Abstract

Abstrak Perjanjian dalam perikatan yaitu jika di dalam perjanjian yang sah maka harus diutamakan tanda bukti berupa tulisan hitam di atas putih dengan bertanda tangan, agar jika ada suatu penuntutan di antara pihak kreditur maupun debitur ada tanda buktinya untuk diberikan di depan hakim atau penegak hukum lainnya. Tetapi dalam utang-piutang, hal tersebut merupakan suatu hal yang tidak wajib melainkan dianjurkan, misalnya ketika seseorang berutang kepada bank karena bank merupakan badan resmi maka harus ada perjanjian menggunakan kertas hitam di atas putih yang bertanda tangan di atas materai. Tentang terhapusnya perikatan akibat prestasi yang menimbulkan adanya perutangan menjadi kompleks di dalam hubungan hukum perikatan maupun perjanjian, karena menyangkut adanya hak dan kewajiban maupun tanggung jawab yang harus dipenuhi baik dari pihak debitur maupun dari pihak si berutang. Jika seseorang telah melakukan suatu perjanjian yang melibatkan utang dari pihak piutang maka pihak yang berutang harus bertanggung jawab atas tindakan awal yang telah disepakati antara keduanya, jika si berutang tidak memenuhi kewajibannya maka terjadilah wanprestasi yang menimbulkan si berutang dapat digugat pada hakim. Artikel ini bertujuan untuk menganalisis yuridis tentang apa yang terjadi bila hilangnya perikatan akibat utang-piutang. Mendekati melalui pendekatan dalam analisis peraturan undang-undang yang mengatur dalam hal perikatan mengenai utang-piutang. Hubungan hukum mengenai hilangnya perikatan akibat utang-piutang perlu dipahami lebih mendalam dari peraturan undang-undang agar para pihak yang terlibat dapat memahami hak dan kewajiban mereka secara jelas dan mengurangi resiko sengketa di kemudian hari. Maka dari itu, sesuai dengan tujuan hukum, pihak yang terlibat harus memperoleh keadilan dan kepastian hukum. Kata Kunci: Hilangnya Perikatan Abstract An agreement in a contract stipulates that in a legitimate agreement, written evidence in the form of black and white writing with signatures must be prioritized. This is to ensure that if there is a dispute between the creditor and the debtor, there is evidence to present before a judge or other legal authorities. However, in the case of debt, this is not mandatory but recommended. For example, when someone borrows from a bank, because a bank is an official entity, there must be an agreement using black and white paper signed on a stamp. The dissolution of a contract due to performance, which results in debt, becomes complex within the legal relationships of contracts and agreements because it involves the rights, obligations, and responsibilities that must be fulfilled by both the debtor and the creditor. If someone has entered into an agreement involving a loan from the creditor, the borrower must be responsible for the initial actions agreed upon by both parties. If the borrower fails to meet their obligations, a breach of contract occurs, and the borrower can be sued before a judge. This article aims to analyze the legal implications of what happens when a contract is dissolved due to debt. It approaches this through an analysis of the regulations governing contracts related to debt. Understanding the legal relationships concerning the dissolution of contracts due to debt requires a deeper understanding of the laws to ensure that the involved parties clearly understand their rights and obligations, thereby reducing the risk of future disputes. Therefore, according to the objectives of the law, the involved parties must obtain justice and legal certainty. Keywords: Loss of Engagement

Abstract

The purpose of this research is to analyse the role of contract drafting in ensuring the implementation of the principle of freedom of contract while remaining in line with legal constraints, morality, and public order, in order to create valid, balanced contracts that provide legal certainty for the parties. This research uses a normative juridical method by examining relevant laws and regulations, doctrines, and court decisions. The analysis shows that freedom of contract from a contract drafting perspective must always be understood within the framework of a balance between autonomy of will and legal protection. Contracts drafted without considering legal constraints have the potential to give rise to disputes or even be deemed null and void. Therefore, innovation in contract drafting is needed to ensure contracts remain flexible for the parties while remaining within the applicable legal framework.
