Abstract

Introduction: On Seram Island, there is an association of customary law communities who live in groups in a certain form, known in the Wemale language as "Yapio Patai". Yapio means looking, and seeing, while Patai means fellowship. Yapio Patai is a form of customary law community association consisting of 38 families/clans. This alliance has not been regulated in the current village/state government system based on statutory regulations.Purposes of Devotion: The purpose of this article is to convey the results of socialization which is the result of previous research, that Yapio Patai can be categorized as a Fam/Clan Confederation. Method of Devotion: This activity was carried out using the method of socializing the law to the public based on the results of previous research by the team, which was carried out empirically.Results of the Devotion: The results of the service show that Yapio Patai is still accepted by the people of the Yapio Patai alliance as a form of traditional government that continues to live and function amid the alliance. The existence of Yapio Patai is a fam/clan confederation consisting of 38 fam/clans, which still exist even though they are spread across 7 hamlets or villages.

Abstract

Introduction: The institutionalization of the Customary Law Community (MHA) unit into a Customary Village is carried out through a determination carried out by the Regional Head. Related to the determination as a unit of MHA as a Customary Village. Provisions regarding the requirements and implementation of the determination of the MHA unit to become a Customary Village are regulated in the provisions of Law No. 6 of 2014 Article 97. The implementation of the determination of the MHA unit as a Customary Village in reality, there are those that are not designated as Customary Villages, but as Villages, even though the requirements and criteria in the provisions of Law No. 6 of 2014 have been met. The determination of MHA units in West Seram Regency as a Village and not as a Customary Village raises legal problems. Juridically, normatively, the MHA units meet all the requirements and criteria of Law No. 6 of 2014 article 97, but are not designated as Customary Villages (or in SBB Regency term referred to as state) but as Villages.Purposes of the Research: The aim of this research is Validity of the Decision of the Regional Head Regarding the Determination of the Unity of the Customary Law Community as a Village Based on Law Number 6 of 2014Methods of the Research: The research used by the author is an empirical juridical research type. The procedure for collecting legal materials by conducting research in the form of interviews and observations as well as literature studies on legal materials, namely primary legal materials and secondary legal materials. Then the legal materials that have been obtained are analyzed descriptively-qualitatively.Results / Findings / Novelty of the Research: The results obtained are the importance of determining the unity of the customary law community into a village must pay attention to various things in order to realize the welfare of the people which does not contradict the correct legal mechanism so that it does not have fatal legal consequences and is detrimental to the community.

Abstract

Pulau Seram memiliki komunitas masyarakat hukum adat yang tergabung dalam suatu persekutuan hidup secara berkelompok dalam bentuk tertentu yang sering disebut Patai dalam bahasa Wemale. Persekutuan ini sebagai sarana untuk menghimpun masyarakat hukum adat sekaligus sebagai bentuk persekutuan pemerintahan adat yang secara hukum belum diatur secara jelas dalam sistem pemerintahan negeri saat ini terutama berdasarkan peraturan perundang-undangan. Tujuan dari pengabdian ini untuk memberikan penyuluhan hukum atau sosialisasi terkait kedudukan sistem pemerintahan adat Yapio Patai dalam persekutuan masyarakat hukum adat di Pulau Seram dan untuk memberikan pemahaman tentang pentingnya pengaturan Yapio Patai dalam pengaturan hukum. Pengabdian ini dilakukan dengan menggunakan metode penyuluhan hukum atau sosialisasi. Dengan hasil memberikan rekomendasi kepada masyarakat adat tentang kedudukan Yapio Patai dapat diterima oleh masyarakat persekutuan Yapio Patai sebagai bentuk pemerintahan adat yang tetap hidup dan berfungsi di tengah-tengah persekutuan tersebut, dan untuk menjaga eksistensi keberadaan persekutuan Yapio Patai dalam kaitan dengan hukum adat dan penyelesaian masalah-masalah adat antara marga-marga yang ada di dalamnya, maka direkomendasikan untuk membentuk Dewan Saniri Yapio Patai dengan Peraturan Bersama Kepala Pemerintah Negeri.

Abstract

Introduction: Supervision of Regional Regulations according to the 1945 Constitution of the Republic of Indonesia, Law Number 23 of 2014, PP Number 79 of 2005 and Permendagri Number 1 of 2014 is carried out by the Government. In exercising the authority to supervise Regional Regulations, the Government is limited to the parameters regulated by laws and regulations. Purposes of the Research: To analyze the supervision Parameters of Regional Regulations regulated in Law Number 23 of 2014. Methods of the Research: This research is a normative research, with a statutory approach and a conceptual approach. Results Originality of the Research: The results of the research found that the provisions of Article 7 of Law Number 12 of 2011 are in accordance with the principle of lex superiori derogate legi inferiori, namely a regulation may also not apply if it clearly contradicts a higher regulatory norm. In a theoretical perspective, the principle of lex superiori derogate legi inferiori was developed by Hans Kelsen and Hans Nawiasky through tiered legal norms.
