Abstract

Perkembangan pesat sektor e-commerce di Indonesia membawa dampak signifikan terhadap pola transaksi masyarakat digital. Tokopedia, sebagai salah satu platform e-commerce terbesar, telah mengembangkan berbagai kebijakan untuk melindungi konsumen dalam transaksi online, seperti kebijakan pengembalian barang, jaminan transaksi, dan sistem mediasi sengketa. Namun, meskipun kebijakan tersebut telah diterapkan, masih banyak permasalahan yang muncul di lapangan, seperti lambatnya proses penyelesaian sengketa, ketidakjelasan informasi terkait kebijakan, dan kurangnya perlindungan terhadap data pribadi konsumen. Hal ini menunjukkan bahwa efektivitas perlindungan hukum yang dijalankan belum sepenuhnya optimal dan masih memerlukan pembenahan. Penelitian ini bertujuan untuk menganalisis sejauh mana perlindungan hukum yang diberikan Tokopedia mampu menjawab kebutuhan dan perlindungan hak-hak konsumen dalam transaksi digital. Penelitian menggunakan metode deskriptif kualitatif dengan pendekatan studi kasus, melalui wawancara dengan konsumen serta telaah dokumen kebijakan Tokopedia dan literatur terkait perlindungan hukum. Hasil penelitian menunjukkan bahwa Tokopedia telah memiliki instrumen perlindungan konsumen yang cukup lengkap, tetapi implementasinya masih menghadapi berbagai tantangan. Beberapa kendala yang ditemukan meliputi minimnya edukasi konsumen terkait hak mereka, proses mediasi yang tidak selalu adil atau transparan, serta lemahnya sistem keamanan data pribadi. Berdasarkan temuan tersebut, disarankan agar Tokopedia mempercepat penyelesaian sengketa secara efisien dan terbuka, meningkatkan edukasi konsumen mengenai hak-haknya, serta memperkuat sistem keamanan dan transparansi perlindungan data pribadi. Di sisi lain, regulasi perlindungan konsumen dalam e-commerce perlu diperbarui secara responsif terhadap perkembangan teknologi digital guna menciptakan ekosistem transaksi online yang aman, adil, dan terpercaya.

Abstract

This community service program aims to enhance understanding of legal protection for teachers in performing their professional duties. The implementation method includes preparation, problem identification, socialization, and monitoring and evaluation (Monev). Through this initiative, teachers gained comprehensive insights into their professional rights, obligations, and legal protection mechanisms as regulated by Law No. 14 of 2005 and Government Regulation No. 74 of 2008. The results showed a significant increase in participants' regulatory understanding, rising from 42% to 89%. The findings reveal that the primary obstacle to teacher protection is not a lack of regulation, but rather weak implementation and insufficient inter-institutional synergy. Consequently, systematic collaboration among local governments, education offices, professional organizations, and legal institutions is required, including the establishment of a Teacher Protection Task Force to ensure an effective and sustainable protection system.

Abstract

This article examines the persistent influence of legal formalism within Indonesia’s civil justice system and its implications for the protection of Indigenous Peoples’ customary land rights, particularly through class action litigation and the doctrine of legal standing. Land disputes involving Indigenous communities reflect structural injustice, as legal recognition remains heavily dependent on administrative validation rather than historical, social, and cultural realities. Consequently, Indigenous Peoples often face significant barriers in accessing justice, despite constitutional acknowledgment of their existence and rights. Using normative legal research, this study analyzes statutory frameworks, judicial decisions, and doctrinal approaches governing class actions and legal standing in Indonesia. The findings demonstrate that existing procedural mechanisms frequently marginalize Indigenous communities by imposing rigid standing requirements and evidentiary standards that are incompatible with their collective and customary social structures. Rather than functioning as instruments of empowerment, class actions often reproduce exclusion through excessive proceduralism. The study argues that Indigenous marginalization stems not from the absence of substantive rights, but from the dominance of formalistic reasoning that prioritizes administrative legality over substantive justice. To address this imbalance, the article proposes a normative reconstruction of civil procedural law, including the establishment of a lex specialis on class actions and Indigenous legal standing, the contextual reinterpretation of standing doctrines, the integration of ecological and social justice principles, and the adoption of participatory and culturally responsive judicial approaches. These reforms are essential to ensure equitable access to justice within Indonesia’s plural legal system.
