Abstract

Penelitian ini secara sistematis menginvestigasi isu-isu yang berkaitan dengan netralitas Aparatur Sipil Negara (ASN) dalam konteks partisipasi politik dan dukungan terhadap Pilkada Serentak Tahun 2024. Fokus penelitian dipusatkan pada pelanggaran atas netralitas ASN secara nasional menuju Pilkada Serentak Tahun 2024, yang merupakan faktor kunci keberhasilan dalam pemilihan yang transparan, berintegritas dan adil. Penelitian ini bertujuan untuk mengetahui tantangan yang dihadapi ASN dalam menjaga netralitas mereka dan implikasi dari keterlibatan politik mereka dalam proses demokratisasi. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan hukum empiris atau sosiologis, melalui pengumpulan data sumber primer dan sekunder, kemudian dilakukan analisis reduksi data dan penarikan kesimpulan. Temuan penelitian menunjukkan bahwa pelanggaran atas netralitas ASN dilatarbelakangi oleh tingkat literasi ASN mengenai sanksi pelanggaran dan proses penegakan sanksi yang belum optimal. Bawaslu dan KPU telah melakukan langkah-langkah pencegahan, seperti sosialisasi mengenai etika dan netralitas ASN, namun peran dari institusi terkait lainnya perlu diperkuat. Sistem meritokrasi dalam birokrasi dan netralitas ASN, turut andil dalam memberikan tekanan untuk memperoleh keuntungan politik. Fanatisme ASN terhadap partai politik dan kekerabatan dengan aktor politik juga menjadi tantangan bagi netralitas ASN. Perlu perbaikan baik dari segi sumber daya manusia maupun sistem yang mengaturnya untuk memastikan netralitas ASN yang lebih kuat pada Pilkada Serentak Tahun 2024.

Abstract

This research explores cybercrime incidents which resulted in data leaks on the official website of the General Election Commission (KPU). This happened repeatedly from 2004 to 2023. So, this research aims to determine the causes and impacts of cybercrime related to election data leaks on the official KPU website, as well as formulating strategic recommendations to strengthen election data security. Information security risk theory, policy decisions, and the concept of political trust are used to analyze phenomena and data with a qualitative method approach. The research results show that the KPU data leak occurred because the data security system that had not been built was not strong enough. Hacking cases have repeatedly led to a decrease in political trust and delegitimization of the election implementation process, so that the KPU requires cooperation from various stakeholders to create a safe and credible data system.

Abstract

The issue of the Regulation of the Minister of Education, Culture, Research and Technology of the Republic of Indonesia Number 30 of 2021 proves the seriousness of the government in dealing with sexual violence in universities. One form of prevention in this Ministerial Regulation is the establishment of a Task Force for the Prevention and Handling of Sexual Violence. This task force aims to be the main factor of dealing with various forms of sexual violence that can occur in universities, all includes prevention, reporting, to handling. Based on the importance of the existence of the task force, this study aims to analyze the effectiveness of establishing The Task Force of the Sexual Violence Prevention and Response in universities based on the Regulation of the Ministry of Education, Culture, Research, and Technology of the Republic of Indonesia in 2021. This study uses a mixture of quantitative and qualitative methods with data samples taken from the State University of Jakarta. This research data collection technique was carried out by distributing questionnaires and conducting a literature review using the theory of effectiveness and the use of law and the concept of roles. This research found that through quantitative research, there is significant correlation between the principles of the Sexual Prevention and Response, The Task Force’s main responsibility, and the objectives of this ministrial regulation. Through qualitative research, from the organizational component and the implimentation of gender-based regulation, this ministrial regulation is proven to be an effective regulation to handling sexual violence.
