Abstract

Nur Misyuari Maddolangeng. Analisis Maslahah Terhadap Pengadaan Conjugal Visit bagi Narapidana (Studi di Lembaga Pemasyarakatan Kelas IIA Kota Parepare) (dibimbing oleh Aris, dan Andi Marlina). Penelitian ini membahas terkait “Analisis Maslahah Terhadap Pengadaan Conjugal Visit bagi Narapidana (Studi di Lembaga Pemasyarakatan Kelas IIA Kota Parepare)”. Terdapat dua rumusan masalah yang menjadi fokus pembahasan, yakni bagaimanakah pemenuhan hak biologis Narapidana di Lembaga Pemasyarakatan Kelas IIA Kota Parepare? Serta bagaimanakah analisis maslahah terhadap pengadaan conjugak visit bagi Narapidana di Lembaga Pemasyarakatan Kelas IIA Kota Parepare? Jenis penelitian yang digunakan ialah penelitian lapangan (field research) dengan menggunakan pendekatan deskriptif kualitatif, yaitu jenis pendekatan yang berupaya untuk mendiskripsikan, mencatat, mengenalisis dan menginterpretasikan fakta-fakta yang ditemukan melalui observasi, wawancara dan mempelajari dokumentasi. Berdasarkan penelitian yang telah dilaksanakan, maka dapat disimpulkan bahwa : Pertama, conjugal visit secara kelembagaan masih tidak terdapat di Lembaga Pemasyarakatan Kelas IIA Kota Parepare. Hal ini dikarenakan kebijakan mengenai conjugal visit belum memiliki landasan hukum yang mengatur secara expressis verbist. Kedua, ditinjau dari segi maslahah, pengadaan conjugal visit menjadi penting untuk direalisasikan di Lembaga Pemasyarakatan Kelas IIA Kota Parepare mengingat ketiadaan fasilitas tersebut memunculkan permasalahan baru bagi Narapidana, baik dari aspek keharmonisan rumah tangga maupun permasalahan dari aspek kejiwaan dan kesehatan Narapidana. Ketiga, pengadaan conjugal visit merupakan bentuk pemenuhan terhadap hak biologis Narapidana sekaligus menjadi bentuk perlindungan terhadap agama, jiwa, akal, maupun keturunan bagi Narapidana. There are two formulations of the problem that are the focus of the discussion, namely how to fulfill the biological rights of convicts in Parepare City Class IIA Penitentiary? As well as how the analysisthank you on procurementconjugak visit for Prisoners in Parepare City Class IIA Penitentiary? The type of research used is field research (field research) by using a qualitative descriptive approach, namely the type of approach that seeks to describe, record, recognize and interpret the facts found through observation, interviews and studying documentation. Based on the research that has been carried out, it can be concluded that: First,conjugal visit institutionally there is still no Class IIA Penitentiary in Parepare City. This is because the policy regardingconjugal visit do not yet have a legal basis that regulatesexpressed in words. Second,viewed in terms ofthank you, procurementconjugal visit becomes important to be realized in Parepare City Class IIA Penitentiary considering the absence of these facilities raises new problems for prisoners, both from the aspect of household harmony and problems from the mental and health aspects of prisoners.Third,Procurement of conjugal visits is a form of fulfilling the biological rights of convicts as well as a form of protection for convicts' religion, soul, mind, and heredity.

Abstract

The dualistic authority in judicial review between the Supreme Court and the Constitutional Court in Indonesia has engendered significant legal uncertainties, institutional conflicts, and inconsistencies in the enforcement of laws. While the Supreme Court is mandated to review regulations subordinate to laws, the Constitutional Court holds the authority to review laws against the 1945 Constitution. This bifurcation has led to fragmented legal interpretations and contradictory rulings, undermining the coherence and certainty of the national legal system. This study examines the urgency of consolidating the judicial review authority under the Constitutional Court to enhance legal certainty, uphold constitutional supremacy, and promote justice in Indonesia. Employing a normative juridical approach and comparative legal analysis, the research highlights the advantages of a unified judicial review mechanism as practiced in several constitutional democracies, including Germany and Malaysia. The findings suggest that centralizing judicial review within the Constitutional Court would streamline legal processes, reduce institutional conflicts, and strengthen the protection of constitutional rights. Nonetheless, the study also acknowledges the necessity for capacity building within the Constitutional Court to manage the increased judicial workload effectively. The integration of judicial review authority is thus posited as a critical reform to fortify Indonesia’s constitutional democracy and the rule of law.

Abstract

The purpose of this study was to ascertain the murafa’at fiqh (Saudi Arabian Law) and the Indonesian Criminal Procedure Code's perspectives on a convict's plea for i’adah al-nadzr (reconsideration). This was a normative juridical inquiry, which entailed poring over relevant material to gather data, assess content, and draw similarities between positive law and Islamic criminal law. The findings of this study indicated that review in positive law, referred to in Saudi Arabia's murafa’at fiqh as i’adah al-nadzr/al-muhakamah, attempted to ensure legal justice and judge justice in their rulings. There were parallels between positive law and murafa’at fiqh in terms of the justifications for filing reconsideration. There were, however, distinctions regarding the giyabi case as a basis for submitting reconsideration. In Saudi Arabia's murafa’at fiqh, the reconsideration application in the giyaby case could be accepted, although positive law did not cite the giyaby ruling as a reason to seek reconsideration. Positive law, on the other hand, provides for the possibility of resistance (verzet) if the defendant was not present in court and has not protested Verstek's ruling. Another parallel between positive law and Saudi fiqh murafa’at was seen in the reconsideration application regulations, which prohibited suspending the execution of rulings. However, the researcher notes that this rule cannot be applied universally.
