Pendekatan rezim anti pencucian uang, pengejaran uang (follow the money) terhadap hasil kejahatan merupakan cara mudah dan efektif dalam mengungkap kejahatan dan pelakunya. Kewenangan PPATK menjadi sangat penting dan perlu pengaturan kelembagaan yang kuat. Lahirnya UU No. 8 Tahun 2010 tentang pencegahaan dan pemberantasan tindak pidana pencucian uang telah memberikan kewenangan yang lebih strategis kepada PPATK. Pusat Pelaporan dan Analisis Transaksi Keuangan adalah lembaga independen yang dibentuk dalam rangka mencegah dan memberantas tindak pidana pencucian uang. (PPATK) memegang peran utama dalam mekanisme komunikasi dan koordinasi antara lembaga yang terlibat dalam upaya menegakan rezim anti pencucian uang di Indonesia. PPATK dengan pihak pelapor mewajibkan pihak pelapor Penyedia Jasa Keuangan (PJK) menyampaikan tiga jenis laporan ke PPATK, yaitu Laporan Transaksi Keuangan yang Mencurigakan (LTKM), Laporan Transaksi Keuangan Tunai (LTKT) dan transaksi transfer dana elektronis internasional (Internasional Fund Transfer Instruction). PPATK menyerahkan Hasil Pemeriksaaan kepada Penyidik untuk dilakukan penyidikan.

Pemakaian lembaga mediasi pengadilan saat ini dirasa lebih menguntungkan karena cepat dalam menyelesaikan Sengketa Perdata. Mekanisme mediasi dalam proses penyelesaian sengketa di Pengadilan juga mendorong upaya damai sebagai solusi yang utama oleh para pihak yang bertikai. Dalam penelitian ini, pelaksanaan Mediasi di Pengadilan Negeri Stabat telah dilaksanakan sangat baik yang mana untuk menunjang Pelaksanaan Peraturan Mahkamah Agung No.1 Tahun 2008 Pengadilan Negeri Stabat telah mempersiapkan Mediator Hakim dan mediator Non hakim serta telah mempersiapkan Sarana dan Prasarana yang mendukung proses Mediasi. Namun demikian dalam Pelaksanaanya terdapat beberapa hambatan yang perlu diperhatikan antara lain perlunya pengaturan khusus masalah insetif bagi hakim yang berhasil mendamaikan para pihak dalam proses mediasi, lebih banyak Pelatihan Sertifikasi Mediator bagi hakim agar para hakim lebih memahami Proses Mediasi, Perlunya Sosialisasi Peraturan Mahkamah Agung No.1 Tahun 2008 dan Perbaikan dari Peraturan Mahkamah Agung No.1 Tahun 2008 tentang Proses Mediasi di Persidangan.

Karya cipta seni lukis yang merupakan salah satu bagian dari Hak atas Kekayaan Intelektual (HAKI) yang dilindungi oleh Perundang-undangan, namun masih ada pelanggaran atas ketentuan UU. Pelanggararan yang terjadi seperti pemalsuan atas suatu seni lukis, perebutan hak sebagai pencipta dan pemegang hak cipta atas suatu dasar karya lukisan. Hal ini terjadi karena Ketidaktahuan masyarakat yang menimbulkan salah pengertian mengenai UU No. 19 Tahun 2002 tentang Hak Cipta dimana bahwa negara Indonesia telah meratifikasi “Berne Convention For The Protection Of Artistic And Literary Works” (Konvensi Berne tentang Perlindungan Karya Seni dan Sastra) melalui Keputusan Presiden No.18 Tahun 1997, dan “World Intellectual Property Right Treaty” (perjanjian Hak Cipta WIPO) melalui Keputusan Presiden No. 19 Tahun 1997. Hak cipta hendaknya selalu mendapat perhatian sekaligus pengawasan yang serius dalam perkembangannya, karena merupakan suatu produk hukum yang akan selalu mengalami kemajuan seiring kemajuan pada bidang lainnya, pemerintah harus bekerjasama dengan masyarakat dalam melakukannya, oleh karena itu masyarakat harus lebih peduli dan mau tahu terhadap apa yang terbaik dapat menjadi perlindungan bagi Hak Cipta.

