Abstract

The study investigates the implementation of zakah as a strategy for community empowerment in Gunung Binjai village, Balikpapan city, via the Zakah Community Development (ZCD) system. Utilizing descriptive qualitative methods with a socio-economic approach, the research evaluates the system through maqasid al-syariah. Findings indicate that the ZCD system enhances the welfare of zakah recipients (mustahik) in line with maqasid al-syariah principles, particularly daruriyatul khams, which include protecting religion, life, intellect, progeny, and property. This system significantly improves mustahik socio-economic well-being, illustrating zakah’s role beyond charity as a tool for societal transformation. The study provides empirical evidence and a detailed analysis, highlighting the ZCD system as a model for effective community empowerment and demonstrating the compatibility of Islamic principles with contemporary socio-economic development. It advocates for a holistic approach rooted in maqasid al-syariah to achieve sustainable progress in marginalized communities.

Abstract

The state has a constitution and Islam has a sharia that aims to regulate human life so that it runs well and does not violate the eastern norms and values adopted by Indonesian society. This article aims to examine the extent of the state's efforts through the Constitution and Islam through sharia to prevent someone from becoming LGBT. This research is a literature review with the type of normative research that uses the statute approach and phenomenological approach. Based on the analysis, the state and Islam have tried to prevent LGBT early on. The Constitution and Sharia regulate that the family is formed on a good and solid foundation in the face of LGBT issues. However, due to the lack of firmness of the Constitution, LGBT perpetrators still find loopholes to exist and change their appearance to better match the gender they want. At the end of the stage, to legalize the gender transition and be recognized by the state, they apply for a change of identity on the Indonesia Identity card through the Court. The constitution that regulates this change is also considered not firm, all returned to the judgment and decision of the judge to accept or reject their application.

Abstract

Understanding the fiqh of menstrual blood is very important for women, but not many formal schools teach menstrual blood material in Islamic religious studies. Though it is not easy to understand it because the menstrual blood cycle of each woman is different. This study aims to analyze the explanation of fiqh of menstrual blood in Buya Yahya's method and the basic knowledge of fiqh of menstrual blood on the understanding of UMKT Faculty of Law students. Buya Yahya's method in explaining the fiqh of menstrual blood is considered as one of the methods that is easy to understand. This research uses quantitative methods with data collection techniques used are questionnaires, with primary data sources, namely data obtained directly from the source through the distribution of forms. The data analysis technique used is multiple linear regression. The results showed that students understand the basic knowledge of fiqh of menstrual blood and the explanation of fiqh of menstrual blood in Buya Yahya's method.

Abstract

This study examines the standards and provisions of fuqaha and muhaddisun in the use of daif hadith as a legal basis, as well as its application in the fatwa of the DSN-MUI with a focus on the sulh hadith and its implementation in the fatwa on Musyarakah Sharia Current Account Financing. This study highlights the lack of clear criteria and transparency in the use of daif hadith in the DSN-MUI fatwa which impacts the credibility and legal force of the fatwa . The purpose of the study is to describe the standards for the use of daif hadith according to the views of hadith and fiqh scholars, while also evaluating its application in the practice of DSN-MUI fatwas. The method used is normative legal research with textual and content analysis, including takhrij sanad and matan hadith as well as comparison with other valid evidence and established fiqh rules. The results of the study indicate differences of opinion between fuqaha and muhaddisun regarding the criteria and use of daif hadith as evidence. In the DSN-MUI fatwa , the frequently used hadith sulh has a weak sanad due to problematic narrators, but the text remains relevant and in accordance with sharia principles that encourage peaceful dispute resolution. In the fatwa on Sharia Musyarakah Current Account Financing, the implementation of the hadith sulh and other hadiths , some of which are weak, indicates the need for increased methodological accuracy and transparency in the inclusion of hadith status to maintain the credibility and accountability of fatwas , especially in facing the dynamic needs of contemporary sharia.
