipimpin oleh seorang Penjabat Kepala Desa. Kedepan ketentuan mengenai penundaan Pilkades Serentak karena force majeur diatur secara jelas dalam peraturan perundangan-undangan dan dalam pelaksanaan tugas oleh Penjabat Kepala Desa harus dilakukan dengan penuh tanggung jawab, karena Penjabat memiliki tugas, wewenang, kewajiban dan hak yang sama seperti Kepala Desa definitif.

Abstract

There were pros and cons in various circles regarding the application of additional castration crimes in Indonesia for perpetrators of sexual crimes. This paper will examine the application of castration in Indonesia from the perspective of Islamic legal. This research includes the type of normative juridical research and will use statutory, conceptual, and case approaches. Primary, secondary, and tertiary legal materials collected through library research will later be analyzed qualitatively using prescriptive and descriptive methods. The results of the study concluded that the application of castration in Indonesia is included in the Ta'zir category, so the application of castration in Indonesia is very feasible in Indonesia. Even its application is not arbitrary, because through a strict mechanism and the nature of this punishment is limited to child sexual crimes. This castration is temporary, not permanent. So this application needs to be done to provide a deterrent effect and reduce the risk of recidivism.

Abstract

Sebagai upaya meningkatkan pendapatan daerah dan kesadaran masyarakat di bidang perpajakan, pemerintah melakukan terobosan restrukturisasi dan penyederhanaan pajak dan retribusi daerah melalui UU HKPD. Penelitian ini menggunakan metode yuridis normatif melalui pendekatan perundang-undangan. Semua bahan hukum dihimpun melalui studi kepustakaan, kemudian dianalisis secara komprehensif melalui teknik deskriptif-analitis. Hasil penelitian menunjukan bahwa dikarenakan terdapat problematika dan kekurangan dalam UU PDRD, Undang-Undang No. 1 Tahun 2022 hadirĀ  mereformasi sistem fiskal daerah melalui penyederhanaan jenis pajak dan retribusi daerah dan menghadirkan jenis pajak baru. Jenis pajak daerah (provinsi dan kabupaten) lebih dirampingkan dan diperkenalkan jenis pajak baru yaitu opsen. Sementara jenis retribusi cukup banyak disederhanakan, jenis retribusi jasa usaha tidak banyak berubah namun jenis retribusi jasa umum dan retribusi perizinan mengalami banyak perubahan. Penulis meyakini langkah ini akan mampu mendorong kesadaran masyarakat dan peningkatan pendapatan asli daerah, karena melalui efisiensi ini masyarakat akan lebih mudah memenuhi kewajibanya sebagai wajib pajak. Selain ituĀ  daerah akan mudah melakukan pengawasan dan optimalisasi penerimaan PAD, sehingga potensi kebocoran dapat diminimalisir.