Money laundering can undermine the national economy as it is very closely linked to the belief that one or another country against the policy of the State. Usually money laundering illicit money was made by mixing with legitimate money so that a legitimate business will not compete with companies who are honest, undermining the integrity of the financial markets due to the financial institutions (financial institutions) even rely on the proceeds of crime can face the danger of liquidity; resulting in a loss of government control of the economy of a country whose policies result in lack of confidence in other countries against its policies. The purpose of this study is to find out how the position of the agreement in the sale and purchase of shares with repurchase rights (REPO) in law in Indonesia, whether the sale and purchase agreement of shares with repurchase rights (REPO) has protected the interests of investors, as well as how the settlement of disputes in the sale and purchase agreement shares with repurchase rights (REPO) between issuers and investors by PT. OSO Medan Branch Securities. The method in this research is a normative juridical legal method with qualitative analysis. From the results of the study, it was found that the sale and purchase agreement of shares brokered by PT. OSO Sekuritas is a form of agreement or contract which must comply with the provisions in the Civil Code in general and specifically must comply with the laws and regulations relating to REPO. In the share sale and purchase agreement brokered by PT. OSO Sekuritas has provided legal certainty and protection to investors because in the agreement clause the form of protection has been explained. Settlement of disputes that occur between the parties in the REPO share-purchase agreement brokered by PT. OSO Sekuritas, contained in the agreement clause, which is an agreement for mediation and deliberation as well as resolving issues through the capital market arbitration body, if deliberation is not reached.

Indonesia currently has Law Number 11 of 2012 concerning the Criminal Justice System for Children (UU-SPPA) to provide protection for children who need special protection such as child offenders, victims and witnesses. In fact, the implementation of the UU-SPPA actually only focuses on children as perpetrators. This not only shows that justice for children is still not upright especially for children who are victims of sexual violence. This is evident from the findings of a study conducted in 2019 entitled "The Effectiveness of the Convention on the Rights of the Child Victims of Sexual Violence". This study found that although Indonesia already has 2 government regulations governing the fulfillment of victims of sexual violence in the form of compensation and or restitution, none of the decisions of the Medan District Court and Lubuk Pakam contain the rights of victims. The decisions of the Medan District Court and Lubuk Pakam throughout 2018 were oriented towards providing penalties for the perpetrators. The two Government Regulations which are guidelines for implementing the Law are (a) Government Regulation of the Republic of Indonesia Number 7 of 2018 concerning Provision of Compensation, Restitution and Assistance to Witnesses and Victims; and (b) Government Regulation of the Republic of Indonesia Number 43 Year 2017 Concerning Implementation of Restitution for Children Who Are Victims of Criminal Acts. These two Government Regulations are the basic ingredients for the implementation of the 2019 Mandatory Servant Lecturer service dedication. This situation is the basis of community service in two districts namely Medan Baru and Medan Sunggal. Law Enforcement Officials (APH) in this case the police and the community not only obtain new information about victims' rights but also increase their awareness to guarantee the rights of children victims of sexual violence are requested in legal proceedings for perpetrators. Furthermore, the Police and the community hope that the information on these two Government Regulations can be continued both by the Regional Government Organization (OPD) and other institutions such as the Civil Society Organization (CSO) in Medan.

