Abstract

This journal discusses the role and implementation of the concept of people's sovereignty in the context of the intersection of members of the Indonesian People's Council of Representatives. (DPR-RI). The sovereignty of the people, as a fundamental principle in a democratic system, is the primary foundation in the process of the realization of the will of people through political representation. This journal specifically explores how people's sovereignty is reflected in the replacement mechanism of DPR-RI members over time. Through a legal and political analysis approach, the journal outlines the legal framework that regulates the process of replacement of members of the DPR-RI and identifies the factors that influence the successful implementation of people's sovereignty in that context. This research includes a study of the role of related institutions, such as political parties and the General Election Commission, inining integrity and representation in line with people's aspirations. The results of this study provide a deep understanding of the extent to which the sovereignty of the people is preserved and updated in the process of changing members of the DPR-RI over time. The implications of these findings can provide valuable insights for policy formulation, the development of democratic systems, and the strengthening of people's political participation in the Indonesian context

Abstract

Examining Body Finance is state agency that has authority inspection finance in Indonesian constitution , p the by constitutional set in _ Article 23E paragraph (1) of the 1945 Constitution. In operate function inspection state finances , the BPK in run it bound by principle assertion . However in level implementation , still there is action examinations carried out by the BPK in Thing this no notice principle assertion . Study this will study existence principle assertion in implementation authority inspection state finances by the BPK. Study this categorized as to in type study normative with based on problem or raised theme _ as topics study main inside _ study this . Approach used _ in study this is approach principle law with link a number of law existing positive _ During regarding with topics discussion main inside _ study this . Method analysis used _ is descriptive analytical with describe regulation current legislation _ apply as well as decisions later court _ linked with practice the law that occurs in the field ( facts ) law ). Research results this show that existence than principle assertion in law positive , practice law until guide for CPC in operate authority inspection to real state finances has emphasized even inside _ law related positive _ with CPC no someone confirmed _ by textual about role as well as attachment from principle assertion .

Abstract

Jurnal ini mengeksplorasi peran dan penerapan konsep kedaulatan rakyat dalam konteks pergantian anggota Dewan Perwakilan Rakyat Indonesia (DPR-RI). Sebagai prinsip dasar dalam sistem demokrasi, kedaulatan rakyat menjadi pijakan utama dalam mewujudkan kehendak rakyat melalui keterwakilan politik. Fokus jurnal ini adalah menganalisis bagaimana kedaulatan rakyat tercermin dalam mekanisme pergantian anggota DPR-RI dari waktu ke waktu. Dengan pendekatan analisis hukum dan politik serta metode penelitian yuridis normatif, jurnal ini menjelaskan kerangka hukum yang mengatur proses pergantian anggota DPR-RI dan mengidentifikasi faktor-faktor yang memengaruhi implementasi kedaulatan rakyat. Penelitian ini mencakup kajian mengenai peran lembaga-lembaga terkait seperti partai politik dan Komisi Pemilihan Umum (KPU) dalam membangun integritas dan keterwakilan yang selaras dengan aspirasi masyarakat. Selain itu, jurnal ini juga mengulas bagaimana partai politik berperan dalam proses seleksi dan pergantian anggota DPR-RI serta bagaimana KPU menjalankan fungsi pengawasan dan penyelenggaraan pemilu untuk memastikan pergantian anggota DPR-RI berlangsung secara transparan dan adil. Hasil penelitian ini memberikan pemahaman mendalam tentang sejauh mana kedaulatan rakyat dijaga dan diperbarui dalam proses pergantian anggota DPR-RI. Jurnal ini juga menyoroti berbagai tantangan yang dihadapi dalam menjaga kedaulatan rakyat, termasuk kendala hukum, politik, dan institusional yang dapat mempengaruhi efektivitas pergantian anggota DPR-RI.  Temuan ini memberikan wawasan berharga untuk perumusan kebijakan, pengembangan sistem demokrasi, dan penguatan partisipasi politik masyarakat di Indonesia. Dengan memahami lebih dalam tentang dinamika dan tantangan dalam proses pergantian anggota DPR-RI, para pembuat kebijakan dan pemangku kepentingan dapat merancang strategi yang lebih efektif untuk memperkuat kedaulatan rakyat dan meningkatkan kualitas demokrasi di Indonesia.
