Abstract

AbstractThe purpose of this research is to find out the Termination of Employment by analyzing it usingthe perspective of human rights. This study uses a normative juridical method. The approachused is the statutory approach. The result is that since the existence of the COVID-19 pandemicit has had a negative impact because it has affected the economy which has threatened the lifeof the nation and state, and not many countries in the world have been able to survive. Indonesiahas experienced imbalances in various fields and living arrangements, especially in theeconomic sector which has resulted in decreased income of economic actors and led toinequalities in society such as layoffs, due to the many losses experienced by companiesranging from operating restrictions, decreased income and even many companies or mediumto lower businesses that have experienced a decrease in income so that it can be said to bebankrupt. This resulted in the company being forced to lay off employees because they wereno longer able to pay employee wages. The large number of workers who are laid off or affectedby layoffs affects the increase in the number of unemployed in Indonesia. Even though thereare provisions regarding layoffs, many companies that lay off their employees do not provideseverance pay as stipulated. The problem is that mass layoffs without severance pay are a formof human rights violation.

Abstract

Rape is a crime that seriously impacts victims and society, especially women. In this research, feminist legal theory is used as a basis for analyzing the regulation of the crime of rape. feminist legal theory emphasizes placing women as the main actors in decision-making and upholding women's rights in any form. feminist legal theory emphasizes establishing women as the main actors in decision-making and defending women's rights in any form. This theory sees violence against women as a form of gender discrimination, where the parties who are most often victims are women. In feminist legal theory, violence against women occurs because of gender inequality and the power held by men in the legal system. The author analyzes the criminal act of rape regulated in positive law in Indonesia in protecting women. This research aims to find out how the crime of rape is regulated and how criminal acts are regulated from the perspective of Feminism Legal Theory. This writing uses a normative juridical method with a statutory and conceptual approach. This research shows that referring to feminist legal theory, the sexual violence crime law is a positive step in eliminating gender-based violence and providing justice for rape victims.

Abstract

The purpose of this research is to describe the authority of district/city governments in managing government affairs in the education sector. As a consequence of the implementation of regional autonomy using the concurrent principle, there is a division of governmental affairs both at the central government and regional governments. This study focuses on the distribution of government affairs in the education sector. Because the study of government affairs in the education sector is small, the authors examine this matter. The research method is normative juridical research using statutory and conceptual approaches. The results of this study are because education is part of human rights, and the government is responsible for protecting, guaranteeing, and fulfilling the right to education for citizens. Then because of the consequences of implementing autonomy, then in terms of administering government affairs in the education sector, there is a division of functions. District/City Governments are tasked with overseeing the running of the education system in which local governments manage Early Childhood Education, Elementary Schools, and non-formal education as stipulated in laws and regulations.

Abstract

 Penelitian ini bertujuan untuk mengkaji penguatan sistem presidensial melalui penerapan ambang batas parlemen dalam pemilu di indonesia. Penelitian ini menggunakan jenis penelitian hukum normatif.. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan serta pendekatan konseptual. Hasil penelitian ini  menunjukkan pentingnya penerapan parliamentary threshold, dimana pembentukan suatu threshold sebenarnya merupakan upaya pemerintah dan DPR untuk merampingkan partai politik guna meningkatkan efektifitasnya dalam pemerintahan. Untuk mengkonsolidasikan partai politik dan meningkatkan stabilitas politik, yang pada akhirnya akan menawarkan kekuasaan, otoritas, dan martabat pemerintah, diperlukan ambang batas parlemen. dalam membentuk pemerintahan yang stabil adalah penerapan ambang batas parlemen. Di negara demokrasi ini, ambang batas parlemen adalah gagasan yang tepat untuk mengurangi jumlah partai politik. Ambang batas parlemen sekarang digunakan, tetapi dapat dikatakan bahwa itu tidak efisien karena lebih banyak partai politik yang memenuhi syarat untuk parlemen daripada lebih sedikit. Ini karena kompromi partai politik, bukan penelitian ilmiah, menentukan tingkat persentase yang digunakan. perhitungan persentase ambang batas parlemen perlu dilihat dari berbagai sudut, bukan hanya terletak pada jalan tengah yang tipis antara partai besar dan partai kecil. Selain itu, penggunaan ambang batas parlemen nasional dapat dipertimbangkan kembali agar penyederhanaan partai politik dapat terjadi secara nasional hingga ke daerah karena memperkuat pemerintah daerah sama pentingnya untuk membangun pemerintahan nasional yang stabil seperti memperkuat pemerintah pusat. Namun, karena setiap kepentingan daerah berbeda dan harus dipenuhi secara bertahap, penerapan ambang batas parlemen nasional tidak dapat dibagi secara seragam besaran persentasenya.Kata kunci : Ambang Batas, Parlemen, Partai Politik
