Abstract

Abstract: Textual interpretation of hadith still dominates. As time progresses, interpretation uses patterns of contextualization of hadith as a response to the lack of hadith texts and limited textual meaning of hadith. So it is considered no longer relevant to the times. According to commentators, contextualization of hadith using a hermeneutical approach can be an alternative to enrich the interpretation of hadith, especially the mukhtalif hadith regarding the prohibition of women visiting graves. This research uses library research methods, with primary data sources from books and journals on the topic of hermeneutics. Meanwhile, secondary data comes from books and journals with the theme of the hadith prohibiting women from visiting graves. The data was analyzed using descriptive analytical methods to find the concept of hermeneutics in understanding the hadith which were considered contradictory. The research results show that the core message (significance/magzā) underlying the basic hadith text is that it is sunnah to visit graves for men or women because it reminds them of death and can always be developed in practice so that it can give rise to other problems for human life. Meanwhile, the core message (significance/magzā) that is not true, such as the prohibition on grave pilgrimages for both men and women because it causes mafsadah/'illat law (forgetting obligations as a husband/father, or as a wife/mother) when done frequently, should be done as much as possible. not practiced in order to prevent humans from things that can cause mafsadah and imbalance in their lives. Abstract

The phenomenon of lesbian, gay, bisexual and transgender (LGBT) still raises pros and cons among the public. The pro group of the idea takes refuge behind the principles of Human Rights (HAM). While the counter group tends to be normative and uses the basis of Islamic law in viewing LGBT issues. The two major currents of this group have never found common ground in positioning the LGBT issue. Therefore, through this research, researchers focus on maqashid sharia perspective which is considered to be the middle ground of the debate between the two groups. This research uses a normative approach and library research type. The main references in this research are various books on the theme of LGBT and maqashid sharia. The results show that according to the idea of maqashid sharia, LGBT as a lifestyle trend is not in line with the purpose of religion, namely the maintenance of offspring (hifdzul al-Nasl). This is because the impact of the LGBT culture of marrying and or having same-sex relationships cannot produce offspring naturally. In addition, the maintenance of offspring that aims to maintain the civilization of mankind is also contrary to the concept of LGBT. Keyword: LGBT, Maqashid syariah.

Abstract

The phenomenon of "forced marriage" carried out by marriage guardians is an interesting study to research. The majority of madhhab priests view that the presence of a marriage guardian is obligatory and constitutes harmony in marriage. Only Imam Abu Hanifah does not require the presence of a marriage guardian at a marriage. Problems arise when marriage guardians intervene excessively, thus taking over a woman's rights in making her marriage decisions. This article attempts to further explore Imam Abu Hanifah's views and their implications in viewing the position of marriage guardian which is different from the views of school imams in general. This research is a qualitative research. The approach used is a legal normative approach. This type of research is library research, the main data source comes from various books and journals which discuss Imam Abu Hanifah's opinions. The results of the research show that according to Imam Abu Hanifah, marriage guardians are not included in the pillars of marriage. According to him, the presence of a guardian in a marriage is not an obligation and does not affect the validity of a marriage. Imam Abu Hanifah believes that adult women have reason and wisdom in making decisions, including representing themselves in marriage. Keywords: Views, Imam Abu Hanifah, marriage guardian, normative, legal implications. Fenomena “kawin paksa” yang dilakukan oleh wali nikah menjadi kajian yang menarik untuk diteliti. Mayoritas imam mazhab memandang bahwa kehadiran wali nikah wajib hukumnya dan menjadi rukun dalam perkawinan. Hanya Imam Abu Hanifah saja yang tidak mewajibkan kehadiran wali nikah dalam perkawinan. Permasalahan muncul ketika wali nikah melakukan intervensi berlebih, sehingga mengambil alih hak bagi seorang perempuan dalam membuat keputusan perkawinannya. Artikel ini mencoba untuk mendalami lebih lanjut pandangan Imam Abu Hanifah tentang kedudukan wali nikah beserta implikasinya yang berlainan dari pandangan imam mazhab pada umumnya. Penelitian ini merupakan penelitian kualitatif. Pendekatan yang digunakan yakni pendekatan normatif hukum. Jenis penelitian ini library research, sumber data utama berasal dari berbagai buku dan jurnal yang membahas tentang pendapat Imam Abu Hanifah. Hasil penelitian menunjukkan bahwa menurut Imam Abu Hanifah, wali nikah tidak termasuk dalam rukun nikah. Menurutnya, kehadiran wali dalam suatu perkawinan bukanlah suatu kewajiban dan tidak mempengaruhi keabsahan suatu perkawinan. Imam Abu Hanifah memandang bahwa perempuan dewasa mempunyai akal dan kebijaksanaan dalam mengambil keputusan, termasuk mewakili dirinya sendiri dalam perkawinan.   Kata kunci: Pandangan, Imam Abu Hanifah, Wali Nikah, Normatif, Implikasi Hukum.

Abstract

The childfree phenomenon in normative legal studies is considered an aberration. Islamic law scholars refer to various considerations, ranging from being contrary to nature, not being in accordance with national culture and threatening human civilization. However, in certain cases childfree becomes an alternative because there is an element of unintentional doing it. Call it for health, psychological and other reasons. Strict restrictions on childfree practices when it is done intentionally and views having children as a burden. This research uses qualitative methods and is a library research type. Researchers use a normative legal approach in analyzing data. The analysis technique used is descriptive analytic. Data is taken from various literature such as books, journals, scientific works, official websites and related sources according to the research theme. The results of the research show that according to the progressive Islamic and Pancasila views, childfree is possible for health and psychological reasons. Apart from that, childfree is a person's private choice that cannot be interfered with by other people.
