Abstract

Genocide, or in Indonesian, Genosida, is a form of crime that attacks humanity by ruthlessly eliminating a group for the personal interests of the perpetrators themselves. Various acts of genocide include slaughtering a targeted group, which then physically and mentally assaults the victims. One example of genocide is the Armenian Genocide that occurred in the 20th century and lasted for 8 years. This action was focused on annihilating unarmed people, women, and children in Armenia according to the orders of the Ottoman Emperor at that time.

Abstract

Marriage is an inner birth network between a man and a woman as husband and wife, with the primary purpose of creating a happy family based on the same Divinity. A mixed marriage is generally defined as a marriage between two people in Indonesia who are subject to opposing laws due to differences in nationality. A mixed marriage of different religions is a marriage carried out by a man and a woman who have different beliefs; this, if associated with Islamic law, is not permitted and considered deviant, not only under Islamic laws but also under the law on marriage and the law about marriage prohibition. Abstract

Perjanjian pasca perkawinan merupakan instrumen hukum yang memperoleh legitimasi lebih kuat setelah terbitnya Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015, yang membuka ruang bagi pasangan suami istri untuk mengatur pemisahan harta setelah berlangsungnya perkawinan. Penelitian ini mengkaji kedudukan dan implikasi perjanjian pasca perkawinan dalam sistem hukum perdata Indonesia, khususnya terkait pembagian harta gono-gini ketika terjadi perceraian. Analisis dilakukan dengan menggunakan pendekatan yuridis normatif melalui penelaahan peraturan perundang-undangan, doktrin, dan putusan pengadilan yang mengatur hubungan keperdataan dalam perkawinan. Hasil kajian menunjukkan bahwa perjanjian pasca perkawinan memiliki fungsi strategis dalam memberikan kepastian status harta, mempertegas batas antara harta pribadi dan harta bersama, serta meminimalkan sengketa yang timbul akibat percampuran aset selama perkawinan. Instrumen ini juga berperan dalam melindungi kepentingan ekonomi masing-masing pihak, terutama dalam kondisi ketika salah satu pasangan memiliki risiko usaha atau kewajiban hukum tertentu. Dalam konteks perceraian, perjanjian pasca perkawinan memberikan arah yang lebih jelas bagi hakim dalam menentukan objek pembagian harta, sehingga memperkuat efektivitas proses peradilan dan meningkatkan kepastian hukum. Penelitian ini menegaskan urgensi penguatan pemahaman masyarakat dan para praktisi mengenai prosedur, syarat, dan konsekuensi hukum dari perjanjian pasca perkawinan agar instrumen ini dapat berfungsi optimal sebagai bagian dari modernisasi hukum keluarga di Indonesia. Postnuptial agreements have gained significant legal legitimacy in Indonesia following the Constitutional Court Decision No. 69/PUU-XIII/2015, which broadened the opportunity for married couples to regulate the separation of assets after the marriage has been established. This study examines the legal status and implications of postnuptial agreements within the Indonesian civil law system, particularly regarding the division of marital property in divorce proceedings. Employing a normative juridical approach, the research analyzes statutory regulations, legal doctrines, and judicial decisions governing marital property relations. The findings indicate that postnuptial agreements function as a strategic legal instrument that reinforces certainty concerning property status, clarifies the distinction between personal and joint assets, and reduces disputes arising from the commingling of assets throughout the marriage. This instrument also provides economic protection for each spouse, especially when one party is engaged in business activities or exposed to legal liabilities. In the context of divorce, postnuptial agreements offer clearer guidance for judges in determining the distribution of assets, thus enhancing judicial efficiency and strengthening legal certainty. The study highlights the importance of improving public and practitioner understanding regarding the procedures, requirements, and legal implications of postnuptial agreements to ensure that this instrument functions effectively as part of the modernization of family law in Indonesia.
