Abstract

The concept of rechterlijk pardon represents a new legal formulation introduced in Indonesia through Law Number 1 of 2023 concerning the Criminal Code, aimed at aligning criminal law with contemporary societal conditions. Beyond traditional deterrence, this concept empowers judges to consider mitigating circumstances and individual offender situations. Several European countries, including the Netherlands, have long regulated rechterlijk pardon, prompting a comparative analysis of its application between the Netherlands and Indonesia. This normative legal research compares the provisions of rechterlijk pardon in the Indonesian Criminal Code (KUHP) with those in Dutch law. The findings reveal both similarities and differences: both systems require judges to justify their decision for granting pardon and offer alternative pardon requirements, yet Indonesia includes specific considerations of justice not detailed in Dutch law. The study underscores the importance of clarifying the criteria for rechterlijk pardon implementation in Indonesia to preempt potential conflicts. Ultimately, the research advocates for a clear and harmonized framework for judicial pardon in Indonesia, ensuring consistency and fairness in its application within the criminal justice system

Abstract

Desa terdiri dari sekelompok orang yang dapat mengatur pemerintahannya sendiri. Namun, desa juga memiliki kebebasan untuk membentuk sebuah badan usaha, yaitu BUMDES. BUMDES merupakan badan usaha yang didirikan oleh pemerintah desa, dengan tujuan untuk meningkatkan dan mensejahterakan dan mensejahterakan kebutuhan ekonomi masyarakat. BUMDES yang didirikan di Desa Gili Anyar dapat membuka lapangan pekerjaan di masyarakat. Gili Anyar adalah nama sebuah desa yang terletak di Kecamatan Kamal, Kabupaten Bangkalan, Provinsi Jawa Timur. Desa Gili Anyar memiliki potensi dalam hal pengelolaan kayu. Hasil penelitian mengenai BUMDES menunjukkan bahwa hal pertama yang harus dilakukan adalah mengenali potensi yang dimiliki oleh desa tersebut yaitu Desa Gili Anyar dan melakukan sosialisasi berupa pengetahuan kepada masyarakat. Manfaat dari adanya BUMDES di Desa Gili Anyar adalah masyarakat mendapatkan harga yang lebih murah ketika berbelanja mebel yang dimiliki oleh BUMDES Desa Gili Anyar dibandingkan dengan berbelanja di mebel lain. Dan masyarakat Gili Anyar dapat memesan model apapun yang berhubungan dengan mebel. BUMDES juga secara tidak langsung dapat mengurangi pengangguran di masyarakat.

Abstract

In the dynamics of an organization, the occurrence of a conflict is indeed something that is very prone to occur. Given how the competition is very tight, it creates a conflict that we cannot avoid. Then conflict management is used in terms of managing and overcoming and tackling well the existence of a conflict within the organization. The focus of this research is how is conflict management in an intra-school student organization that occurred at SMA PLUS AL – HASAN? with the aim of knowing how to manage conflict in an organization, the importance of conflict management in an organization and conflict resolution strategies in an organization. This research uses a descriptive qualitative research method which in collecting data uses a technique of observation, interviews and documentation. This research has produced several things related to how conflict management in organizations, the importance of conflict management in organizations and how to strategy a conflict resolution in an organization.
