Abstract

When a man and a woman are married, they officially have responsibilities towards each other. And one of the responsibilities of a husband after marriage is to provide his wife with a place to live and provide for him. The income in question is either a physical income or an inner bread. If a husband deliberately fails to provide for his wife, then the husband is considered negligent and sinful. Because it is one of his responsibilities. Livelihood is not only a gift given by a husband to his wife, but also an obligation between the father and his children and also has a responsibility between an owner and something he owns. This income also covers the needs of the wife during childbirth, such as the financing of midwives or doctors who help with childbirth, drug costs and hospitals. Also included is the fulfillment of the biological needs of the wife. Abstract

Islamic law still gives a portion of reason to man, therefore man still has to establish laws based on the Qur'an and Hadith on problems that do not exist Nas and the law clearly. It is these interpretations that are the root of dissent among scholars. One of the important themes in the study of Islamic family law is the adultery of children. The scholars agree that the adulterous child's nasab is cut off from the man and is only connected to the mother's path, but so the scholars are sincere in the matter of determining the adulterous child's nasab by the biological father through the ilhaq (confession of the child). According to Abu Zahrah, adulterous children do not have a sexual relationship with a man as a biological father. But an adulterous child can be recognized as a biological father through the ilḥāq method, provided that the biological father does not explicitly suggest that the child he recognizes is the result of adultery. The consequence is a relationship of mutual support, inheritance relations, guardian relationships and other laws.

Abstract

The Warung Jablay business in the North Hulu Sungai Regency area has disturbed many residents. Basically, this kind of night girl stall has the same function as other stalls, but often because of the presence of young girls with sexy and skimpy clothes and differences in the way of service provided and differences in customer segmentation which are mostly filled by young people. So, there are many things that violate morals and religion in the field, and this is not in line with the teachings of Islam. This study aims to map how the practice of Warung Jablay in Hulu Sungai Utara is associated with Perspectives in the Sociology of Islamic Law, because Hulu Sungai Utara Regency is famous for its high religious area and is known as Bertaqwa City. This research is field wise with a qualitative descriptive approach. The results of this study found that people believe that the behavior of some people who run a stall business like this is driven by economic factors and desires. In addition, the community also considered the behavior of Warung Jablay workers to be out of bounds and violated moral, social, and religious norms.
