Abstract

Abstract PBI Number: 7/46/PBI/2005 explained that in murābaḥah financing, if the bank represented the customer to purchase goods, then murābaḥah contract must be made after the goods became the bank's property. Meanwhile, BSI KCP Sukoharjo Kartasura carried out a murābaḥah contract before the goods became the bank's property. This was not in accordance with the PBI and it couldbe said that there was engineering in financing implementation. This study aimed to analyze the mechanism of murābaḥah financing at BSI KCP Sukoharjo Kartasura based on PBI Number: 7/46/PBI/2005 and analyze causative factors of engineering in financing. This study used qualitative field research and the Miles and Huberman method, with data collection techniques were interview with related parties and documentation. This studyconcluded that the murābaḥah financing mechanism in BSI KCP Sukoharjo Kartasura consists of filling out forms, BI checking, surveys, etc. The financing mechanism was generally appropriate. However, in its implementation, not all provisions have been carried out properly. BSI KCP Sukoharjo Kartasura carried out a murābaḥah contract before the goods became the bank's property. Then, it could be said that there was engineering in the financing implementation. The causative factors were the bank wanted to save time, minimize expenses, etc. Keywords: Financing; Mechanism; Murābaḥah; PBI.   Abstrak PBI Nomor: 7/46/PBI/2005 menjelaskan bahwa dalam hal pembiayaan murābaḥah, apabila bank mewakilkan kepada nasabah untuk membeli barang, maka akad murābaḥah harus dilakukan setelah barang menjadi milik bank. Sedangkan BSI KCP Sukoharjo Kartasura melaksanakan akad murābaḥah sebelum barang menjadi milik bank. Hal ini tidak sesuai dengan PBI dan dapat dikatakan bahwasannya terdapat rekayasa dalam pelaksanaan pembiayaan tersebut. Penelitian ini bertujuan menganalisis mekanisme pembiayaan murābaḥah di BSI KCP Sukoharjo Kartasura berdasarkan PBI Nomor: 7/46/PBI/2005 dan menganalisis faktor penyebab terjadinya rekayasa dalam pembiayaan tersebut. Jenis penelitian ini menggunakan penelitian kualitatif lapangan serta metode Miles dan Huberman, dengan teknik pengumpulan data berupa wawancara pihak terkait dan dokumentasi. Hasil penelitian ini menyimpulkan bahwa mekanisme pembiayaan murābaḥah di BSI KCP Sukoharjo Kartasura terdiri dari pengisian form, BI checking, survei, dan lain sebagainya. Menurut PBI Nomor: 7/46/PBI/2005, secara umum mekanisme tersebut sudah sesuai. Namun, dalam implementasinya belum semua ketentuan sudah dijalankan sebagaimana mestinya. BSI KCP Sukoharjo Kartasura melaksanakan akad murābaḥah sebelum barang menjadi milik bank. Maka, hal ini dapat dikatakan bahwasannya terdapat rekayasa dalam pelaksanaan pembiayaan tersebut. Faktor penyebabnya yakni karena pihak bank sebisa mungkin ingin menghemat waktu, meminimalisir pengeluaran, dan lain sebagainya. Kata Kunci: Mekanisme; Murābaḥah; PBI; Pembiayaan.

Abstract

This study aims to determine and analyze the actions of Notaries when signing authentic deeds by sending minutes of authentic deeds and to determine and analyze the form of Notary's responsibility for violation of code of ethics in signing authentic deeds by sending minutes of authentic deeds. The results of the research and discussion in this study are: Notaries can sign authentic deeds by sending minutes of authentic deeds because they deviate from the principle of obedience and the Notary's Principle of Prudence towards the code of ethics of 2005 and 2015 Article 4 paragraph (6) of the notary's code of ethics, namely as a strict prohibition on Notaries in sending minutes to clients to be signed. This has an impact on the validity of the deed and the integrity of the notary profession. So that violations of the code of ethics, the Honorary Council will impose sanctions in the form of Reprimands, Warnings, Schorzing (temporary dismissal) from membership of the association, Onzetting (dismissal) from membership of the association, Dishonorable Dismissal from membership of the association and the responsibility of the Notary in sending authentic minutes of deeds has the potential to cause legal uncertainty, where as a form of responsibility the Notary can be subject to administrative, disciplinary, or even criminal sanctions in accordance with the provisions of Law Number 2 of 2014 concerning the Position of Notary. Legal responsibility for the Deed of Sale and Purchase Agreement made by a notary for sending the minutes of the deed to the client even though with the consent of the parties, the Notary can still be burdened with Administrative Sanctions by the Notary Honorary Council in the form of a written warning, so that the notary is responsible for maintaining the credibility of his profession and public trust in him.
