Abstract

Law and society are interconnected in the digital world. The viral case of a scholarship recipient from the Education Fund Management Institute whose nationalism declined due to insults to the state through social media, sparked a public movement responding to various opinions. This article aims to educate the public on the wise use of social media from a sociological perspective. The sociological research method uses a qualitative approach, employing a sociological perspective of law. The research results, according to social theory in global history, are manifested in the form of neoliberalism, with the intention of viewing society as individuals who behave as economic beings. This addresses the function of law in society to prevent conflicts of interest. If occur, the law becomes a tool used to resolve the consequences of individual violations that insult the state. According to the Law of the Republic of Indonesia, the Education Fund Management Institute Scholarship Agreement between the government and the people meets the requirements for the validity of the agreement as stipulated in Article 1320 of the Civil Code. This means that the agreement is legally binding for the parties bound by it. Violation of the Education Fund Management Institute Scholarship Agreement by failing to return to Indonesia to serve the national interest after completing studies can result in a civil lawsuit. A civil lawsuit based on breach of contract involves failure to fulfill obligations inherent in a valid agreement, namely the existence of a measurable agreement of rights and obligations (performance).

Abstract

The rule of law is applied to perpetrators of sexual harassment against students who will be punished. This study aims to provide a deterrent effect to perpetrators of sexual harassment so as not to do it again, prevent others from doing it, and provide justice to victims of sexual harassment. This research uses a quantitative descriptive approach. Perpetrators of sexual harassment against children in Cimacan State Elementary School, Cianjur Regency are the variables studied. This research has obtained an approval letter from the Cianjur District Education Office. Sampling also involved the parents of the school students. The results showed that the government of the Republic of Indonesia made Law number 23 of 2002 concerning Child Protection to protect children in Indonesia. Articles 46, 47, and 48 of Law No. 23 of 2004 on the Elimination of Domestic Violence regulate law enforcement against perpetrators of sexual abuse against children, including fines and imprisonment for a minimum of three years and a maximum of fifteen years. Several articles in the Criminal Code regulate law enforcement against perpetrators of sexual abuse against children, such as Adultery; Rape; Murder; and Molestation.

Abstract

Posisi jaksa sebagai dominus litis yang rentan terhadap tekanan sosial-politik, terutama dalam perkara sensitif yang melibatkan tokoh publik dalam studi kasus perkara Basuki Tjahaja Purnama (Ahok). Rumusan masalah meliputi konsep etika jaksa, prinsip keadilan dalam penuntutan tokoh politik, evaluasi etika jaksa dalam perkara politik, serta apakah penuntutan kasus Ahok mencerminkan prinsip keadilan. Tujuan penelitian adalah untuk menganalisis keempat hal tersebut secara kritis. Metode yang digunakan adalah yuridis normatif dengan pendekatan konseptual, kasus, dan perundang-undangan. Hasil penelitian menunjukkan bahwa dalam kasus Ahok, jaksa menghadapi ketegangan antara tuntutan profesionalisme dan tekanan publik massal serta intervensi politik. Tuntutan jaksa yang lebih ringan (1 tahun percobaan) dibanding putusan hakim (2 tahun penjara) memicu perdebatan tentang objektivitas dan independensi. Dari perspektif filsafat hukum, kasus ini memperlihatkan dominasi pendekatan formalistik yang tekstual dibanding keadilan substantif, serta adanya pengabaian konteks sosial dan niat terdakwa. Penelitian ini menyimpulkan bahwa penguatan etika profesi dan mekanisme pengawasan independen sangat diperlukan untuk menjamin penuntutan yang adil dan bebas intervensi.

Abstract

Background: Juvenile delinquency, including crimes committed by children, is a pressing social issue in various regions. Children are often unable to fully comprehend and take responsibility for their actions due to their developmental stage and environmental influences. To address this, the judicial process for children differs from that of adults, aiming to minimize psychological harm. Law Number 11 of 2012 on the Juvenile Criminal Justice System serves as the legal framework to protect children’s rights while addressing their offenses. Objectives: This study aims to analyze the occurrence of violent theft by children, understand contributing factors, and evaluate the application of the juvenile justice system in handling such cases.. Methods: The study uses a qualitative approach, analyzing legal documents, court cases, and interviews with stakeholders, including law enforcement, psychologists, and social workers, to understand the legal and social dimensions of violent theft involving children. Research Findings: The findings reveal that environmental factors, lack of supervision, and socio-economic issues are significant contributors to children’s involvement in violent theft. The juvenile justice system plays a crucial role in rehabilitating offenders and preventing recidivism. Conclusion: Addressing juvenile delinquency requires an integrated approach involving legal, social, and psychological interventions. Strengthening family and community support systems is vital to reducing the incidence of violent theft by children.
