Abstract

Tujuan penelitian menganalisis perlindungan hukum dan penerapan asas praduga tak bersalah terhadap pelaku tindak pidana narkotika dalam proses penyidikan. Penelitian ini menggunakan metode penelitian Empiris, Hasil penelitian ini menunjukkan bahwa : (1) perlindungan hukum dan penerapan asas praduga tak bersalah terhadap pelaku tindak pidana telah diatur di dalam Undang-Undang Dasar 1945, Undang-Undang No. 39 Tahun 1999 tentang Hak Asasi Manusia, serta Undang-Undang No. 48 Tahun 2009 tentang Kekuasaan Kehakiman dan pengimplikasiannya dalam proses penyidikan juga di atur dalam Peraturan Kepala Kepolisian Republik Indonesia No. 8 tahun 2009 tentang Implementasi Prinsip dan Standar Hak Asasi Manusia dalam Penyelenggaran Tugas Kepolisian Negara RI; (2) Faktor-faktor yang mempengaruhi efektivitas penerapan asas praduga tak bersalah terhadap pelaku tindak pidana narkotika dalam proses penyidikan yaitu, kurangnya pemahaman aparat penegak hukum terkait implementasi asas praduga tak bersalah, tidak adanya edukasi kepada tersangka tentang hak-hak yang mereka miliki sebgai tersangka, penyalahgunaan kekuasaan oleh oknum aparat penegak hukum. The research objective is to analyze the legal protection and the application of the principle of presumption of innocence towards perpetrators of narcotics crimes in the investigation process. This research uses empirical research methods. The results of this research show that: (1) legal protection and application of the principle of presumption of innocence towards perpetrators of criminal acts have been regulated in the 1945 Constitution, Law no. 39 of 1999 concerning Human Rights, as well as Law no. 48 of 2009 concerning Judicial Power and its implications in the investigation process are also regulated in the Republic of Indonesia Police Chief Regulation No. 8 of 2009 concerning Implementation of Human Rights Principles and Standards in Carrying Out the Duties of the Indonesian National Police; (2) Factors that influence the effectiveness of applying the principle of presumption of innocence to perpetrators of narcotics crimes in the investigation process, namely, lack of understanding by law enforcement officials regarding the implementation of the principle of presumption of innocence, lack of education to suspects about the rights they have as suspects. , abuse of power by law enforcement officers.
