Abstract

AI made human work easier in creating many things, like works of art. However, this is worrying for creators or owners. They are concerned about fulfilling exclusive rights to works of art. AI is part of technological developments that should be used as a tool for creators to create works of art. Therefore, clear boundaries are needed regarding how much AI can be used by creators as a tool in creating works of art so there is no reduction in the value of the creator's own efforts and creativity. The type of research that the author uses is applied descriptive with a qualitative nature. The inductive method is applied to analyze and process data which is linked to existing theories and laws and regulations. The author analyzes the comparison of copyright law protection in Indonesia and in the United States regarding works of art created by AI.

Abstract

Abstract Indonesia through Law Number 32 of 2009 concerning Environmental Protection and Management regulates the government has the right to file claims for compensation and certain actions. Minister of the Environment Regulation Number 7 of 2014 concerning Compensation for Environmental Pollution and/or Damage, as a derivative regulation, regulates that environmental compensation costs that have been paid are entered into the Treasury Fund as Non-Tax State Revenue (PNBP). This research identifies the mechanism for using environmental compensation costs, the implementation of court decisions containing environmental compensation before Supreme Court Regulation Number 1 of 2023 concerning Guidelines for Adjudicating Environmental Cases, and how this can be a solution to the problem of environmental compensation costs in Indonesia. This research applies a normative juridical approach method using several approaches, namely the conceptual approach, case approach, and comparison approach. The research results show that the environmental compensation costs that have been paid are included in the PNBP, making it difficult to disburse these funds because the process is long and the absence of a recovery plan means that the compensation costs charged to the defendant do not have a detailed calculation basis. Perma Number 1 of 2023 regulates that environmental compensation costs are managed in the court clerk's account and lawsuits are required to include a recovery plan. Abstract

An emergency situation disrupts the normal functioning of a country, rendering standard laws and procedures ineffective. In such cases, extraordinary measures are required, and the President, as the executive authority, is granted significant powers to address the emergency. The House of Representatives (DPR), as the legislative body, is responsible for overseeing the executive branch. However, the oversight function of the DPR appears to be suspended during emergencies under Government Regulation in Lieu of Law Number 23 of 1959 (Perppu Keadaan Darurat). Furthermore, there are no clear guidelines defining the DPR's role during states of emergency in Indonesia. The DPR's oversight function is crucial and cannot be eliminated, as it represents the people's interests and voices. This article employs a normative juridical method, incorporating conceptual, comparative, and legislative approaches with a descriptive analysis. It aims to explore the role of legislative oversight in emergency situations in both Indonesia and the United States, comparing the effectiveness of their oversight systems in preventing power abuse and protecting human rights. The United States has established regulations to ensure legislative oversight during emergencies, thereby preventing arbitrary actions by the executive. Indonesia could benefit from adopting similar mechanisms to enhance its legislative oversight during emergencies and better protect human rights.

Abstract

Introduction: The importance of an environment-based budget in an effort to optimize the revitalization program of the Citarum River, known as Citarum Harum. The program aims to address the serious problem of river pollution, but has not achieved optimal results because sustainable budgets have not been fully implemented.Purposes of the Research: The purpose of this research is to examine why environment-based budgeting is still not a priority in program implementation, and how this affects the overall and long-term success of the program.Methods of the Research: Using the method of policy analysis and evaluation of program implementation, this study reveals that the misalignment between budget policies and environmental needs has hampered the effectiveness of revitalization efforts.Results Main Findings of the Research: Key findings suggest that delays in the adoption of environmentally-oriented budgets result in slow, suboptimal, and unsustainable river recovery. The impact of these findings highlights the urgency of comprehensively integrating environmentally-based budgets to accelerate the recovery of river ecosystems and ensure the long-term sustainability of the program. In addition, the study also emphasizes that without proper and consistent budget support, revitalization programs such as Citarum Harum will continue to face significant challenges in achieving the expected environmental goals. In conclusion, budget management that is aligned with environmental conservation efforts is key to increasing the success of future environmental programs, including the revitalization of the Citarum River and other ecosystem restoration efforts in Indonesia.
