Abstract

The development of economic crimes, particularly regarding money laundering and terrorism financing, led to the promulgation of Law Number 8 of 2010 on Prevention of the Crime of Money Laundering and Law Number 9 of 2013 Regarding Prevention and Eradication of Terrorism Financing Crime. The mode of the crime of the two types of crime also then uses the corporation to disguise it. Presidential Regulation Number 13 of 2018 regarding the application of the Know-Your-Beneficial-Owner Principle by Corporations for the Prevention and Eradication of the Criminal Acts of Money Laundering and Terrorism Financing was promulgated to tackle money laundering and terrorism financing using Corporations. There is an unclear basis for the authority to enact that Presidential Regulation and there is a discrepancy between the criteria for Beneficiary Owners causing legal uncertainty. This study aims to find out and examine the fulfillment of the principle of forming statutory regulations which form the principle of recognizing Beneficiary Owners and to find out and study the determination of Beneficiary criteria in that Presidential Regulation in terms of Law on Prevention of the Crime of Money Laundering and Law Regarding Prevention and Eradication of Terrorism Financing Crime. This study uses normative legal research with a law and regulations approach, where the data obtained is analyzed qualitatively, and the conclusions use a deductive way of thinking. The result of this research is that the principle of recognizing the Beneficiary Owner in that Presidential Regulation is in accordance with the principles of legislation formation; however, the determination of Beneficiary Owner criteria is not accurate.

Abstract

Limited Liability Company in Indonesia has a conceptual expansion since the Job Creation Law has enacted. There are two types of Limited Liability Company currently, capital partnership limited liability company and single-member limited liability company. One of the most significant changes to the concept of limited liability company is related to its organs. Single-member limited liability company consists of director who also serve as shareholder. The expansion concept raises questions regarding the application of fiduciary duty to single-member limited liability company. This research uses conceptual and statute approach. The conclusion from this research is that in single-member limited liability company, there is only director who also become shareholder, thus there is no supervisory function by the board of commissioner. Secondly, the director in single-member limited liability company still has the obligation to carry out the responsibilities with the principle of fiduciary duty.

Abstract

Trademark rights are one type of Intellectual Property Rights which differentiates the origin of the goods and services. The existence of this protection shows that the state is obliged to enforce brand law, such as protecting registered brands. This type of research is normative legal research. Normative research is doctrinal law where law is often conceptualized as what is written in regulations. Legislation (Law in book) or laws decided by judges through the court process. Decision Number 2/Pdt.Sus.HKI/Merek/2020/PN Niaga Mdn confirms that the Plantiff's Goat Brand must be legally protected until 2025. By having a “GOAT BRAND” brand certificate, the Plantiff deserves exclusive rights protection of ownership and use of the brand. In this decision, the judge found similarities between the brands “GOAT BRAND” and “2 GOATS”, as well as the bad fath of the Defendant. The judge also referred to the principle of the first to file system in brand law in Indonesia so that the Plantiff deserves to get protection of exclusive rights to ownership and use of the mark.

Abstract

Knalpot brong merupakan salah satu permasalahan yang sering terjadi di lingkungan pedesaan, termasuk di Padukuhan Pakwungu. Suara bising yang dihasilkan knalpot jenis ini tidak hanya mengganggu kenyamanan masyarakat, tetapi juga melanggar peraturan lalu lintas yang berlaku. Penelitian ini bertujuan untuk menganalisis efektivitas metode sosialisasi dalam menangani penggunaan knalpot brong, khususnya di kalangan remaja sebagai pengguna utama kendaraan bermotor. Metode yang digunakan dalam penelitian ini adalah pendekatan partisipatif dengan melibatkan warga dan remaja melalui kegiatan sosialisasi. Kegiatan ini meliputi penyuluhan mengenai dampak negatif penggunaan knalpot brong, baik dari segi hukum maupun lingkungan, serta diskusi kelompok untuk mencari solusi bersama. Data dikumpulkan melalui observasi langsung, wawancara, dan kuesioner sebelum dan sesudah pelaksanaan sosialisasi. Hasil penelitian menunjukkan bahwa sosialisasi yang dilakukan secara terarah dan melibatkan tokoh masyarakat berhasil meningkatkan kesadaran warga, khususnya remaja, terhadap pentingnya menggunakan knalpot standar. Hal ini dibuktikan dengan penurunan signifikan penggunaan knalpot brong di Padukuhan Pakwungu dalam kurun waktu dua bulan setelah kegiatan sosialisasi. Kesimpulannya, metode sosialisasi terbukti efektif dalam menangani masalah knalpot brong. Keterlibatan aktif masyarakat dan pendekatan edukatif menjadi kunci keberhasilan program ini, yang dapat diterapkan di desa lain dengan permasalahan serupa.
