Abstract

Article 24A (5) of the 1945 Constitution regulates the composition, position, membership, and procedural law of the Supreme Court and subordinate judicial bodies. Initially limited to bankruptcy, postponement of debt payment obligations (PKPU), and commercial matters by Law Number 37 of 2004, the jurisdiction of the Commercial Court has expanded through other laws. This expansion raises two key issues: (1) The need for legal remedies for objections to decisions of the Competition Supervisory Commission (KPPU), and (2) The competence of the Commercial Court to address these objections. This research uses a normative juridical method, suggesting that legal remedies for objections to KPPU decisions should be regulated in a separate law, addressing decisions from institutions beyond the judiciary’s jurisdiction. The procedural aspects for contesting KPPU decisions, outlined in Article 45 of the Omnibus Law Number 6 of 2023, should first be determined within the competence of the Commercial Court as regulated by law. The current institutional arrangements and authority of the Commercial Court, as outlined in the Bankruptcy and PKPU Laws and laws on Intellectual Property Rights, should be revised through a dedicated Law on Commercial Courts. This law should define the court's structure, powers, procedural rules, and set time limits and sanctions for case resolution at both the Commercial Court and the Supreme Court.

Abstract

The Religious Courts, one of whose powers is to resolve divorce issues for Muslim people. Before the divorce trial begins, the parties must mediate in court assisted by a mediator. Whereas in Malaysia the Religious Courts are called the Sharia Courts whose duties are to resolve issues related to Islamic matters, if a husband and wife have an agreement to file for divorce, the Sharia Court shall resolve the matter by conducting mediation or sulh first. Sulh is an attempt to reconcile couples in the context of marriage as an attempt to reconcile between husband and wife before the couple is legally divorced and separated. The problem is how are the similarities in divorce mediation between the Indonesian Religious Court and the Malaysian Sharia Court and how are the differences in divorce mediation between the Indonesian Religious Court and the Malaysian Sharia Court. This study uses a descriptive comparative normative research type using secondary data obtained from the literature. Secondary data was analyzed qualitatively by using deductive logic. Based on the results of a comparative study of divorce mediation at the Indonesian Religious Court and at the Malaysian Sharia Court, they have similarities and differences. The similarities are regarding the time of the mediation process and the appointment of mediators, while the differences are regarding the method of conducting the mediation, the requirements of the mediator, the mediation arrangements, the time limit for the mediation process, and the number of mediators.

Abstract

Penyelesaian Sengketa Bisnis Melalui Pengadilan Niaga Dihubungkan Dengan Asas Kepastian Hukum Sebagai Upaya Pengembangan Sistem Peradilan. Permasalahan yang diangkat (1) Bagaimana kewenangan Pengadilan Niaga dalam penyelesaian sengketa bisnis mengingat tidak adanya kejelasan tentang objek perkara perniagaan yang dapat ditangani oleh Pengadilan Niaga, (2) Bagaimana kepastian hukum penyelesaian sengketa bisnis di Pengadilan Niaga yang sering berlarut-larut melalui proses peninjauan kembali yang tidak sesuai dengan asas peradilan sederhana, cepat dan biaya ringan. Kewenangan Pengadilan Niaga menurut Undang-Undang Kepailitan adalah memeriksa, memutus perkara kepailitan dan perkara perniagaan lainnya. Undang-Undang Kepailitan tidak menjabarkan yang dimaksud dengan perkara perniagaan lainnya dalam pelaksanaanya dapat menimbulkan multi interpretasi. Upaya hukum peninjauan kembali di Pengadilan Niaga untuk perkara kepailitan diatur secara limitatif sedangkan dalam perkara hak milik intelektual peninjauan kembali tidak diatur

Abstract

Undang-Undang Dasar 1945 Pasal 24 A ayat (5) menyebutkan susunan, kedudukan, keanggotaan dan hukum acara Mahkamah Agung serta badan peradilan dibawahnya diatur dengan undang-undang. Proses pemeriksaan persidangan perkara pidana diatur dalam KUHAP Pasal 3 yang menyatakan proses peradilan menggunakan Undang-undang termasuk pemeriksaan saksi harus bebas, jujur dan obyektif. Permasalahan dalam penelitian ini 1) Bagaimana regulasi asas legalitas dalam proses pemeriksaan persidangan saksi di peradilan pidana. 2) Bagaimana implementasi proses pemeriksaan saksi di persidangan. Regulasi asas legalitas dalam proses pemeriksaan persidangan saksi di peradilan pidana. Dalam menilai kebenaran keterangan seorang saksi, hakim harus dengan sungguhsungguh memperhatikan persesuaian antara keterangan saksi satu dengan yang lain, persesuaian antara keterangan saksi dengan alat bukti lain, alasan yang mungkin dipergunakan oleh saksi untuk memberi keterangan yang tertentu, cara hidup dan kesusilaán saksi serta segala sesuatu yang pada umumnya dapat mempengaruhi dapat tidaknya keterangan itu dipercaya. Implementasi proses pemeriksaan saksi di persidangan banyak tidak sesuai seperti Keterangan saksi “berbeda” dengan keterangannya dalam BAP yang dilakukan oleh penyidik, Saksi menarik/mencabut keterangannya dalam BAP yang dibuat Penyidik, Keterangan Saksi di depan persidangan diduga diberikan de¬ngan tldak sebenarnya. Dalam pemeriksaan dipersidangan tidak sesuai dengan asas legalitas sebagaimana dimaksud KUHAP tetapi mengikuti praktek persidangan yang dianggap biasa

Abstract

Introduction: National economic growth requires a responsive and efficient legal system, particularly in the field of business and investment. The Draft Bill on Civil Procedure Law is expected to provide legal certainty and accelerate the resolution of business and investment disputes.Purposes of The Devotion: This article aims to provide understanding of fast-track civil procedure for business and investment through public dialogue.Method of The Devotion: The method applied was lecture and interactive discussion, using an empirical approach based on stakeholder participation in public dialogue.Results Main Findings of the Devotion: The community service activity revealed that participants gained broader knowledge of business dispute resolution through both litigation and non-litigation, fast-track proceedings in civil procedure law, and academic aspects of the Draft Bill. The enthusiasm of the participants highlighted the urgent demand for a faster and more efficient civil procedure system. These findings emphasize the importance of reforming civil procedural law to foster a favorable investment climate and ensure legal protection for business actors.
