Abstract

Perjanjian TRIPS menjadi kesepakatan bagi anggota WTO untuk mengkonversi undang-undang nasional di bidang Hak Kekayaan Intelektual. UU No.31 tahun 2000 tentang Desain Industri menjadi salah satu keseriusan pemerintah Indonesia dalam melindungi Hak Kekayaan Intelektual. Problematik pemeriksaan substantif perlu ditinjau kembali agar tidak terjadi kesamaan dalam pendaftaran Desain Industri. Metode penelitian dalam artikel ini adalah yuridis normative yaitu penelitian yang difokuskan untuk mengkaji studi dokumen, yakni menggunakan data sekunder seperti peraturan perundang-undangan, keputusan pengadilan, dan teori hukum. Diharapkan artikel ini dapat menjadi bahan pertimbangan pemerintah untuk merevisi beberapa peraturan di bidang Hak Kekayaan Intelektual. The TRIPS Agreement is an agreement for WTO members to convert national laws in the field of Intellectual Property Rights. Law No. 31 of 2000 concerning Industrial Design is one of the Indonesian government's seriousness in protecting Intellectual Property Rights. The problems of substantive inspection need to be reviewed so that there are no similarities in the registration of industrial designs. The research method in this article is normative juridical, namely research that is focused on examining document studies, namely using secondary data such as laws and regulations, court decisions, and legal theory. It is hoped that this article can be taken into consideration by the government to revise several regulations in the field of Intellectual Property Rights.
