Abstract

Researchers have widely discussed research on human rights, but there has not been much writing that specifically connects the theological aspects with practical aspects. This research examines the construction of Ahmed An-Na'im's theology and its relevance to the problems of modern society. This article is literature research that examines the thoughts of figures through historical analysis. The primary data is an essay by the figure studied, Abdullahi Ahmed An-Nai'im: Toward an Islamic Reformation: Civil Liberties, Human Rights and International Law, Islam and the Secular State. Meanwhile, secondary sources are other works that discuss An-Na'im's thoughts, human rights, and Islamic theology. This research concludes that An-Na'im made the Universal Declaration of Human Rights a strong instrument to protect the glory, honor, and dignity of every human being on Earth. This research makes an important contribution as a theological and practical basis for eliminating all forms of human rights violations and making human values the main element in law and social interaction in social and state life.

Abstract

Child marriage remains a complex issue within Indonesia’s multicultural legal system. The lack of synchronization among state law, religious law, and customary law creates a significant space for legal contestation, particularly in the practices of marriage dispensation and marital validation (isbat nikah). This study aims to analyze the dynamics of legal contestation among these systems using a normative-empirical legal approach through the examination of legal documents, regulations, and critical legal literature. Employing John Griffiths’ theory of legal pluralism, the study reveals that the Indonesian state tends to adopt a form of weak legal pluralism, recognizing religious and customary laws only to the extent that they do not contradict state law. The primary academic contribution of this study lies in its detailed exploration of how local and religious norms influence judicial decisions regarding dispensation and marital validation—an area that has received limited critical scrutiny in previous studies, which largely focused on formal normative analysis. This research also highlights the inadequacy of uniform national legal policies in responding to the diversity of grassroots social norms. Therefore, it advocates for a reformulation of legal approaches that are more participatory and context-sensitive through inclusive dialogue among state authorities, religious leaders, and customary communities. Such an approach is essential to ensuring the fair and sustainable protection of children’s rights within an adaptive legal pluralism framework that reflects Indonesia’s social realities.

Abstract

Studying the Ahmadiyah movement in Indonesia through the work of Iskandar Zulkarnain, according to researchers, requires a reassessment of the figure to determine whether the history is truly discussed without any intervention from any party or the opposite. This is crucial as it will determine the historical accuracy and reveal whether Ahmadiyah has contributed to the development of Islamic scholarly studies, especially in Indonesia. The method used in this research is library research. The data collection technique relevant to this study is documentary research, which involves various literature related to the thoughts or concepts of the figure under examination. The results of this research conclude that the Ahmadiyah movement entered Indonesia with the departure of three Indonesian youths to India. These three youths were Abu Bakar Ayyub, Ahmad Nuruddin, and Zaini Dahlan, all from Padang Panjang, West Sumatra. In his research on the Ahmadiyah movement in Indonesia, Iskandar Zulkarnain truly used two tools offered by Edmund Husserl, namely epoche and eidetic. Iskandar successfully suspended his initial knowledge to obtain valid information from the Ahmadiyah community, as evidenced by Iskandar Zulkarnain's research. Many historical facts support that Ahmadiyah is appreciated by Muslim intellectuals in the homeland. Through the Islamic works written by Indonesian figures, it can be traced that there are indications that their ideas are inspired by the literature of Ahmadiyah figures, especially in the narrative of comparative religion and Christology. With this evidence, it can be concluded that Ahmadiyah's ideas are visualized in many intellectual works by Indonesian Muslim figures.
