Abstract

This study aims to analyse and criticise the application of sustainable development principles in forest spatial planning. The research method used is normative juridical research, and the approach used is the context and statutory approaches. The study results show that law in the primary sector must refer to sustainable development and people's welfare. Forest destruction cannot be considered a consequence of activities in this sector; it also reflects the failure of spatial planning in an area. The embodiment of spatial planning that can realise environmental preservation must lead to how the law exists in the community. The community around the forest area, as the leading actor, plays a crucial role in controlling and protecting the forest, and their involvement is vital for successful environmental preservation. An extraordinary, measurable, planned, and directed spatial arrangement is urgently and significantly needed. This is done so that the living environment is maintained and planned. Good planning is expected to lead to good spatial use, but this requires consistent management so that environmental sustainability remains aligned with spatial planning scenarios.Penelitian ini bertujuan untuk menganalisis dan mengkritisi tata ruang dalam pinjam pakai kawasan hutan dalam hubungannya dengan prinsip-prinsip pembangunan berkelanjutan. Metode penelitian yang digunakan ialah penelitian yuridis normatif dan pendekatan yang digunakan adalah pendekatan konseptual, dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa hukum di sektor kehutanan harus mengacu kepada pembangunan berkelanjutan dan kesejahteraan rakyat. Kerusakan hutan tidak dapat dianggap sebagai konsekuensi dari kegiatan di sektor kehutanan, kerusakan tersebut juga mencerminkan gagalnya penataan ruang di suatu daerah. Perwujudan tata ruang yang dapat mewujudkan pelestarian lingkungan hidup harus mengarah kepada bagaimana hukum yang ada di masyarakat, karena masyarakat sekitar Kawasan hutan dapat menjadi aktor utama pengendali dan penjaga hutan itu sendiri. Atas dasar hal tersebut dibutuhkan penataan ruang yang terukur, terencana dan terarah yang bersifat extraordinary, ini dilakukan agar lingkungan hidup tetap terjaga dan terencana. Perencanaan yang baik diharapkan dapat mengarah pada pemanfaatan ruang yang baik, namun hal ini membutuhkan tata kelola yang konsisten agar kelestarian lingkungan hidup tetap sejalan dengan skenario penataan ruang.

Abstract

Several multi-interpretive provisions in the Advocate Law are considered to violate the constitutional rights of advocates to carry out their profession. Over the years, this has resulted in quarrels and disputes between advocates regarding organizational matters, this of course has an impact on advocates, new advocates and also people seeking justice. The research method used in this research is the normative juridical method. This research is included in descriptive analysis research, aiming to describe carefully the single bar organization, history, debates, rules of advocates. The single bar system must be interpreted as an organization that accommodates all advocates, starting from education, oaths, codes of ethics and enforcement of codes of ethics. advocates so that there are clear standards to guarantee that lawyers are qualified and recognized by the state to be able to proceed in court. Judging from the institutional perspective of advocate organizations at the present time, it can be said that they are still not organized. The main factor is the lack of clear standardization in carrying out their authority as an advocate. With government intervention in efforts to form a single forum for advocate organizations as mandated by the Advocate Law, this will be realized. The government or state can do this because it has the power to form legal products, namely laws, including the Law on Advocates. The ideal concept in this research shows that the institution of a multi-bar advocate organization with a single regulator can restore the dignity of advocacy as a noble profession or nobile officiating.

