Abstract

Hukum merupakan panglima yang sangat bermanfaat untuk melindungin masyarakat dari ketidak adilan para penguasa namun pada pelaksanaannya hukum hanya merupakan panglima dalam dunia mitos yang tidak terwujud terutama dalam hal keadilan. Tidak dapat terwujud hukum sebagai panglima di karenakan hukum merupakan produk dari politik dan di buat oleh para penguasa yang memiliki kepentingan pribadi dan kelompok sehingga lengkap sudah dimana hukum di buat oleh penguasa dan penegakannya dilakukan oleh penguasa maka kekuatan hukum yang menghasilkan keadilan akan lemah atau tidak terwujud karena politik merupakan Raja pada dunia relaitasnya.

Abstract

Criminal law is a bad law, if a criminal sentence is imposed on someone, it will experience such a heavy misery, criminal law is no longer relevant to its implementation and what is most feared in criminal law is its implementation by law enforcers who have the authority which is still being influenced. by political interests. The paradigm of criminal law adopted is the paradigm of modern criminal law, which is not retributive. In this study, there are several problem formulations, namely first, what makes criminal law a bad law? second, what is the paradigma of modern criminal law? and in this study has a normative research method.

Abstract

The development of information and communication technology (ICT) has changed various aspects of human life, making understanding the laws governing the use of this technology, such as the Information and Electronic Transactions Law (UU ITE), very important. The ITE Law in Indonesia, which was passed in 2008, was revised in 2016. The second amendment in 2024 regulates various aspects ranging from electronic transactions to criminal sanctions for misuse of information technology. A good understanding of the ITE Law can provide legal protection, create safe transactions, prevent violations, and increase people's digital literacy. Violations of the ITE Law can result in legal sanctions, financial losses, reputation damage, and threats to data security. This article highlights the importance of education and understanding of the ITE Law to build a safe and responsible digital ecosystem.

Abstract

Pembuatan UU Perampasan Aset sebagai instrumen hukum untuk pemberantasan kejahatan ekonomi dan korupsi memiliki urgensi yang sangat besar dalam konteks hukum di Indonesia. UU Perampasan Aset dapat mencegah penyalahgunaan kewenangan oleh aparat penegak hukum adalah dengan menyusun ketentuan hukum yang jelas, terperinci, dan tegas.UU harus menetapkan kewenangan yang tegas bagi aparat penegak hukum, terutama mengenai siapa yang berhak melakukan perampasan aset dan kapan perampasan tersebut dapat dilakukan. Hal ini mencakup batasan mengenai peran masing-masing lembaga, seperti KPK, Kejaksaan, Kepolisian, dan Pengadilan. Tanpa adanya batasan yang jelas, akan ada potensi aparat penegak hukum bertindak sewenang-wenang dalam mengambil keputusan atau melakukan tindakan perampasan tanpa dasar yang kuat.

Abstract

The proof of motive in the crime of premeditated murder plays a crucial role but faces significant challenges due to the absence of a clearly defined motive within Article 340 of the Indonesian Criminal Code, leading to varying interpretations and inconsistent applications of the law. Some judges consider motive as a basis for sentencing, while others do not, resulting in legal uncertainty and concerns over fairness and uniformity in judicial decisions. This research aims to analyze the position of motive proof within the crime of premeditated murder and propose an ideal concept for its future application. Using a normative legal research method with statutory, conceptual, and case study approaches, the findings reveal that the absence of a clear directive regarding motive causes inconsistent judicial practices and undermines legal certainty. The study highlights the need to explicitly incorporate motive as an essential element of proof in Article 340 to enhance fairness and consistency in judicial decisions. It concludes that integrating motive into the legal framework of premeditated murder is critical to ensuring clarity for judicial interpretation, upholding justice, and strengthening the reliability of the legal system.
