Abstract

Paspor merupakan dokumen identitas penting yang digunakan saat bepergian ke luar negeri. Di Indonesia, penerbitan paspor diatur oleh Kementerian Hukum dan Hak Asasi Manusia melalui Kantor Imigrasi. Penelitian ini bertujuan untuk menganalisis penerapan asas equality before the law dalam pelayanan pembuatan paspor same day service di Kantor Imigrasi Kelas I Khusus Medan. Metode penelitian yang digunakan adalah yuridis-normatif dengan pendekatan deskriptif-analitis. Data dikumpulkan melalui studi dokumen dan wawancara dengan pejabat terkait serta masyarakat pemohon paspor. Hasil penelitian menunjukkan bahwa meskipun terdapat kerangka hukum yang jelas dalam penerbitan paspor, pelaksanaan layanan same day service menimbulkan beberapa tantangan, terutama terkait ketidaksetaraan akses akibat biaya tambahan yang cukup tinggi. Rekomendasi perbaikan mencakup pemberian subsidi atau tarif berjenjang, serta peningkatan sosialisasi dan edukasi kepada masyarakat

Abstract

The COVID-19 pandemic is very risky and requires quick action and policy-making for the safety of all. For this reason, the government has taken a policy related to using specific budget allocations by facilitating the procurement process of goods and services to prevent and handle COVID-19. Still, in the process, many acts have occurred that are detrimental to state finances. The method used in this thesis is the normative legal research method, which refers to legal norms with data sources obtained by examining library materials to obtain secondary data in the form of primary, secondary, and tertiary materials. The study results found that in the two decisions studied, the judges had carefully considered the legal facts in the trial but still had different interpretations regarding the element of "Unlawfully" in the Corruption Law. Several factors cause the provisions of Article 2 paragraph 2 of the Corruption Law not to be applied to perpetrators of corruption during the pandemic, namely from the Public Prosecutor, Panel of Examining Judges, and the applicable regulations. Criminal policy in overcoming corruption in the relationship between business actors and procurement officials is carried out in two ways: non-penal policy by increasing supervision. In contrast, penal policy has been carried out by making changes to the Corruption Crime Law. It is hoped that the Examining Judge can have uniformity in interpreting Article 2 and Article 3 of the Corruption Crime Law so that there is no disparity in punishment for corruption convicts so that no parties feel disappointed by the decisions made.

Abstract

Cases of domestic violence that occur in Indonesia not only result in women as victims, but can also occur in children. The problem formulation in this thesis is: What is the role of the Labuhan Batu District Prosecutor's Office in providing legal protection towards child victims of domestic violence through a Restorative Justice approach; What are the obstacles for the Labuhan Batu District Prosecutor's Office in providing legal protection for child victims of domestic violence through a Restorative Justice approach? The research method used in this journal is the sociological juridical research method. The results of this research can be concluded that restorative justice can be implemented with the following requirements: the threat of a sentence of no more than 5 (five) years, the perpetrator is not a recidivist, there is the victim's consent or desire to make peace, there is good faith from the suspect to fulfill the obligations agreed between the victim and the suspect , and there must be an agreement between the victim, the suspect and other parties
