Abstract

This research discusses default in the payment of land purchase using a home ownership credit as a basis for canceling a sale that has been registered at the land office, based on the Court Decision Number 15/Pdt/2020/PT.Bdg. In this case, the bank disbursed the credit according to the credit agreement between the buyer and the bank, which should have been paid to the seller by the buyer. However, since the money was not paid despite the transfer of rights being registered at the Land Office, the seller suffered a loss due to the buyer's default. This default can create new legal problems if not promptly resolved through the court. The research method used is doctrinal legal research, based on legal doctrines and applicable laws and regulations. The research typology used is descriptive-analytical. This method describes the applicable laws and regulations and relates them to legal theories and the practice of positive law relevant to the issue. This research focuses on whether a default can annul a land sale that has been registered with the land office and the differences between default and unlawful acts in canceling an engagement based on applicable regulations. The result of this research is that the transfer of land can be annulled by proving that a default has indeed occurred through a judge's decision in accordance with Article 1266 of the Civil Code.

Abstract

Tujuan dari penelitian ini adalah untuk menganalisis pengaturan mengenai kegiatan publikasi dan promosi diri yang dilarang oleh Notaris di Indonesia melalui Kode Etik Notaris dan di Belanda melalui Code of Notary Ethics serta penerapan kegiatan publikasi atau promosi diri Notaris di Indonesia dibandingkan dengan Belanda. Penelitian ini menggunakan metode penelitian hukum Normatif atau Doktrinal. Dalam era digital ini, semua profesi, termasuk notaris, cenderung menggunakan situs web sebagai sarana untuk meningkatkan visibilitas dan keterjangkauan layanan mereka. Ditemukan bahwa pengaturan mengenai kegiatan publikasi dan promosi diri oleh Notaris di Indonesia sangat ketat. Di Indonesia, notaris dilarang melakukan seluruh kegiatan publikasi dan promosi diri sebagai tindakan pencegahan terhadap persaingan usaha yang tidak sehat. Notaris di Indonesia dilarang untuk melakukan segala tindakan yang memperkenalkan dirinya sebagai seorang Notaris. Hal ini berbeda dengan yang diatur di Belanda dimana para Notaris dapat memberikan informasi-informasi umum seperti nama, alamat kantor, nomor telefon, surat elektronik, serta jasa-jasa yang ditawarkan tersebut yang dilakukan tanpa memuji diri sendiri. Seharusnya, Notaris di Indonesia juga dapat memberikan informasi yang umum seputar profesi Notaris tersebut. Namun perlu diingat bahwa hal ini wajib dilakukan tanpa adanya keinginan untuk memuji diri sendiri ataupun memberikan konsepsi bahwa Notaris tersebut adalah yang paling unggul serta merendahkan Notaris lainnya. Sifat saling menghormati sesama rekan notaris juga merupakan nilai etika dan moral yang diajarkan dalam Kode Etik Notaris di Indonesia.

Abstract

ABSTRAKArtikel ini bertujuan untuk memberikan pemahaman tentang perlindungan indikasi geografis pada perdagangan produk Kopi Luwak Arabika Indonesia yang berasal dari Jawa, Sumatra, dan Sulawesi. Kopi Luwak Arabika merupakan salah satu kopi khas Indonesia yang telah dipromosikan dan dipasarkan secara luas ke mancanegara, salah satunya ke Amerika Serikat. Meskipun Kopi Luwak Arabika sudah dikenal luas sebagai kopi khas Indonesia, tetapi Kopi Luwak Arabika belum terdaftar dalam indikasi geografis di Indonesia yang merupakan negara asalnya. Oleh karena itu artikel ini akan membahas perlindungan indikasi geografis terhadap Kopi Luwak Arabika yang dihasilkan di Indonesia dan dijual di Amerika. Kopi ini seyogianya perlu segera mendapatkan perlindungan indikasi geografis di Indonesia sebagai negara asal budidaya dari Kopi Luwak Arabika, untuk dapat melindungi produk kopi tersebut baik di Indonesia maupun dimancanegara. Penulisan artikel ini menggunakan metode penelitian yuridis normatif. Kesimpulan dari artikel ini cukup unik karena indikasi geografis pada kopi luwak arabika ini ditemukan bukan dari biji kopi arabika, namun dari sebaran binatang khas di Indonesia yaitu Luwak (Paradoxurus Hermaphroditus) yang secara khusus melibatkan Luwak melalui proses fermentasi di pencernaan Luwak. ABSTRACTThis article aims to provide an understanding of the protection of geographical indications on the trade of Indonesian Arabica Luwak Coffee products originating from Java, Sumatra and Sulawesi. Kopi Luwak Arabica is one of Indonesia's specialty coffees that has been widely promoted and marketed to foreign countries, including the United States. Although Kopi Luwak Arabica has been widely recognized as a typical Indonesian coffee, it has not been registered in geographical indications in Indonesia, which is the country of origin. Therefore, this article will discuss the protection of geographical indications for Arabica Luwak Coffee produced in Indonesia and sold in America. This coffee should immediately get geographical indication protection in Indonesia as the country of origin of the cultivation of Arabica Luwak Coffee, to be able to protect the coffee product both in Indonesia and abroad. The writing of this article uses normative juridical research methods. The conclusion of this article is quite unique because the geographical indication on luwak arabica coffee is found not from arabica coffee beans, but from the distribution of typical animals in Indonesia, namely Luwak (Paradoxurus Hermaphroditus) which specifically involves Luwak through the fermentation process in Luwak's digestion. Abstract

This article seeks to find methods for preventing the chilling effect of International Investment Law (“IIL”), according to the Indonesian legal system. The IIL has been known as one of the controversial legal regimes in international law, due to its main issue to balance the right of foreign investors and the sovereignty of the host state. From the host state’s point of view, an international arbitration tribunal award in favor of the foreign investors may cause a chilling effect on its right to regulate an investment measure. Since Indonesia is a country that is currently experiencing this effect, the article herein provides three discussions on how the chilling effect can be prevented. In providing these discussions, this article applies the doctrinal approach by taking into account the cases in hand, particularly where Indonesia is one of the parties. The first discussion provides explanations concerning the Tecmed v. Mexico case, which reflects how the absence of domestic law concerning cooling-off period may damage a state’s sovereignty. This discussion also provides findings in Amco v. Indonesia and Oleovest v. Indonesia, which shall be considered as cases where Indonesia applied its cooling-off period, despite its defeat in the Amco’s Tribunal. Furthermore, the second discussion explains how the cooling-off period and the exhaustion of local remedies are interconnected. This discussion shows the weakness within the Indonesian legal system and an example of the Indonesian government’s BITs, which consist of a cooling-off period, despite not transposed to its national law. Last but not least, the third discussion explores how a mediation and administrative court shall be utilized by Indonesia as a cooling-off period mechanism. This discussion also consists of recommendations on how Indonesia’s national investment law shall be amended in preventing the IIL chilling effect.
