Abstract

This article explores the Indonesian Constitutional Court’s views through its decisions in shaping the practice of outsourcing in Indonesia based on the 1945 Constitution. The study was first conducted by analyzing Decision No. 012/PUU-I/2003 and later Decision No. 27/PUU-IX/2011. The novelty of this research is evident from the involvement of perspective in analyzing the outsourcing scheme in Indonesia as newly regulated in several laws, namely Job Creation Law and the Government Regulation in lieu of Job Creation Law. Using the normative legal research method, the authors used statutory, case, and conceptual approaches. Based on the research conducted, the authors found that the Constitutional Court aims to uphold the balance of companies’ efficiency and outsourced workers’ rights protection. The findings are evidenced by the Constitutional Court’s stance in a decision that implies that outsourcing is constitutional to enhance the State’s economy while simultaneously protecting the outsourced workers’ rights to ensure the fulfillment of their constitutional rights by setting two-fold models of protection. Therefore, even if new outsourcing scheme regulations are issued, the criterion of legality in future judicial reviews must involve determining whether such balance has been sufficiently met.

Abstract

The discrepancy between Constitutional Court Decision Number 91/PUU-XVII/2020 on the review of the Job Creation Law and the PERPPU on Job Creation has created constitutional incompatibilities. The research aims to analyze the executorial power in the final and recall nature of the Constitutional Court's decision on the follow-up of the Constitutional Court's decision by the legislators and (ii) the implementation of the constitutional mandate of Constitutional Court Decision Number 91/PUU-XVIII/2020 on Job Creation in the Job Creation PERPPU in the dynamics of the relationship between the Constitutional Court and the legislators. This research uses a combination of normative-doctrinal methods using a contextual approach, legislative approach, conceptual approach and case approach. The results of this study indicate that the Constitutional Court's decision has executorial power over the final and binding nature erga omnes. The Constitutional Court's conditional unconstitutional decision regarding the formal examination of the Job Creation Law has shifted the role of the Constitutional Court as a positive legislature which also results in the nature of the Constitutional Court's decision as a quasi-law. Follow-up of the Constitutional Court's decision is also considered important as compliance with the constitution. This research also shows that there is a mismatch between the constitutional mandate in Constitutional Court Decision Number 91/PUU-XVII/2020 and the follow-up carried out by the President as one of the branches of lawmaking power. This mismatch is clearly a form of constitutional delegitimization and straddles the final and binding Constitutional Court decision.

Abstract

The President's issuance of Regulations in Lieu of Law No 1 of 2022 regarding the Job Creation represents a deliberate endeavor to operationalize and further refine the previously ratified Job Creation Law. The objective of this research is to provide a lucid comprehension of the formulation of the Regulations in Lieu of Law that adheres to the Constitutional Court's directives. This paper employs normative legal research methodologies, incorporating conceptual, historical, statutory, and jurisprudential analyses to scrutinize extant legal quandaries concerning the urgency and constitutionality of Regulations in Lieu of Law No 1 of 2022 regarding the Job Creation. Furthermore, the research yields the proposition that the promulgation of Government Regulation in Lieu of Law No. 1 of 2022 on Job Creation, vis-à-vis Constitutional Court Decision No. 91/PUU-XVIII/2020, may be regarded as a departure from the constitutional imperatives articulated in Constitutional Court Decision No. 91/PUU-XVIII/2020. Furthermore, concerning the reformulation of provisions governing the issuance of a Regulation in Lieu of Law by the President within the national legislative framework, a predicated state of emergency is a requisite antecedent. The President is obligated to communicate this state of emergency to the Indonesian People's Consultative Assembly and the public before promulgating the Regulation in Lieu of Law.

Abstract

Salah satu catatan kritis proyek pembangunan Ibu Kota Nusantara adalah minimnya partisipasi masyarakat dalam pengundangan Undang-Undang tentang Ibu Kota Negara (UU IKN). Hal ini telah menciptakan potensi perenggutan hak-hak masyarakat adat yang merupakan kelompok paling rentan. Tulisan ini bertujuan untuk menganalisis politik hukum UU IKN serta akibatnya terhadap perlindungan lingkungan hidup pada hak masyarakat adat dengan menggunakan metode penelitian yuridis normatif. Hasil penelitian ini menunjukkan bahwa UU IKN memiliki konstelasi konfigurasi politik otoriter yang secara simultan berdampak pada karakter produk hukum yang elitis. Sebagai akibat dari kentalnya unsur elite dalam UU IKN, akses masyarakat adat terhadap pembangunan menjadi terbatasi, dan pelanggaran hak menjadi tidak terhindarkan. Penelitian ini berkesimpulan bahwa konfigurasi politik UU IKN memiliki dampak yang signifikan terhadap pemenuhan hak perlindungan lingkungan sebagai bagian terikat dari kehidupan masyarakat adat.
