Abstract

Destructive fishing activities are a threat to the sustainability of fishery resources and harm fish stocks as well as environmental ecosystems. Comprehensive regulations are needed to cope with destructive fishing and ensure the regulations will be implemented well and appropriately. Using a qualitative approach, this study aims to scrutinize the implementation of policies issued by the central government in the regions, including laws and other national regulations related to coping with destructive fishing. North Maluku Province is the focus of the study to identify the implementation of national regulations in the region. In addition, this study also identifies the roles of maritime law enforcement agencies involved in efforts to supervise and implement national policies related to overcoming and preventing destructive fishing. The results reveal that existing laws are insufficient to cope with the destructive fishing criminal act. So far, eight actors have roles in the prevention and coping of destructive fishing activities, consisting of elements of maritime law enforcement agencies such as the Police, Indonesian Navy, Indonesian Coast Guard, and Directorate General of PSDKP, as well as civil or community elements such as the PWP3K Special Police, Forestry Police, Department of Marine Affairs and Fisheries, and Monitoring Community Supervisory Groups (Pokmaswas). Abstract

The article discusses the political economy of fisheries development in Indonesia and its dynamics during Joko Widodo's regime. The development of the fisheries sector, particularly marine fisheries, has faced ups and downs since Indonesia's independence. During the New Order era, fisheries development depended on foreign investment and international aid, which on several occasions has driven severe conditions in depleted fish stocks and the marginalization of small-scale fishermen. The fisheries sector began to be measured politically after the reform period when Indonesia established the Department/Ministry of Marine Affairs and Fisheries. Even so, the direction of fisheries development has not met its consistency. When Joko Widodo served as president, he created a big vision for maritime development, namely "Global Maritime Axis," where the fisheries sector became one of the national development priorities. Jokowi appointed Susi Pudjiastuti as Minister of Marine Affairs and Fisheries (MAF). Under Susi, the development of fisheries began to be reformed and she enacted many strict policies to deal with fisheries problems that have been occurring for decades. Susi gained many political pressures because her strict policies disrupted the oligarchic system that had controlled fisheries resources at the time. Fisheries development experienced inconsistencies from the last of 2019 until the end of 2020 because the first Minister of MAF in Jokowi's second period made contradictory policies from Susi's period. Since 2021, Indonesia's fisheries development has been using a blue economy model implemented through the regulation on measured fishing.

Abstract

Penerbitan Peraturan Menteri Kelautan dan Perikanan No.18 Tahun 2021 (Permen KP No. 18/2021) bertujuan untuk menghadirkan regulasi pengaturan dan pengelolaan alat penangkapan ikan (API) dan alat bantu penangkapan ikan (ABPI) agar terciptanya manfaat yang optimal serta memberi perlindungan pada lingkungan hidup. Pada kebijakan tersebut, alat tangkap dogol kembali dilarang penggunaannya, dan menghadirkan Jaring Tarik Berkantong (JTB) sebagai solusi pengganti alat tangkap dogol yang sudah banyak digunakan. Penelitian ini bertujuan untuk menganalisa pengaruh pemberlakuan Permen KP No. 18/2021 dengan membandingkan produktivitas hasil tangkapan dan pendapatan nelayan purse seine di Kandanghaur, Indramayu, serta persepsi stakeholder perikanan di Indramayu terhadap penerapan peraturan menteri tersebut. Asumsi yang dibangun adalah dengan dilarangnya dogol maka produktivitas dan pendapatan nelayan purse seine akan meningkat. Metode dalam penelitian ini menggunakan pendekatan mixed method (Kualitatif dan Kuantitatif) dengan menggunakan sensus sampling sebagai teknik pengumpulan data. Analisis data menggunakan pendekatan Mc Nemar guna membandingkan produktivitas dan pendapatan nelayan sebelum dan sesudah pemberlakuan kebijakan, dan skala likert dalam mengukur persepsi setiap pihak terkait pemberlakuan kebijakan tersebut. Hasil penelitian menunjukan hal yang sebaliknya, bahwa terjadi penurunan produktivitas hasil perikanan purse seine yang mana pada  tahun 2020 sebesar 20.035 kg/trip menjadi 13.193 kg/trip pada tahun 2022, serta penurunan hasil lelang pada tahun 2020 sebesar Rp. 2.509.061.000 menjadi Rp. 1.661.266.580 pada tahun 2022. Persepsi yang diperoleh dari stake holder perikanan di Indramayu terkait implementasi Permen KP No. 18 tahun 2021 khususnya pada poin pelarangan dogol menunjukan bahwa kebijakan tersebut belum optimal. Hal tersebut ditunjukan karena masih tingginya aktivitas penggunaan alat tangkap dogol yang semestinya telah beralih menjadi alat tangkap JTB. Ditambah lagi dengan penegakan hukum yang kurang efektif.Kata kunci: Permen KP No. 18 Tahun 2021, Purse seine, Dogol, JTBAnalysis Of The Impact Of Implementation Of Minister Of Marine And Fisheries Regulation No.18/Permen-Kp/2021 On Purse Seine Fishery Activities In Indramayu DistrictMinister of Maritime Affairs and Fisheries Regulation No. 18 of 2021 (Permen KP No. 18/2021) was introduced to regulate and manage fishing equipment (API) and fishing aids (ABPI) to maximize benefits and ensure environmental protection. The policy specifically prohibits the use of dogol fishing gear and introduces the Pocket Towing Net (JTB) as an alternative. This study analyzes the impact of this regulation on the productivity and income of purse seine fishermen in Kandanghaur, Indramayu, and assesses the perceptions of fisheries stakeholders in Indramayu. The assumption is that by banning dogol, the productivity and income of purse seine fishermen would increase. The research employs a mixed-method approach, utilizing census sampling. Mc Nemar's approach is applied to compare the productivity and income of fishermen before and after policy implementation, and a Likert scale measures stakeholders' perceptions. Results reveal a decrease in purse seine fishery productivity from 20,035 kg/trip in 2020 to 13,193 kg/trip in 2022, along with a decline in auction results from Rp. 2,509,061,000 in 2020 to Rp. 1,661,266,580 in 2022. Fisheries stakeholders in Indramayu express dissatisfaction with the policy's effectiveness, citing continued high usage of dogol fishing gear instead of transitioning to JTB gear.
