Abstract

This research aims to establish modern Sufism, advocated by Buya Hamka, as a solution for navigating toxic lifestyles that foster a culture of arrogance and superficiality. The research method utilized in this article is qualitative, employing a descriptive analysis approach to explore Buya Hamka's thoughts on modern Sufism as a reference for the restless Gen Z generation, troubled by their own existential concerns. Data collection involves the use of questionnaires administered through Google Forms and library research. The primary data sources include processed responses from respondents gathered through Google Forms, while secondary data sources comprise Buya Hamka's book "Tasawuf Modern" and various books and articles accessible via the Open Journal System (OJS). Data analysis techniques entail descriptive analysis utilizing reduction, display, and verification methods. The findings of this writing conclude that Buya Hamka's modern Sufism serves as a suitable solution for Gen Z individuals seeking to transform their toxic and problematic lifestyles. The approach of modern Sufism emphasizes the practice of asceticism within happiness, underscores the importance of education and modesty culture, and emphasizes the maintenance of mental and physical health balance to consistently remember Allah SWT.

Abstract

This article is based on a critical review of the verdict of 916/Pdt.P/2022/PN.Sby, which recognizes the validity of interfaith marriages in Indonesia. This decision is different from the provisions of the marriage law in force in Indonesia. Indonesia has regulated that marriages can be carried out according to their respective religions. This article aims to critically analyze the verdict of 916/Pdt.P/2022/PN.Sby. This research is a normative juridical study with a case approach. The main data sources are obtained from court decisions and marriage laws. This article also uses several important articles and research resulting from empirical studies. Based on the data findings and analysis that have been carried out, this paper argues that: Firstly, interfaith marriages are prohibited in Islamic law because they contain more harm than good; this prohibition merely closes the opportunity for bad impacts to occur after the marriage; and second, the decision issued by the Surabaya District Court Judge was inappropriate because it conflicted with positive law and Islamic law. Legally, the judge may refuse to grant permission based on Article 2 paragraph (1) of the Law on Marriage and the Compilation of Islamic Law (KHI). In this decision, the judge has a different interpretation of the marriage regulations that apply in Indonesia.

Abstract

Indonesia has a pluralist background, so realizing one rule accommodating all interests is a challenge. Among them is the unification of the rules on marriage. The purpose of this study is to explore historically the growth and development of taqnin from time to time, taqnin of marriage law in Indonesia, the legality of post-taqnin marriage law, challenges and opportunities, and challenges of taqnin. This literature research method uses quantitative with an exploratory analysis approach, namely analyzing fikih munakahat products transformed into positive law. Data processing by managing library materials (library research). Secondary data sources are Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law (KHI) and books and articles based on OJS (Open Journal System). Techniques for analyzing the data obtained were exploratory and descriptive analysis using the techniques of reduction, display, and verification. The results showed that, based on historical aspects, taqnin had been pursued since the abasiyah daulah but has experienced ups and downs in its implementation. Second, The transformed legal product is dynamic. Third: Munakahat jurisprudence has gone through the process of taqnin to have the legality of state law, so it becomes the primary source in marriage issues. Fourth: The opportunities and challenges faced are internal and external.

Abstract

AbstractIntroduction to The Problem: Technological advances, especially the internet, have driven the rapid growth of e-commerce in Indonesia. So, examining the suitability of transactions on platforms such as Zalora with the principles of Islamic sale and purchase contracts is essential.Purpose/Objective Study: This article explores the suitability of the sales and purchase contract in Zalora Indonesia's e-commerce platform with Sharia principles.Design/Methodology/Approach: This research utilizes a qualitative method with an exploratory, descriptive analysis approach. This study's primary and secondary data sources are primary and secondary sources. Primary data sources were obtained directly from participant observation within the Zalora e-commerce application, where the researcher was directly involved as a buyer on Zalora Indonesia's platform. The observed data included the application of contracts in Zalora Indonesia and then comparing their suitability with Islamic contract principles. Secondary sources were taken from books and articles based on the Open Journal System (OJS) regarding contracts and e-commerce. The data obtained will be processed through a framework analysis method, and then the data will be organized into sentences corresponding to the findings. The techniques used in analyzing the collected data include classification, exploration, verification, and conclusion.Findings: The research findings indicate that e-commerce transactions in Zalora, Indonesia, are based on the principles of sales and purchase contracts in Islam. Principles such as godliness, permissibility, honesty, equality, trust, commitment, welfare, keeping promises, willingness and agreement, transparency, and convenience have been applied in e-commerce transactions on Zalora Indonesia's platform..Paper Type: Research ArticleKeywords: Akad; Principle; Zalora Indonesia

Abstract

This paper is to examine the appropriateness of implementing halal tourism in the Dama Batang Park tourist attraction in accordance with the standardized criteria outlined in DSN MUI fatwa No. 16 of 2016. This research methodology employs qualitative techniques, utilizing field research and exploratory analysis for data processing. The study utilizes both primary and secondary data sources. Primary data sources are derived directly from observational interviews with management of the Dama Batang Park tourist attraction, while secondary sources are extracted from DSN-MUI Fatwa No. 16 of 2016, books, and publications published in the Open Journal System (OJS) concerning halal tourism. The data analysis technique applied involves a series of steps, including classification, exposing data, verifying the data obtained through the analysis of standardization values with the results of field findings, and producing conclusions from the data that has been collected and presented. The results of these findings explain that several standardization values have been written in the fatwa so that it becomes a reference in assessing whether the tourist attraction is halal or not. Then after being analyzed, in general, the Dama Batang Park tourist attraction has met the criteria as a halal tourist attraction, but several shortcomings can be resolved immediately such as the community selling merchandise that does not have a halal certificate and the use of e-money in transactions, the community still uses conventional financial institutions.
