Abstract

Langkah cepat dan tepat perlu dilakukan pemerintah dan pemerntah daerah dalam menangani pandemi Covid-19 dengan membentuk produk hukum daerah, baik yang bersifat legislasi maupun yang bersifat regulasi. Kesejahteraan dan keselamatan masyarakat harus terjamin, di samping norma produk hukum yang dihasilkan harus memiliki daya guna dan daya ikat bagi masyarakat. Pergub Maluku Nomor 15 Tahun 2020 yang memiliki banyak kesamaan materi muatan dengan Pergub DKI Jakarta Nomor 33 Tahun 2020, harus dicabut dan diganti dengan pergub yang baru, yang materi muatannya memenuhi prinsip-prinsip pembentukan perundang-indangan yang baik dan mencerminkan konsep Good Covid-19 Governance, agar dapat dilaksanakan dan memberi perlindungan kepada masyarakat.Kata kunci: Produk hukum, Pergub Maluku Nomor 15/2020, Covid-19

Abstract

Law of the Republic of Indonesia number 19 of 2019 concerning the second amendment to law number 30 of 2002 concerning the Corruption Eradication Commission was formed with the aim of increasing the efficiency and effectiveness of efforts to eradicate corruption. In carrying out its duties, the Corruption Eradication Commission was given the authority to conduct investigations, investigations, and prosecutions (indictments) of corruption crimes involving law enforcement officers, state administrators, and other people related to corruption crimes committed by law enforcement officers or state administrators.

Abstract

Introduction: Issuance of environmental permits by the West Seram Regency Government without supervision has resulted in non-compliance with environmental permits which has resulted in environmental damage.Purposes of the Research: This writing aims to examine and analyze the Authority of the West Seram Regency Government in supervising the Decree of the West Seram Regent Number 525-456 of 2017 concerning Environmental Permits for the Cultivation of Nutmeg Intercroop Cocoa Plantations, to study and analyze what administrative sanctions can be given West Seram Regency Government regarding violations of environmental permits. Methods of the Research: Normative research method with the type of research is qualitative analysis. The problem approach used is the statute approach, the conceptual approach and the case approach. The sources of legal materials used are Primary legal materials, Secondary legal materials, and Tertiary legal materials and are used as a technique for collecting legal materials, then processing and analyzing legal materials through methods of interpretation, harmonization, systematic and legal discovery.Results of the Research: The results of the study show that the authority to issue environmental permits by the West Seram Regency Government can automatically become an obligation for the West Seram Regency Government as the issuer of environmental permits to supervise environmental permits issued by the West Seram Regency Government, administrative sanctions that can be imposed by the Government West Seram District to violators of environmental permits is, written warning, government coercion, freezing of environmental permits and revocation of environmental permits.

Abstract

Introduction: Government Regulation No. 81 of 2012 article 17 paragraphs (2), (4) and (5), stipulates that The District/City Government provides a means of sorting District/City-scale waste against 5 types of waste. Then, Local Regulation No. 11 of 2015 Article 27 letter f, only requires Local Government of Ambon City to provides waste sorting facilities for 3 types of waste.Purposes of the Research: The purpose of this research is to find out and analyze the conflict of norms in the regulation of Local Regulation No. 11 of 2015 Article 27 letter f with Government Regulation No. 81 of 2012 article 17 paragraphs (2), (4) and (5). The conflict of norms that occurs between the two regulations, interaction is a unilateral conflict of norms and in substantially is a partial conflict of norms.Methods of the Research: This research used normative research method.Results of the Research: Based on the principle of hierarchy, Local Regulation. In fact Local Regulation No. 11 of 2015 Article 27 letter f regulates the type of waste that is not in accordance with Government Regulation No. 81 of 2012 article 17 paragraphs (2), (4) and (5).

Abstract

Abstrak: Kehidupan perekonomian masyarakat hukum adat sangat bergantung pada kekayaan sumber daya alam, dan hutan adat adalah salah satu dari sekian banyak kekayaan alam yang dapat dikelola. Namun tidak semua masyarakat hukum adat dapat mengelola hutan yang ada dalam wilayah adat untuk memenuhi kebutuhan hidupnya, hal ini disebabkan karena kepemilikan negara atas hutan begitu kuat, untuk itu pengetahuan dan kesadaran hukum masyarakat hukum adat harus ditingkatkan. Adapun kegiatan in di di Negeri Sohuwe dan Negeri Waraloin dengan tujuan untuk memberikan pemahaman dan meningkatkan pengetahuan tentang implikasi hukum penetapan hutan adat bagi peningkatan perekonomiannya. Metode yang digunakan yaitu sosialisasi atau penyuluhan dan diskusi. Hasil dan kesimpulan yang didapatkan adalah ada anggota masyarakat yang telah mengetahui dan ada juga yang belum mengetahui tentang penetapan hutan adat dan implikasinya, selain itu lewat diskusi yang dibangun, ditemukan bahwa ada upaya menghalang-halangi masyarakat dalam mengelola hutan adat dengan alasan bahwa hutan tersebut merupakan hutan lindung. Strengthening the Legal Implications of Customary Forest Designation for Economic Improvement of Customary Law PeoplesAbstract: The economic life of indigenous peoples depends heavily on the wealth of natural resources, and customary forests are one of the many natural resources that can be managed. However, not all customary law communities can manage forests in customary territories to meet their needs; this is because state ownership of forests is so strong that knowledge and legal awareness of indigenous peoples must be improved. The activities in Sohuwe State and Waraloin Country aim to provide understanding and increase knowledge about the legal implications of establishing customary forests for economic improvement. The methods used are socialization, counselling, and discussion. The results and conclusions obtained are that community members already know, and some need to learn about customary forests' designation and implications. Besides that, through discussions that were built, it was found that there are efforts to hinder the community in managing customary forests because the forest is a protected forest.

