Abstract

Abstrak Pernikahan dini merupakan fenomena yang mendapat perhatian serius dalam hukum perdata karena berbagai implikasi yang ditimbulkannya, terutama terkait perlindungan hak-hak pihak korban. Artikel ini bertujuan untuk melakukan tinjauan menyeluruh terhadap perspektif hukum perdata terhadap pernikahan dini di Indonesia. Analisis meliputi aspek definisi pernikahan dini, faktor-faktor yang mempengaruhi terjadinya, serta dampaknya terhadap hak-hak individu yang terlibat, baik secara teoritis maupun praktis. Dengan mempertimbangkan norma hukum yang berlaku dan upaya perlindungan yang ada, penulis mengidentifikasi tantangan utama dalam memberikan perlindungan yang efektif terhadap pihak-pihak yang rentan dalam konteks pernikahan dini. Kesimpulan dari tinjauan ini memberikan pandangan tentang bagaimana hukum perdata dapat lebih ditingkatkan untuk memastikan keadilan dan perlindungan yang optimal bagi semua individu yang terlibat dalam pernikahan dini. Abstract Early marriage is a phenomenon that has drawn significant attention in civil law due to its profound implications, particularly concerning the protection of the rights of the victims involved. This article aims to provide a comprehensive review of the civil law perspective on early marriage in Indonesia. The analysis covers the definition of early marriage, factors influencing its occurrence, and its impacts on the rights of the individuals involved, both theoretically and practically. By considering applicable legal norms and existing protective measures, the author identifies key challenges in effectively safeguarding vulnerable parties in the context of early marriage. The conclusions drawn from this review offer insights into how civil law can be enhanced to ensure fairness and optimal protection for all individuals affected by early marriage. Abstract

The Indonesian state is a state of law that actually prioritizes law over politics. The Indonesian state in regulating the structure of the state administration and the actions of its people always prioritizes the laws that have been compiled and made by the government and must also be implemented. In its implementation, the State of Indonesia has set up a judicial institution which specializes in overseeing the code of ethics of a Judge who will decide the case, namely the Judicial Commission. The purpose of this study is to determine the neutrality of an independent institution, namely the Honorary Council of the Constitutional Court in carrying out its duties using a research method approach to legislation or pre-existing literature. In the discussion of this paper, several new facts were found regarding the supervision carried out by the Judicial Commission as a judicial supervisory institution that only supervises Supreme Court Judges but does not supervise Constitutional Judges. Indeed, if the Constitution conducts direct supervision of Constitutional Judges, it will certainly lead to non-neutrality in the implementation of such supervision.
