Abstract

The interaction between law and culture is fundamental to the functioning of any society. While laws are formal rules enforced by state institutions, culture encompasses the shared values, beliefs, and practices of a society.  In order to eliminate problems such as the conflict between law and culture, the pressure of law on culture, the society's behavior against the law, and similar problems, law must be adapted to the culture and existing laws must be made a culture of the society. This article explores the process of transforming legal norms into cultural ones, emphasizing the mechanisms through which laws are internalized and become an integral part of social behavior. By examining historical precedents, theoretical frameworks, and contemporary examples, the article demonstrates how legal norms can shape and be shaped by cultural norms, transcending their formal boundaries. More significantly, it illustrates how the state's promulgation, enforcement, and potential future enactment of laws can be rendered more palatable, acceptable, and culturally integrated to both the state and society. The article posits that as society embraces laws as part of its culture, not only will the state's expenditure on ensuring security decrease, but societal trust will also increase, reducing conflicts and insecurities in the application of laws. The article also, introduces the concept of Legaculturation and emphasizes the importance of turning (transforming) laws into a culture.  This comprehensive research provides a professional and detailed examination of the concept of Legaculturation by combining information from existing literature. Ultimately, the article assumes that society will thrive in welfare underpinned by a harmonious blend of legal and cultural norms.

Abstract

Career selection and career satisfaction are integral factors that influence an individual's professional development and happiness. This study examines the complex, reciprocal relationship between these two concepts through a review of relevant literature. Career choice involves determining one's future career based on interests, abilities, values, and goals. Proper career selection positively impacts career satisfaction when there is alignment between the individual and their work. Conversely, dissatisfaction with one's chosen path may precipitate career changes. Career satisfaction relates to subjective well-being and success derived from work experiences and achievement of career goals. High satisfaction promotes motivation and productivity, while low satisfaction reduces commitment and performance. Personal characteristics, educational background, socioeconomic factors, and the social environment also shape career choice and satisfaction levels over time. Compatibility between career and individual personality traits or values typically enhances outcomes. Work environment quality, development opportunities, and work-life balance further mediate this relationship. A supportive culture, continuous training, and balanced responsibilities impact job fulfillment. Informed career selection centered on self-awareness establishes foundations for satisfaction and success. However, satisfaction likewise influences persistence or diversification from initial choices. Understanding this complex, mutual relationship optimizes career trajectories and organizational effectiveness.

Abstract

This paper critically analyzed Abraham Maslow's well-known hierarchy of needs theory (1943), identified its shortcomings, and examined previous studies in the literature on qualitative research methods. Moreover, it discussed the suitability of the theory to human needs and its scientific nature, considering the qualifications, dynamics, variability, and nature of human needs. Maslow proposed a rigid hierarchical framework, categorizing human needs from physiological to self-actualization. Over time, the theory faced criticism for disregarding scientific principles and overlooking the objective and subjective aspects of human needs. Instead of rigorous scientific research, the theory heavily relied on Maslow's personal observations and clinical experiences. This paper posits that Maslow overlooked socio-cultural influences that shape motivation and emphasizes how social and economic contexts prioritize needs. Moreover, the lack of empirical evidence is identified as a weakness compromising the theory's validity. The article also, proposes an updated framework considering the objectivity and subjectivity of human needs, scientific research principles, technological connections, sustainability, socio-cultural influences, arbitrary human behavior and needs, personal preferences, and emotional factors. It advocates for acknowledging that needs circulate dynamically through interpersonal networks rather than being staged rigidly, thereby supporting theoretical evolution. Additionally, the paper identifies and offers potential solutions to eight fundamental issues associated with the theory. In this study, a literature review was conducted, and Maslow's hierarchy of needs was analyzed and its deficiencies were identified and eliminated. Igor Kospov's model was examined and explained to eliminate its flaws. Finally, instead of Maslow's hierarchy of needs, the article proposes a model or set of clustered needs that are compatible with human needs and scientific, dynamic, interactive, prioritized by humans, and influenced and influenced by culture, technological developments and the human environment. The model, or clustered set of needs, consists of several clusters. These clusters are interconnected and influence each other. In other words, the same person can take steps towards self-actualization and experience the indispensable feature of social belonging while he satisfies the physiological needs of drinking water and eating, because human needs can vary from person to person, from place to place, from time to time and from situation to situation, even within the same person.
