Abstract

Marriage is a form of cooperation between a man and a woman in society under special regulations and this is taken into account by religion, state, and custom. In general, marriage is a process of uniting two different individuals into a husband and wife with the aim of building a household and strengthening brotherhood between families. Marriage not only concerns the individual of husband and wife but also concerns all family and community matters. The definition of marriage based on the provisions of Article 1 of Law Number 1 of 1974 concerning Marriage states that "Marriage is an inner and outer bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family or household based on the belief in the Almighty God." Marriages can be carried out with different nationalities which are called mixed marriages. Article 57 Law no. 1 of 1974 Mixed Marriage is a marriage between two people who in Indonesia are subject to different laws, due to differences in nationality. The consequences of mixed marriages can have an impact on the status of children and marital assets because each country has its policies regarding mixed marriages and citizenship. In addition to containing matters related to marriage, the Marriage Law regulates marital property. This field is one of the areas of civil law with a sensitive nature and the potential to cause conflict because regulating this field is not as easy as regulating neutral legal fields. The complexity of problems in the area of ​​wealth resulting from mixed marriages, apart from being based on the Marriage Law No. 1 of 1974, also deals with the principles of International Private Law.

Abstract

Penelitian ini menganalisis secara yuridis Pasal 39 Ayat 2 UU No. 1 Tahun 1974 tentang Perkawinan yang mengatur pelaksanaan perceraian tanpa persetujuan satu pihak pasangan. Pasal ini memungkinkan pengadilan mengabulkan perceraian meskipun salah satu pihak tidak setuju, asalkan ada alasan yang sah dan sesuai dengan peraturan hukum. Tujuan penelitian adalah untuk memahami implikasi hukum dari ketentuan tersebut, termasuk dampaknya terhadap keadilan dan hak-hak pasangan yang terlibat dalam proses perceraian. Metode penelitian yang digunakan adalah yuridis normatif, dengan menganalisis peraturan perundang-undangan dan studi kasus terkait. Penelitian ini juga membandingkan penerapan hukum dalam putusan pengadilan untuk mengevaluasi keadilan dalam perceraian yang diajukan sepihak. Hasil penelitian menunjukkan bahwa ketentuan Pasal 39 Ayat 2 memberi fleksibilitas bagi pihak yang mengalami masalah dalam perkawinan untuk mengajukan perceraian, namun dalam beberapa kasus dapat menimbulkan ketidakadilan bagi pihak yang tidak setuju. Oleh karena itu, pengadilan harus secara hati-hati mempertimbangkan hak dan kepentingan kedua belah pihak, terutama dalam kasus yang melibatkan perempuan dan anak, untuk menjaga keseimbangan antara kebebasan individu dan perlindungan hukum.

Abstract

This study analyzes the implications of substantive errors in court petitions regarding the recognition and legitimization of extramarital children, focusing on enhancing their legal status following the death of the biological father. Based on a case study of Pontianak District Court Determination No. 246/Pdt.P/2021/PN Ptk, it was found that inaccuracies in the substance of the petition can result in ambiguous legal determinations, particularly regarding the child’s status as a recognized but not fully legitimate child. This ambiguity impacts the civil rights of extramarital children, including inheritance rights from their biological father. This research employs doctrinal legal methodology with a descriptive-analytical approach through a literature review, aiming to comprehensively explain the court’s essential role in ensuring the completeness of petition substance from the initial stages, especially at Meja I (Desk I). The findings emphasize the importance of legitimizing extramarital children to secure a stronger legal status equivalent to legitimate children, ensuring the protection of civil rights and reducing the potential for future legal conflicts.

Abstract

Child Custody can be given to a parent in accordance with the best interest of the child. In reality, many parents who hold child custody do not do their responsibility in caring for and protecting their child well. This reality leads to many child abuse cases and even the death of the child. This research aims to examine should the child custody is revoked in some cases discussed in this research and how the parent who does not hold child custody can supervise child custody. This research was conducted using doctrinal research method which used the secondary data as a primary data to answer the problem. The answer of the problem is that the revocation of child custody is needed if the parent who holds child custody do not fulfill responsibility to her or his child as regulated in Article 49 of The Marriage Law. The parent who does not hold child custody can supervise child custody with visitation right. Unfortunately, there is no explicit regulation regarding this right.

Abstract

Joint asset causes legal consequences in entering into a loan agreement and its accessor, collateral agreement. These legal consequences shall arise as spousal consent is necessary in entering into such agreement. However, many collateral agreements are arranged without a spousal consent. The purpose of this writing to find out the legal consequences of collateral agreements which are entered into only by one of the parties, husband or wife, over the joint assets and responsibility(s) of the Notary Public and Land Deed Official Certifier (“Pejabat Pembuat Akta Tanah/ PPAT”) regarding the agreement. This study utilizes normative juridical approach which was carried out by examining data from legal norms in the society, including laws and regulations. Based on its characteristic, this research is a descriptive study. The result of this study is agreement remains binding on the joint asset despite the collateral agreement being entered into without spousal consent. Meanwhile, the responsibility of the Notary Public and PPAT if they are proven to neglect their obligation is considered unlawfulacts.

Abstract

This paper analyzes the legal provisions of child adoption in Indonesia in the Child Protection Law and Government Regulation Number 54 of 2007 and its implementation in Decision Number 269/Pdt.P/2024/PN Smg. This paper was compiled using a doctrinal research method. In the process, child adoption must be motivated by the fulfillment of the child's best interests and in accordance with applicable legal procedures. The case study of Decision Number 269/Pdt.P/2024/PN Smg shows the legal implementation of the principles of child protection in child adoption in Indonesia. The applicant has cared for and raised his prospective adopted child since birth, fulfilling the child's physical, emotional, and social needs well. In addition, the Applicant's financial and emotional conditions have also met the applicable requirements, as evidenced by a statement from the Social Service. Overall, this decision provides an illustration that child adoption carried out in accordance with the law can be a solution that provides benefits for all parties, especially for children as the main subject of legal protection.
