Abstract

In general, there are laws that provide protection to banks as lenders to obtain repayment of their debts when the debtor is in default, this is stated in Article 1131 of the Civil Code which reads: "All assets of the Debtor, whether movable or immovable, whether existing ones or those that will be in the future become dependents/guarantees. Debtor's assets, both movable and immovable, both present and future will become dependents/guarantee for their debts”. Then Law Number 4 of 1996 was born which specifically regulates the implementation of Mortgage (UUHT). One of the characteristics of the UUHT is that it is easy and certain to execute, which means executing the mortgage certificate. must be carried out but can still provide legal certainty for interested parties, in this case, the auction seller, auction buyer and auctioneer. Therefore, in carrying out executions based on parate execution, it must be able to provide convenience and legal certainty for all interested parties

Abstract

The development of Islamic substantive law in Indonesia—encompassing waqf (endowment), wills, grants (hibah), and sharia financing—demands legally valid documents with evidentiary force. However, the drafting techniques of sharia deeds are regulated across various statutory instruments, raising questions regarding their validity and position within the national legal system. This study aims to analyze the drafting techniques of sharia deeds under statutory regulations, examine their validity and evidentiary force, and explore the practice of the Sharia TPA Laboratory as a means of mastering deed-drafting skills. This research employs normative legal methods with statutory and conceptual approaches. Primary legal materials—including the Notary Office Law, the Compilation of Islamic Law, the Waqf Law, and related regulations—are analyzed qualitatively through grammatical and systematic interpretation. This study affirms that the validity of sharia deeds is determined by the fulfillment of formal and material requirements under statutory regulations, while their evidentiary force depends on the authority of the drafting official. The Sharia TPA Laboratory plays a strategic role in bridging theory and practice through deed-drafting simulations.

Abstract

The digital transformation of Islamic economic transactions has encouraged the use of electronic signatures as an instrument to improve efficiency, accessibility, and speed in the implementation of Islamic contracts. However, the use of electronic signatures in Sharia transactions raises legal issues concerning the validity of contracts and the legal status and evidentiary strength of electronically executed instruments, particularly in relation to the characteristics of authentic deeds under the Indonesian legal system. This study aims to analyze the validity of electronic signatures in Sharia transactions and their implications for the validity and evidentiary strength of authentic deeds. This research employs normative legal research using statutory, conceptual, and case approaches. The analysis examines legal provisions governing notarial authority, electronic transactions and electronic signatures, evidentiary law, and the principles of contracts under Islamic economic law. The results indicate that the use of electronic signatures may, in principle, establish the validity of electronic transactions provided that the requirements stipulated by applicable laws and regulations are fulfilled and the transaction does not contravene Sharia principles. Nevertheless, the use of an electronic signature does not automatically confer the status of an authentic deed upon an electronic document. The authenticity of a deed remains dependent on the fulfillment of formal and substantive requirements established under Indonesian notarial law. Therefore, the digital transformation of Sharia contracts requires harmonization between technological developments, positive law, notarial authority, and Sharia principles in order to ensure legal certainty and legal protection for the parties.
