Abstract

Keberagaman dalam beragama memunculkan perkawinan beda agama sebagai masalah yang diperdebatkan di Indonesia pada umumnya dan Islam pada khususnya. ada beberapa interpretasi yang berbeda di dalamnya fuqaha’ atau ulama Islam tentang hal ini dipengaruhi oleh beberapa penjelasan yang diberikan dalam Al-Qur’an. Fokus dalam artikel penelitian ini adalah penafsiran ulama tentang ayat ahkam yang menyinggung perkawinan beda agama. Penelitian ini merupakan kualitatif deskriptif dan termasuk jenis penelitian bibliografi karena berusaha mengumpukan data, menganalisis dan membuat interpretasi tentang tafsir ayat ahkam perkawinan beda agama. Dengan sumber data dan buku-buku yang berkaitan dengan obyek kajian ini menunjukkan bahwa terdapat pendapat ulama yang melarang perkawinan antara laki-laki muslim dengan perempuan musyrik. Ada ulama yang mengkategorikan musyrik yang hanya meliputi musrik arab dan ada yang mengkategorikan musyrikat secara global. Sedangkan penafsiran tentang menikah dengan ahli kitab, para ulama sepakat membolehkan dengan kriteria-kriteria masing-masing ulama. Penafsiran mereka pun berdasarkan pendekatan-pendekatan sesuai dengan kaidah fiqh. Ulama kontemporer berpendapat bahwa perkawinan beda agama sepantasnya dilarang sebagai tindakan preventif untuk mencegah kemudharatan yang lebih besar. Keyword : tafsir, perkawinan, agama

Abstract

Kyai Nur Iman was one of the great scholars who was influential in the spread of Islam in Java in the 18th-19th century AD. As the son of King Amangkurat IV, Kyai Nur Iman prefers to dedicate his life to teaching the Islamic religion and teaching the concepts of soul purification to society. One of his works examines the purification of the soul entitled the book al-Sunni al-Muthalib. This book is still in the form of a manuscript stored in Pesantren Salimiyah Mlangi in Yogyakarta. This manuscript needs to be scholarly examined because it was written by a 19th century AD scholar who tried to combine two sciences, namely the science of Arabic (nahwu); arabic grammar, and the science of tasawwuf; moral sciene.  This study aims to reveal the concept of soul purification explained by Kyai Nur Iman in the manuscriptal-Sunni al-Muttalib. This research method is qualitative research using literature review with historical analysis to explain the concept of soul purification according to Kyai Nur Iman then explains the biography of Kyai Nur Iman. The results of this research explain that the concept of tazkiyah nafs according to Kyai Nur Iman in the book Asna al-mathalib starts with knowing Allah, knowing Rasulullah SAW, and getting to know things that can purify the soul such us repentance, inabah, asceticism, tawakkal, tafwidl, happy and sincere  and defile it such us namimah, ghibah, greed, riya', sum'ah, arrogant, ujub, wicked, exposing others' shame, immorality, blasphemy, and wishful thinking.

Abstract

Maqashid Shariah, which means the objectives, values, and benefits to be achieved through the implementation of Shariah, both globally and in detail. Initially, Maqashid Shariah was considered a branch of Usul al-Fiqh (principles of Islamic jurisprudence), but in its development, Islamic scholars stated that Maqashid Shariah is a distinct discipline and not part of Usul al-Fiqh. One of these scholars is Al-Tahir Ibn Ashur. The focus of this research is to understand the biography of Al-Tahir Ibn Ashur and the background that influenced his thinking. Additionally, it aims to explore the thoughts of Al-Tahir Ibn Ashur in the field of Maqashid Shariah. This study is a descriptive qualitative research using literature review as the methodology. The researcher examined documents related to Al-Tahir Ibn Ashur, and after data collection, the data were reduced or selected for analysis. The gathered data were then described, and using inductive thinking, conclusions were drawn regarding the thoughts of Al-Tahir Ibn Ashur in Maqashid Shariah. The thoughts of Al-Tahir Ibn Ashur in Maqashid Shariah encompass making Maqashid Shariah a separate discipline, dividing Maqashid Shariah, various maslahah (benefits), and methods of discovering Maqashid Shariah. Through this study, the background and thoughts of Al-Tahir Ibn Ashur in Maqashid Shariah can be understood. Maqashid Syariah yang berarti tujuan, nilai, dan faidah yang ingin dicapai dari diturunkannya syariah baik secara global maupun secara terperinci. awalnya maqashid syariah merupakan cabang dari bagian ilmu ushul fiqh, namun dalam perkembangannya muncul tokoh-tokoh islam yang menyatakan bahwa maqashid syariah merupakan disiplin ilmu tersendiri, dan bukan menjadi bagian dari ushul fiqh, salah satu tokoh tersebut adalah pendapat Al-Tahir Ibn Asyur. fokus penelitian ini untuk mengetahui biografi Al-Tahir Ibn Asyur serta latar belakang yang mepengerahui pemikirannya, selain itu untuk mengetahui pemikiran Al-Tahir Ibn Asyur dalam bidang maqashid syariah, Jenis penelitian ini merupakan pelitian kualitatif deskriptif dengam studi pustaka, sehingga peneliti mengkaji dokumen-dokumen yang terkait dengan Al-Tahir Ibn Asyur, setelah terkumpul, maka akan dilakukan reduksi atau pemilihan data, setelah itu data yang telah ada dideskripsikan, selanjutnya dengan analisis berfikir induktif, data tersebut akan ditarik kesimpulan, mengenai pemikiran Al-Tahir Ibn Asyur dalam maqashid syariah. Pemikiran Al-Tahir Ibn Asyur dalam maqashid syariah meliputi menjadikan maqashid syariah sebagai disiplin ilmu tersendiri, membagi maqashid syariah, macam-macam maslhahat, serta metode penemuan maqashid syariah. Dengan hal tersebut maka dapat diketahui bagaimana latar belakang serta pemikiran Al-Tahir Ibn Asyur dalam maqahid syariah.

Abstract

The interpretation of Quranic verses concerning gender relations has been a broad topic in Islamic tradition. Many classical interpretations place women in a subordinate position, which in the current context can be considered gender bias. This study aims to analyze the hermeneutical method used by  M. Quraish Shihab to explain gender-related verses in Tafsir al-Misbah. The method used is qualitative with a literature study approach. The results show that  Quraish Shihab applies a hermeneutical approach that considers the social context, historical background, and linguistic meaning in interpreting the verses. Thus, he offers a gender-just perspective on current developments. Verses such as QS. al-Nisa': 34, QS. al-Baqarah: 228, and QS. Al-Baqarah: 282 conservation does not emphasize male dominance but regulates social relations responsive to societal conditions. This interpretation also emphasizes that justice in Islam does not necessarily mean absolute equality but fairness in the rights, responsibilities, and respect for each individual's potential. This research recommends the need for more critical studies of classical interpretations to produce more inclusive and gender-just interpretations.
