Abstract

The aim of the article is to analyze financial transparency of the political parties. The methods used normative Juridical. Political parties are an important element of the state system in a country that adheres to the principle of democracy. Political parties can be a place for people to channel their aspirations, but increasingly. Therefore, as an important element in order democracy, political parties must begin to improve more transparent to the public about the management and use of party funds. Law No. 14 of 2008 has provided a standard for political parties wishing to uphold the agreement by making an Information Management and Documentation Officer (PPID).

Abstract

To administrative effort in the form of an objection, a maximum time of 21 working days is given. However, there are differences in the application of these administrative efforts between judex facti judges and judex juris judges. Judex facti judges through decisions number 21/G/2020/PTUN and 76/B/2021/PT.TUN JKT implementing administrative measures are mandatory, this decision was upheld by judges at the State Administrative High Court. However, the decision was annulled by the judge judex juris (Supreme Court level) through decision number 420 K/TUN/2021. The basis for the judex juris to cancel the judex facti decision is based on the phrase "can" as stated in Article 75 paragraph (1) of Law Number 30 of 2014 concerning Government Administration. So that administrative efforts through objections or administrative appeals are an option, not mandatory. Administrative efforts are efforts to realize the principles of Pancasila into the settlement of administrative problems, namely in the resolution of administrative problems so that they are first resolved through deliberation and consensus. If consensus deliberation cannot find a point of peace, it can be resolved through the State Administrative Court

Abstract

As a state of law, Indonesia, which adheres to the Civil Law system, actually makes omnibus law which is a legal system of Common Law. The omnibus law is considered to be the answer to the overlapping of all existing laws and regulations in Indonesia. Omnibus Law if it is associated with the Legal System in Indonesia is contrary to the system that has been applied in Indonesia. There are 7 factions that agree and 2 factions that reject the discussion of the Omnibus Law Bill. In the process, Article 5 of Law No. 12 of 2011 and Law No. 15 of 2019 contains the principle of the formation of legislation, one of the problems in the formation of the Omnibus Law Bill is the principle of openness. This is because there are various indications, including the exclusion of groups related to or having an impact on this Omnibus Law Bill. There was also a member of the DPR who was supposed to be one of the working committees (Panja) to discuss the Omnibus Law Bill which was not involved because there was no notification. There is also a difference in the number of pages in the Omnibus Law Bill. In the regulations, referring to Law Number 12 of 2011 and Law Number 15 of 2019 concerning changes to the Formation of Laws, there are no clear norms and explanations regarding the Omnibus law process both in forming laws and revising laws. The absence of a legal basis for the formation of this omnibus law rules out the legitimacy of a law. Thus the position of Omnibus Law in Indonesia is not in accordance with the existing legal system in Indonesia, especially related to the Indonesian legal system (Civil Law) and Law Number 12 of 2011 and Law Number 15 of 2019 concerning Amendments to Law Number 12 of 2011 concerning the Establishment of Legislation.

Abstract

Dalam pengetahuan hukum hidup (Wyaharacastra) membagi aparat penegak hukum menjadi beberapa nama, yakni Hakim yang dikenal dengan “Adhyaksa”, sedangkan Juris (ahli) ilmu hukum hindu dimaknai sebagai Pragwiwaka. Sedangkan hukum yang ada dan diterapkan disebut dengan Decadrasta yakni kebiasaaan dalam suatu daerah. Penamaan pemanam ini merupakan penamaa dalam struktur hukum yang ada di kerajaan Majapahit pada waktu itu. Menariknya dalam sistem hukum yang diberlakukan di Kerajaan Majapahit atau kerajaan sebelumnya seperti Sriwijaya, sumpah menjadi hukum tertinggi dalam rantai penerapan hukum di Kerajaan Majapahit. Dalam hal ini, Yamin menuliskan mengenai kesaktian sumpah kesetiaan menjadi kunci utama dalam ketertiban bermasyarakat dan bernegara dalam kerajaan – kerajaan pada masa lampau. Sumpah kesetiaan kepada kerajaan menjadi tumpuan utama bahkan dicantumkan dalam sebuah prasasti kerajaan tersebut.

Abstract

Bestuurdwang merupakan tindakan reparatoir yang bisa dijadikan alat untuk mencegah adanya pelanggaran professional dalam penyelenggaraan pemilu. Profesional dalam menjalan tugas dan fungsi sebagai penyelanggara pemilu adalah menaati asas yang sudah ditentukan. Tujuan penulisan ini untuk untuk memberikan gambaran terkait pentingnya tindakan reparatoir dalam mencegah adanya kesalahan dalam pembuatan kebijakan. Sedangkan metode penelitian yang digunakan dalam penulisan ini menggunakan metode normatif, dimana sumber preimernya adalah undang-undang dan sumber skundernya adalah kepustakaan. Salah satu pelanggaran kode etik yakni penyelenggaran pemilu tidak melaksanakan tugas dan fungsi secara profesional. Artikel ini akan menganalisis penerapan bestuursdwang terhadap penyelenggara pemilu tingkat daerah sebagai upaya pencegahan pelanggaran etik. Ada problem yuridis dalam mekanisme seperti ini. Meskipun demikian penyelenggara pemilu tingkat pusat mempunyai wewenang untuk melakukan pengawasan dan kontrol terhadap penyelenggara pemilu tingkat daerah supaya tidak melakukan pelanngaran kode etik
