Abstract

A village assistant is a competent person assigned to assist the village in the development and empowerment of village communities. The purpose of this study is to determine the form of implementation of the role of village assistants in supervising the operation of the village government as per the laws and regulations. This study uses a legal research type with an empirical approach, where data is obtained directly from the field through interviews and observations, the data obtained are analyzed qualitatively and then described descriptively. The results of the study indicate that the implementation of the role of village assistants has brought changes in the development and empowerment of village communities in Marioriwawo District, especially in equitable development and efforts to increase human resources in the village and are carried out according to the guidelines regulated in the village law along with other implementing regulations.

Abstract

Every regency government has issued Regulation on the allocation of village funds (ADD) ADD funding as a reference. Granting rights ADD is a form of fulfillment of village autonomy within the framework of the implementation of the village. The implementation on the ground quite well, begin from planning phase has been implemented well until completion of the ADD planning in village regulations. Furthermore, the implementation phase is also running smoothly and fairly good. But there are still a few obstacles which funds ADD does not coincide with the time the cause of a delay so that the activity is late to be implemented as well as the distribution system funds change often.

Abstract

Pendamping desa merupakan seorang yang berkompeten yang ditugaskan untuk mendampingi Desa terhadap pembangunan dan pemberdayaan masyarakat desa. Tujuan penelitian ini yakni untuk mengetahui bentuk pelakasanaan peranan pendamping desa dalam mengawasi jalannya Pemerintah Desa sebagaimana aturan perundang-undangan. Penelitian ini menggunakan tipe penelitian hukum dengan pendekatan empiris, dimana data diperoleh langsung dari lapangan melalui wawancara dan pengamatan, data yang diperoleh dianalisis secara kualitatif kemudian dipaparkan secara deskriktif. Hasil penelitian menunjukkan bahwa implementasi peranan pendamping desa telah membawa perubahan dalam pembangunan dan pemberdayaan masayarakat desa di Kecamatan Marioriwawo utamanya dalam pemerataan pembangunan dan upaya peningkatan sumber daya manusia di Desa dan dijalankan tetap pada pedoman yang diatur dalam undang-undag desa berserta aturan pelaksana lainnya.

Abstract

As part of the regional government, the Regency/Municipal Regional People’s Representative Council (DPRD) has functions, duties, and authorities. Article 149 paragraph (1) of Law Number 23 of 2014 states that the Regency/Municipal DPRD has the function of forming regency/municipal regional regulations, the budgeting function, and the supervisory function. As representatives of the people, the DPRD has three functions, namely legislation, budgeting, and supervision. Misuse of the Regional Revenue and Expenditure Budget (APBD) frequently occurs in local governments. The APBD managed by regional governments is vulnerable to misuse, including for the personal interests of regional heads. The purpose of this research is to identify and analyze how the DPRD supervises the implementation of the Regional Revenue and Expenditure Budget in Mamuju Regency. The research method used by the author is normative juridical research, which focuses on law as norms, rules, legal principles, legal doctrines, legal theories, and other legal literature to address the legal issues under study. The results of the research indicate that the supervision carried out by the DPRD over the implementation of the APBD in Mamuju Regency faces several obstacles. These obstacles are caused by various factors, including the quality of DPRD members (human resources), such as the level of formal education, knowledge, experience, leadership, expertise, and capabilities of the members. Educational background is an essential factor in determining the quality or competence of a DPRD member. In addition, there is a lack of communication between DPRD members and the community, as well as relatively low public political awareness