PERAN UNITED NATIONS INTERNATIONAL CHILDREN’S EMERGENCY FUND (UNICEF) TERHADAP PEMULIHAN KONDISI PENDIDIKAN DI SULAWESI TENGAH INDONESIA PASCA GEMPA BUMI Ladyta Tahany Reformita Marpaung ABSTRAKSI Penelitian ini bertujuan untuk mengetahui bagaimana peran yang dilakukan oleh organisasi internasional yaitu United Nations International Children’s Emergency Fund (UNICEF) dalam membantu pemulihan pendidikan di Sulawesi Tengah Indonesia pasca gempa bumi. Sedangkan kegunaaan penelitian ini adalah untuk menambah wawasan bagi pembaca mengenai bantuan apa saja yang diberikan UNICEF terhadap pemulihan pendidikan di Sulawesi Tengan Indonesia pasca gempa bumi. Permasalahan dalam skripsi ini adalah bagaimana kedudukan UNICEF sebagai organisasi internasional menurut hukum internasional, bagaimana perkembangan UNICEF di Indonesia, dan bagaimana peran UNICEF terhadap pemulihan kondisi pendidikan di Sulawesi Tengah Indonesia pasca gempa bumi. Metode penelitian yang digunakan adalah yuridis normatif dengan dilakukan penelitian kepustakaan guna memperoleh data-data sekunder yang dibutuhkan yang meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang dibutuhkan dalam penelitian ini. Hasil penelitian ini disajikan secara deskriptif juga memperoleh penjelasan dari masalah yang dibahas. Hasil penelitian menunjukkan bahwa kedudukan UNICEF adalah sebagai subjek hukum internasional yaitu organisasi internasional dibawah PBB dan merupakan bagian dari organisasi internasional antar pemerintah yaitu bersifat semi otonom dan memiliki badan pengatur sendiri. Perkembangan UNICEF di Indonesia juga berjalan dengan baik ditunjukan dengan kerjasama yang terus dilakukan UNICEF dengan Indonesia selama lebih dari enam puluh tahun sampai saat ini. Pasca gempa bumi di Sulawesi Tengah Indonesia pendidikan disana menjadi terbengkalai karena banyaknya sekolah yang rusak dan tidak dapat digunakan kembali. Dalam membantu pemerintah Indonesia mengatasi pemulihan pendidikan disana, UNICEF dengan cepat dan sigap mengirimkan bantuan berupa tenda darurat dan paket sekolah untuk anak-anak sehingga pendidikan di daerah tersebut dapat berjalan kembali dan pemerintah Indonesia sangat mengapresiasi bantuan yang diberikan UNICEF tersebut.  Kata Kunci: UNICEF, Peran UNICEF, Pendidikan Pasca Gempa Bumi di Sulawesi Tengah

A bank always requires collateral to its customers in providing credit facility as a form of a guarantee or responsibility for their contract with the bank. A bank also employs an Appraisal Bank or Public Appraisal Service Office (KJPP). KJPP is expected to prevent wrong collateral valuation and value engineering. Therefore, the research problems are how the independence of an Appraisal Bank is, in performing collateral valuation in a credit contract, how the binding force of the valuation results gained by an Appraisal Bank to the collateral in a credit contract, and how the liability of the Appraisal Bank for the valuation performed by an Appraisal Bank to the collateral in a credit contract. This is a normative juridical and descriptive research. This research employs statutory method using primary, secondary, and tertiary legal materials. The data are collected from library study and field observation. They are analyzed by reducing data, presenting data, and drawing conclusions/making verification to obtain descriptive data. The results of the research conclude that the independence an. appraisal is assessed when he performs valuation without intervention from anyone. In legal view, an appraisal is considered valid and affecting the collateral object; the results of his valuation becomes his responsibility. The responsibility of an appraisal for his valuation results can be seen from the conformity of his report and the prevailing regulations. It is suggested that one be required and obliged to have specific skills, integrity, honesty and objectivity to become an appraisal. An appraisal also has to be guided by ethical codes and prevailing laws and regulations.

The roles of Capital Market Supervisory Agency (Badan Pengawas Pasar Modal – Bapepam) are to guide, rule and supervise capital market. The issuance of Law on Financial Service Authority takes over the authorities of the Capital Market Supervisory. The establishment of Financial Service Authority is mandated by Article 34 of Law on Bank Indonesia as an independent institution which regulates and supervises all financial service sectors by applying an unified supervisory model which separates the regulating and supervising tasks. Prior to the issuance of Law on Financial Service Authority, financial service sectors in capital market are supervised by Capital Market Supervisory Agency which is structurally still under the coordination of Ministry of Finance so that its authorities are still limited and result in the high number of cases of capital market which cannot be addressed effectively. Since Capital Market Supervisory Agency needs to be independent, it prefers to transform and merge into Financial Service Authority. It is suggested that laws related to banking, capital market, the Deposit Insurance Agency (Lembaga Penjamin Simpanan – LPS) need to be harmonized to prevent overlapping in their authorities. Therefore, Draft Bill on UUPM needs to be passed immediately because Capital Market Supervisory Agency has emerged into Financial Service Authority while UUPM still regulates the authorities of Capital Market Supervisory Agency. Financial Service Authority has to make regulations related to investigative authorities to address cases of capital market properly.
