Abstract

“Anak” biasanya berarti sesuatu yang lebih kecil, seseorang yang belum dewasa, atau benda yang berada “di bawah” benda lain.Terjadi peningkatan laporan kasus penganiayaan orang tua terhadap anak di bawah umur dan kasus penganiayaan anak yang dilaporkan ke Polrestabes Palembang. Salah satu kasus yang terjadi di Panti Asuhan Fisabilira, dimana anak-anak mendapat santunan atas perbuatan yang dilakukan pemilik panti. Metode penelitian yang diterapkan berkenaan dengan penelitian ini merupakan penelitian hukum empiris atau biasa disebut penelitian lapangan, yang hal tersebut menganalisis dan mengkaji peraturan perundang-undangan yang berlaku saat ini dan apa yang terjadi di masyarakat nyata. Hasil pembahasan ini menjadi dasar pertimbangan hakim dan jaksa yang akan memutuskan apakah reparasi akan berhasil atau tidak, berdasarkan pada dasar evaluasi, landasan pengambilan keputusan, dan nilai-nilai kehidupan dalam masyarakat.

Abstract

Repeat victimisation, also known as revictimisation, is when a person who has been a victim of a crime experiences a similar event at a later date. This phenomenon has become a serious concern in the study of victimology and criminology.To determine and analyse the internal factors that influence women victims of crime so that they are vulnerable to experiencing repeat violence (revictimisation) and explain how patriarchal norms in Indonesian society limit women in reporting or seeking help for self-victimisation in the event that violence is suffered.The type of research applied is normative research.Women are still vulnerable to repeated violence (revictimisation), which is often triggered by several causes, namely extinsic and instrinsic, the internal causes are Women have common characteristics in the form of submission to dominant male power, Women also often experience emotional dependence and attachment / dependence on the perpetrator, fear of the threat of being separated from children, feeling cared for and receiving love and / or because they feel love from their partner, fear of losing it ‘or because they don't have anyone anymore’. In Indonesia, patriarchal norms discourage women from reporting violence and seeking help, which can be exacerbated by stigmatisation and stigma. This situation can be exacerbated by social stigma, powerlessness, economic dependence, reinforcement of adverse power patterns, and cultural norms governing gender roles). Abstract

Crime prevention and eradication are part of the government's duties in law enforcement. Narrowly, law enforcement is associated with the prevention and eradication of crime through the criminal justice system. The police as the front guard play a role in the investigation. The problem of this thesis is how the law enforcement against the crime of theft of oil palm fruit by PT. Agro Muara Rupit (WEST) by the Muratara Police and the inhibiting factors. This empirical legal research shows that law enforcement is carried out penally without restorative justice because it is rejected by the company. The main obstacles are the rejection of RJ, as well as factors of law enforcement, infrastructure, and community culture.
