Abstract

Perkembangan teknologi digital memunculkan kekhawatiran terhadap data-data pribadi yang dimiliki oleh setiap individu, tidak terkecuali data pribadi para konsumen yang mempercayakan pemrosesannya kepada pelaku usaha (in casu korporasi). Problematika pelindungan data pribadi konsumen menjadi cukup pelik di tengah maraknya kasus kebocoran data konsumen oleh beberapa korporasi besar di Indonesia. Konsumen sebagai subjek data pribadi menjadi pihak yang notabene lemah ketika dihadapkan dengan korporasi sebagai pengendali data pribadi. Perlu adanya identifikasi terhadap bentuk pelindungan hukum bagi konsumen dalam kasus kebocoran data tersebut. Penelitian yuridis-normatif ini menunjukan perlindungan data konsumen merupakan kewajiban hukum bagi korporasi sebagai pengendali data pribadi dalam transfer data pribadi dan bentuk pelindungan hukum tersebut dapat ditemukan dalam beberapa peraturan perundang-undangan existing di Indonesia seperti Undang-Undang Pelindungan Data Pribadi, Undang-Undang Perlindungan Konsumen, Undang-Undang Informasi dan Transaksi Elektronik serta peraturan turunan lainnya. Pada akhirnya, pemerintah sebagai pemangku kekuasaan merupakan kunci dalam hal pembentukan dan pelindungan hukum terhadap data pribadi konsumen sebagai pemegang hak sebagai subjek data pribadi.

Abstract

The awarding of honorary academic degrees in the form of a chancellor's decision always gives rise to positive and negative assessments from academics and the public. The aim of this research is to analyze the chancellor's decision regarding the awarding of honorary academic degrees regarding the qualifications for the State Administrative Decree (KTUN) which is the absolute competence of the State Administrative Court (PTUN) as well as legal remedies for the polemic that arises as a result of the issuance of this decision. Next we will explain the efforts law regarding disputes that arise as a result of the rector's decision. This research uses a type of juridical-normative legal research with a historical, conceptual and normative approach. The results of this research show that the rector's decision regarding the awarding of academic honorary degrees, both honoris causa doctoral degrees and professorial degrees. Honor is a State Administrative Decision (KTUN) and is included in the absolute authority of the PTUN so that if a dispute arises, the resolution can be reached through the PTUN. The conditions for granting honorary academic degrees are the result of accumulated historical thought and experience in the legal dynamics that govern it. The legal remedies for the emergence of TUN disputes related to the chancellor's decision regarding academic honorary degrees are the same as resolving KTUN disputes in general, namely through administrative efforts or litigation efforts through the PTUN.

Abstract

The number of illegal poachers is increasing in the forest area of Kepuharjo Village, Kapanewon Cangkringan, Sleman Regency. This illegal hunting activity can disrupt the ecosystem and threaten the extinction of certain animal species. One of the iconic animals of Sleman Regency which is now starting to become rare is the punglor bird (red anis) which is often hunted by members of the public. Referring to the many reports from the public to the Kepuharjo district government, it shows that the massive number of animal poaching requires follow-up efforts to overcome this problem. This research aims to increase public understanding regarding the urgency of protecting animals by prohibiting animal hunting in the forest area of Kepuharjo Village. This research is a normative-empirical research that uses descriptive-qualitative analysis techniques and is strengthened by a case study approach. The results of the research show that the cause of the high number of illegal poaching in the Kepuharjo sub-district is due to a lack of public legal awareness and a lack of firmness in law enforcement relating to the prohibition of animal hunting. As an effort to reduce the number of illegal poaching that occurs in Kepuharjo Subdistrict, The Student Community Services-Community Empowerment Learning (KKN-PPM UGM) team collaborates with the Kepuharjo Subdistrict Government to establish animal protection efforts in the form of drafting Kepuharjo subdistrict regulations regarding animal protection, making signs. animal hunting ban installed in eight hamlet points, planning of a task force to eradicate illegal poaching and other steps implemented in the context of animal protection.