Abstract

Introduction: Legal issues in this study include, What is the form of responsibility of local governments towards abandoned children and the legal consequences that arise if local governments do not carry out responsibilities towards abandoned children.Purposes of the Research: This paper aims to describe the legal consequences if local governments do not carry out their responsibilities towards abandoned children.Methods of the Research: The type of research used is normative research, where research is carried out by collecting legal materials obtained from literature studies. The problem approach used is a statutory approach and a conceptual approach. Legal materials are analyzed qualitatively to achieve clarity on the issues to be discussed.Results of the Research: The results of this study show that Legal consequences arising if the local government does not carry out its responsibilities towards abandoned children based on Perma No. 2/2019 Article 3 that local governments can be sued on the grounds of committing illegal acts because negligence towards the responsibility of caring for abandoned children has been regulated in laws and regulations, besides that it is also contrary to the principles of good governance

Abstract

Introduction: Disability is often defined as an illness or injury that impairs and limits a person's mental and physical abilities or the state of being unable to do things in an unusual way.Methods of the Research: The research method used is normative juridical research, the type of research is analytical descriptive. The sources of legal materials used are primary, secondary and tertiary legal materials. The legal material collection technique used in this research is through library research. Analysis of legal materials is descriptive qualitative.Results of the Research: Based on the analysis, the authors conclude 1. The form of local government responsibility is to provide access to infrastructure, access to single residential buildings inhabited by persons with disabilities, and provide facilities for pedestrians. 2. Legal consequences if the Regional Government does not carry out its responsibility to provide accessibility, that is, it will be subject to sanctions in accordance with the provisions of the applicable laws and regulations

Abstract

Introduction: Constitutionally, Indigenous Peoples are 'subjects' of natural resources which are the rights of Indigenous Peoples that have been managed and maintained for generations based on their local wisdom. Indigenous Peoples must be involved in investment activities through the involvement of Indigenous Peoples from the beginning of the planning stage to provide input and other involvement in share ownership of investment or business activities.Purposes of the Research: This research was conducted with the aim of knowing and analyzing the form of fulfillment of the involvement of Indigenous Peoples in the implementation of investment activities.Methods of the Research: The research conducted is normative. For this reason, the problem approaches used are: a statutory approach, a conceptual approach, and a human rights-based approach. The sources of legal materials used consist of primary legal materials and secondary legal materials. And then the legal materials are collected for inventory and used in the analysis of the problems raised.Results of the Research: The fulfillment of the rights of Indigenous Peoples to customary territories and rights to manage natural resources in investment activities has not been fully realized. The government must ensure that the fulfillment of the rights of Indigenous Peoples in investment activities is accommodated and not violated in the preparation of laws and regulations. So that the legal certainty of the involvement of Indigenous Peoples in investment can be fulfilled, in the form of involvement from the planning stage to the implementation of the investment.

Abstract

Pulau Seram memiliki komunitas masyarakat hukum adat yang tergabung dalam suatu persekutuan hidup secara berkelompok dalam bentuk tertentu yang sering disebut Patai dalam bahasa Wemale. Persekutuan ini sebagai sarana untuk menghimpun masyarakat hukum adat sekaligus sebagai bentuk persekutuan pemerintahan adat yang secara hukum belum diatur secara jelas dalam sistem pemerintahan negeri saat ini terutama berdasarkan peraturan perundang-undangan. Tujuan dari pengabdian ini untuk memberikan penyuluhan hukum atau sosialisasi terkait kedudukan sistem pemerintahan adat Yapio Patai dalam persekutuan masyarakat hukum adat di Pulau Seram dan untuk memberikan pemahaman tentang pentingnya pengaturan Yapio Patai dalam pengaturan hukum. Pengabdian ini dilakukan dengan menggunakan metode penyuluhan hukum atau sosialisasi. Dengan hasil memberikan rekomendasi kepada masyarakat adat tentang kedudukan Yapio Patai dapat diterima oleh masyarakat persekutuan Yapio Patai sebagai bentuk pemerintahan adat yang tetap hidup dan berfungsi di tengah-tengah persekutuan tersebut, dan untuk menjaga eksistensi keberadaan persekutuan Yapio Patai dalam kaitan dengan hukum adat dan penyelesaian masalah-masalah adat antara marga-marga yang ada di dalamnya, maka direkomendasikan untuk membentuk Dewan Saniri Yapio Patai dengan Peraturan Bersama Kepala Pemerintah Negeri.

Abstract

Introduction: Supervision of Regional Regulations according to the 1945 Constitution of the Republic of Indonesia, Law Number 23 of 2014, PP Number 79 of 2005 and Permendagri Number 1 of 2014 is carried out by the Government. In exercising the authority to supervise Regional Regulations, the Government is limited to the parameters regulated by laws and regulations. Purposes of the Research: To analyze the supervision Parameters of Regional Regulations regulated in Law Number 23 of 2014. Methods of the Research: This research is a normative research, with a statutory approach and a conceptual approach. Results Originality of the Research: The results of the research found that the provisions of Article 7 of Law Number 12 of 2011 are in accordance with the principle of lex superiori derogate legi inferiori, namely a regulation may also not apply if it clearly contradicts a higher regulatory norm. In a theoretical perspective, the principle of lex superiori derogate legi inferiori was developed by Hans Kelsen and Hans Nawiasky through tiered legal norms.
