<![CDATA[Abstract. This research focuses on the consequences of inheritance law that is experienced by one of the heirs in terms of the Civil Code. The purpose of this research is to determine the legal consequences of one of the heirs controlling the inheritance and the considerations in Decision 388/Pdt.g/2020/PN.Bdg. Qualitative research approach method with doctrinal research type. The results of this research have legal consequences for one of the heirs who controls the inheritance, namely that they can be sued civilly on the basis of Article 834 of the Civil Code and Article 1365 of the Civil Code if the control is detrimental to other heirs. The judge's consideration in Decision 388/Pdt.g/2020/PN.Bdg which rejected the plaintiff's claim was because the judge was guided by Supreme Court Decision No. 232 PK/Pdt/2018 relates to rejection of inheritance defects which have permanent legal force. Abstrak. Penelitian ini berfokus pada akibat hukum warisan yang dikasai salah satu ahli waris ditinjau KUHPerdata. Tujuan penelitian ini untuk mengetahui akibat hukum salah satu ahli waris yang menguasai harta warisan dan pertimbangan pada Putusan 388/Pdt.g/2020/PN.Bdg. Metode pendekatan penelitian kualitatif dengan jenis penelitian doktrinal. Hasil penelitian ini akibat hukum bagi salah satu ahli waris yang menguasai warisan ialah dapat digugat secara perdata dengan dasar Pasal 834 KUHPerdata dan Pasal 1365 KUHPerdata apabila penguasaan tersebut merugikan ahli waris lainnya. Pertimbangan hakim pada Putusan 388/Pdt.g/2020/PN.Bdg yang menolak gugatan penggugat disebabkan hakim berpedoman pada Putusan MA No. 232 PK/Pdt/2018 berkaitan dengan penolakan pencacatan warisan yang sudah berkekuatan hukum tetap.]]>
