Abstract

Nowadays, we often hear about many legal incidents and even see them ourselves in society, one of which is the rise of bullying which is very rampant both among adults and children. Bullying will cause harm to the victim, whether physical or mental harm to a person, and often results in the loss of a person's life. In this case, it is hoped that many parties will be involved in preventing bullying, not only parents or those closest to them who will play a role in providing protection and prevention, but the government will also be involved in it. Regarding bullying actions that are often carried out in elementary schools involving children as victims or even as perpetrators, the government has created an Independent Curriculum, one of which includes the implementation of the Pancasila Student Profile Strengthening Project or known as P5. Activities are designed to strengthen efforts to achieve competence and character according to the Pancasila Student profile. It is hoped that the Independent Curriculum related to the implementation of the Pancasila Student Profile Strengthening Project can encourage and shape the character of young people so that they can carry out their role as good human beings.

Abstract

Abstract

This article examines the status of Banjar customary law as a living law and its potential integration into regional regulations in South Kalimantan using Eugen Ehrlich’s theory of the living law. This normative legal study employs a conceptual approach, a statutory approach, and document analysis of both national and regional regulations. The findings demonstrate that Banjar customary law fulfills the characteristics of a living law, possessing strong social legitimacy and functioning as a mechanism for dispute resolution grounded in deliberation and social restoration. Nonetheless, its integration into the formal legal system faces challenges, including the absence of a regional recognition regulation (Perda Rekognisi), the lack of limited codification, and normative disharmony between customary law and state law. This study proposes an integration model based on recognition-oriented regional regulations, limited codification, and synergy with the national restorative justice framework. The findings contribute conceptually to strengthening legal pluralism in Indonesia and formulating regionally responsive policies rooted in local values.

Abstract

Customary law (hukum adat) constitutes an integral component of the cultural identity of South Kalimantan, particularly among Banjar communities and other local groups. As a living legal system transmitted across generations, customary law not only regulates social relations but also preserves collective values, norms, and local wisdom. This study examines the role of customary law in maintaining cultural identity in South Kalimantan while analyzing the challenges and opportunities it faces in the modern era. Using a normative-empirical legal approach, the research combines doctrinal analysis of relevant legislation with field-based observations and secondary data to explore how customary norms interact with state law, modernization, and globalization. The findings indicate that customary law continues to play a significant role in strengthening social cohesion, conflict resolution, and the preservation of cultural values such as deliberation, mutual cooperation, and harmony with nature. However, it also encounters challenges, including legal marginalization, declining intergenerational transmission, and pressures from economic development and formal legal systems. Despite these challenges, modernization offers opportunities for the revitalization of customary law through legal recognition, institutional integration, and community-based cultural education. The study concludes that strengthening the synergy between customary law and state law is essential to ensure the sustainability of cultural identity in South Kalimantan in the context of contemporary societal change.