Abstract

This research aims to analyze the evolution of forestry licensing regulations before and after the enactment of the Job Creation Law (CK Law). Utilizing a normative juridical approach, this study examines conceptual, statutory, and historical aspects of forestry law. The findings reveal that the politics surrounding forestry law significantly impact the balance between investment-driven economic interests and the preservation of sustainable forest cover. Prior regulatory issues in forest management remain unaddressed by the CK Law, which primarily emphasizes the exploitation of forest resources. This focus could exacerbate carbon emissions as forest utilization investments increase. While the changes introduced by the CK Law are designed to boost investment by simplifying licensing procedures, permitting multi-business activities, and facilitating foreign investment, they also present challenges for natural resource management. The revisions dilute commitments to forest conservation, reinforce disparities in forest product utilization between large corporations and local communities, and marginalize traditional forest-dependent populations. The novelty of this research lies in its critical examination of how legal reforms aimed at economic growth may unintentionally undermine long-term environmental sustainability and social equity. The urgency of this issue is highlighted by the potential long-term consequences of these legal changes on both environmental health and community welfare. This study contributes to the broader discourse on balancing economic development with environmental protection in Indonesia’s forestry sector.

Abstract

Lingkungan hidup yang sehat merupakan hak konstitusional yang diakui dalam UUD 1945,tetapi implementasinya masih menghadapi berbagai tantangan. Mahkamah Konstitusi memilikiperan strategis dalam menegakkan prinsip Konstitusi Hijau melalui judicial review terhadapundang-undang lingkungan. Penelitian ini bertujuan untuk menganalisis peran MK dalammemperkuat perlindungan lingkungan, kontribusi putusannya terhadap kebijakan lingkungan,serta tantangan yang dihadapi dalam implementasinya. Penelitian ini menggunakan metodeyuridis normatif dengan pendekatan konseptual terhadap putusan MK terkait perlindunganlingkungan. Hasil penelitian menunjukkan bahwa putusan MK telah memberikan dasar hukumyang kuat bagi perlindungan lingkungan dan kebijakan pembangunan berkelanjutan, tetapiimplementasinya masih menghadapi hambatan regulasi, kelembagaan, serta dominasikepentingan ekonomi dan politik. Oleh karena itu, diperlukan sinergi antara pemerintah, aparatpenegak hukum, akademisi, dan masyarakat sipil untuk memastikan bahwa prinsip KonstitusiHijau benar-benar diwujudkan dalam kebijakan lingkungan yang efektif. Penguatan regulasi, peningkatan pengawasan, serta partisipasi aktif masyarakat menjadi langkah krusial dalammenjamin keberlanjutan lingkungan bagi generasi mendatang.

Abstract

Asas Ultra petita dalam praktik Mahkamah Konstitusi (MK) Republik Indonesia khususnya dalam perkara pengujian Undang-undang terhadap Undang-Undang Dasar menjadi sebuah perhatian penting, secara doktrin asas ultra petita melarang hakim memberikan putusan melebihi tuntutan yang diajukan dalam petitum, sebagaimana berlaku dalam hukum acara perdata. Namun, dalam konteks peradilan konstitusi, MK kerap kali mengeluarkan putusan yang melampaui permintaan pemohon, dengan alasan untuk mewujudkan keadilan substantif dan melindungi kepentingan umum (erga omnes). Penelitian ini menggunakan meetode yuridis normatif dengan pendekatan perundang-undangan, konseptual, historis dan kasus. Hasil penelitian ini menunjukkan bahwa penerapan asas ultra petita oleh MK tidak bisa disamakan dengan peradilan umum, karena objek sengketanya bersifat publik dan berdampak luas. Oleh karena itu, selama putusan tersebut atas pertimbangan hukum yang rasional dan bertujuan untuk menegakkan supremasi konstitusi serta melindungi hak-hak konstitusional warga negara, maka penerapan asas ultra petita oleh MK dapat dianggap sah dan dapat diterima. Konsekuensi hukum dari putusan Mahkamah Konstitusi yang mengandung unsur ultra petita tetap harus dijalankan, karena putusan tersebut bersifat final dan mengikat. Dengan kata lain, sejak dibacakan dalam sidang pleno, putusan tersebut menjadi wajib untuk dilaksanakan dan ditaati oleh seluruh institusi negara, termasuk Pemerintah, DPR, serta masyarakat secara keseluruhan.
