Abstract

One of the factors contributing to the suboptimal implementation of “meaningful participation” is the exploitation of legal loopholes to expedite the creation of open cumulative draft laws (RUU). This issue is further complicated by Constitutional Court Decision Number 90/PUU XVIII/2020, which states that the formation of open cumulative draft laws does not necessitate general public participation, thereby posing a distinct challenge. In the context of this matter, by employing a normative legal research method, the author examines the urgency of public participation in the development of open cumulative draft laws through a “fast track” legislative process. The study’s results cover three main topics: (1) the mechanism of open cumulative draft law design and its relationship to “fast track” legislation; (2) the legal implications stemming from the Constitutional Court’s considerations regarding public participation in the creation of open cumulative draft laws; (3) the essence of integrating public participation into open cumulative draft laws using the “fast track” legislative method.

Abstract

This study aims to provide confirmation of the accommodation of disclosure which is still questionable in the cluster of international regulations, this is done in order to obtain the same interpretation of regulations in international practice for the protection of Genetic Resources and Traditional Knowledge (SDGPT), which is also an implication of the existing system in Law Number 13 of 2016 concerning Patents has not been able to protect it optimally. By using a normative juridical method with qualitative analysis, this study justifies the results that have been in previous studies that the beneficial sharing mechanism has become the government's effort to protect SDGPT from acts of misappropriation, but this research found a novelty, namely by supporting the affirmation and perfecting of these matters which need to be acknowledged are not sufficient to meet the needs of international practice, because it was found that there are still Indonesian State patents taken without beneficialy sharing due to the plurality of interpretations and accommodations of the Patent Law which are not in accordance with international practice requirements. Thus, the accommodation of disclosure or the formulation of disclosure requirements deserves a position in the regulation of the Patent Law in Indonesia for steps to encourage the sound of the same interpretation in the echoes of international practices and regulations, so that the benefits can be maintained and felt by people of origin.

Abstract

Digital transformation has driven a surge in cross-border transactions, but on the other hand, it has raised legal challenges related to jurisdiction, recognition of foreign judgments, and regulatory harmonization. The urgency of this research lies in the need for a legal framework that is fair, adaptive, and responsive to the complexities of international electronic commerce. This study aims to analyze the effectiveness of the application of International Civil Law (ICL) in the settlement of cross-border e-commerce disputes in the digital era. The method used is normative legal research based on a literature review, examining international regulations and practices of technology-based dispute resolution. The results of the study show that the harmonization of international regulations, the development of practical guidelines for e-commerce players, and clear regulations regarding the role of digital platforms are strategic steps to increase legal certainty and consumer confidence in cross-border transactions. This research offers novelty by emphasizing the integration of digital technology, including artificial intelligence and big data, in ADR-based dispute resolution mechanisms to strengthen effectiveness, legal certainty, and consumer confidence in the global arena.

Abstract

It is a big job for law enforcement to be able to deal with fraud crimes and data leaks that are increasing at this time. Social engineering attacks are considered to be one of the modes used by perpetrators in carrying out their actions. If the current prevention efforts always link social engineering with phishing, an activity that is closely related to technological sophistication, it is necessary to know another form of social engineering that deserves attention, namely dumpster diving. A term that describes the activity of “scavenging” a target's trash in search of valuable information. Dumpster diving is often underestimated because some people think that if the waste that has been disposed of will not be used by others, it will even have a threatening impact. The habit of throwing away records and documents without being destroyed makes it a target for perpetrators to collect information which will then be used in attacking their targets. Several countries have considered regulating the designation of waste that has the potential to be misused, including regarding the security of personal data. Therefore, this article aims to provide an alternative policy for the Indonesian government, in order to consider the issuance of regulations that protect victims who are affected by losses due to the use of waste by perpetrators.
