Abstract

After the Supreme Court Decision, Number 50 P / HUM / 2018 concerning the Cancellation of Permenkumham Number 62 of 2016 concerning Terms and Procedures for Appointment, Transfer, Dismissal, and Extension of Notary Term of Office, which is considered contrary to Article 3 of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary has an impact, namely the issuance of Permenkumham Number 19 of 2019. Permenkumham Number 19 of 2019 changed the notary appointment examination as one of the conditions for the appointment of the position of Notary to the required photocopy of the training certificate for improving the quality of the Notary position. The cancellation of the Permenkumham was then repeated with the Supreme Court Decision No. 3 P/HUM/2022 which invalidated Article 2 paragraph (3) of Permenkumham No. 19 of 2019, which was deemed detrimental by the Petitioner in this case because of the long, long-winded and costly process. This research is expected to provide explanations and solutions to the above problems carried out using normative juridical methods guided by applicable laws and regulations.

Abstract

This research aims to analyze the arrangements related to the employment relationship of workers who are seconded to other companies, the implementation of the employment relationship of workers who are seconded to other companies by taking a study at Pertamina Group, as well as the ideal arrangements related to the employment relationship status of workers who are seconded to other companies. The method used is normative juridical research method with qualitative data type. The results of the study show that the existence of a regulatory vacuum causes the non-achievement of legal certainty as one of the objectives of the law. Moreover, until now the Manpower Law has not explicitly regulated worker assistance. The government needs to strengthen labor regulations related to secondment of workers, including regulating the terms of secondment of workers, secondment agreements, protection of the rights of secondment workers, and settlement of industrial relations disputes of secondment workers. Secondment agreements that have been implemented by several companies, one of which is PT Pertamina (Persero), can be the basis for current arrangements related to worker secondment. In the secondment agreement, arrangements are made that as long as workers are seconded to other companies, there will be no transfer of employment relations from the home company to the user company. In addition, it also regulates the period of assistance and the rights of workers during the period of assistance, which are guaranteed at least the same as the rights of workers when working in the original company.

Abstract

Penelitian ini bertujuan untuk menganalisis implementasi perbantuan pekerja di PT X. Metode yang digunakan adalah dengan menggunakan metode penelitian yuridis normatif dengan jenis data kualitatif. Hasil penelitian menunjukkan bahwa adanya kekosongan aturan yang menyebabkan tidak tercapainya sebuah kepastian hukum sebagai salah satu tujuan dari adanya hukum. Terlebih, hingga saat ini UU Ketenagakerjaan belum secara eksplisit mengatur tentang perbantuan pekerja. Pemerintah perlu memperkuat peraturan ketenagakerjaan terkait perbantuan pekerja, termasuk mengatur syarat-syarat perbantuan pekerja, perjanjian kerja perbantuan (secondment agreement), perlindungan hak-hak pekerja perbantuan, serta tata cara penyelesaian perselisihan hubungan industrial pekerja perbantuan. Secondment agreement yang telah diimplementasikan oleh beberapa perusahaan salah satunya oleh PT X dapat menjadi dasar pengaturan terkait perbantuan pekerja saat ini. Di secondment agreement diatur bahwa selama pekerja diperbantukan di perusahaan lain, tidak akan terjadi peralihan hubungan kerja dari perusahaan asal (home company) kepada perusahaan pengguna/perusahaan penugasan (host company). Selain itu, diatur pula mengenai jangka waktu perbantuan dan jaminan pemenuhan hak-hak pekerja selama masa perbantuan yang dijamin minimal sama dengan hak-hak pekerja pada saat bekerja di perusahaan asal.
