Abstract

The evolution of the State Administrative Court’s authority in adjudicating factual legal actions involving government entities represents a dynamic facet of administrative law. This paper aims to explore and interpret the nuanced expansion of the State Administrative Court’s jurisdiction in handling cases related to factual legal actions initiated by the government. Through an in-depth analysis of legal precedents, legislative developments, and judicial interpretations, the study navigates the evolving landscape of administrative law. The paper delineates the historical context and legal frameworks that have shaped the State Administrative Court's jurisdiction, emphasizing its pivotal role in ensuring governmental accountability. It investigates the implications of the broadened scope of authority on the court's adjudicative processes and the overall legal landscape. Furthermore, the research scrutinizes key cases to illustrate how the court’s expanded jurisdiction impacts the resolution of factual legal actions involving government entities. By examining the interplay between legislative intent, judicial reasoning, and practical implications, the paper provides insights into the complexities and challenges associated with this expanded mandate. The findings underscore the significance of a judicious balance between the State Administrative Court’s authority and the imperative to maintain government efficacy. Additionally, the paper contributes to the ongoing discourse on administrative law by offering a comprehensive interpretation of the expanding role of the State Administrative Court in the adjudication of factual legal actions initiated by the government. In conclusion, this paper enhances our understanding of the evolving dynamics within administrative law, shedding light on the implications and intricacies surrounding the State Administrative Court’s extended authority in addressing factual legal actions involving government entities.

Abstract

This study analyzes the legal position of underhand land sale agreements in bankruptcy estate disputes by addressing the tension between legal certainty and substantive justice. The issue arises from inconsistent judicial reasoning in determining the legal consequences of privately executed land sale agreements concluded prior to bankruptcy declarations, as illustrated by the divergence between Supreme Court Decision No. 359 K/Pdt.Sus-Pailit/2024 and Decision No. 850 K/Pdt.Sus-Pailit/2017. Using normative legal research with statutory, conceptual, and case-based approaches, this study examines legislation, court decisions, and relevant legal doctrines. The findings demonstrate that underhand land sale agreements are civilly valid when material contractual requirements are fulfilled; however, they do not automatically result in juridical transfer of land rights due to unmet formal land registration requirements. Consequently, such land objects are frequently classified as part of the bankruptcy estate, despite the buyer’s good faith and full performance. This study finds that judicial approaches emphasizing legal certainty alone risk marginalizing justice and producing legal imbalance. The novelty of this research lies in applying Gustav Radbruch’s theory of legal purposes to reconcile legal certainty, justice, and utility in bankruptcy adjudication. The study concludes that legal protection for good-faith buyers remains achievable through a justice-oriented interpretation without undermining land administration order, provided it is realized through final and binding court decisions.   Penelitian ini menganalisis kedudukan hukum perjanjian jual beli tanah di bawah tangan dalam sengketa boedel pailit dengan menyoroti ketegangan antara kepastian hukum dan keadilan substantif. Permasalahan muncul akibat inkonsistensi pertimbangan hakim dalam menilai akibat hukum perjanjian jual beli tanah yang dibuat sebelum debitur dinyatakan pailit, sebagaimana terlihat dalam perbedaan Putusan Mahkamah Agung Nomor 359 K/Pdt.Sus-Pailit/2024 dan Putusan Nomor 850 K/Pdt.Sus-Pailit/2017. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan studi kasus melalui analisis terhadap peraturan perundang-undangan, putusan pengadilan, serta doktrin hukum yang relevan. Hasil penelitian menunjukkan bahwa perjanjian jual beli tanah di bawah tangan sah secara keperdataan sepanjang memenuhi syarat materiil perjanjian, namun tidak serta-merta menimbulkan peralihan hak atas tanah secara yuridis karena tidak terpenuhinya persyaratan formal pendaftaran tanah. Kondisi ini menyebabkan objek tanah kerap dimasukkan ke dalam boedel pailit meskipun pembeli telah bertindak dengan iktikad baik dan memenuhi seluruh kewajibannya. Penelitian ini menemukan bahwa penegakan hukum yang semata-mata mengutamakan kepastian hukum berpotensi mengabaikan keadilan dan menciptakan ketidakseimbangan hukum. Kebaruan penelitian ini terletak pada penerapan teori tujuan hukum Gustav Radbruch sebagai kerangka analisis untuk menyeimbangkan kepastian hukum, keadilan, dan kemanfaatan dalam sengketa kepailitan. Penelitian ini menyimpulkan bahwa perlindungan terhadap pembeli beriktikad baik tetap dimungkinkan melalui pendekatan keadilan tanpa mengabaikan tertib administrasi pertanahan, sepanjang diwujudkan melalui putusan pengadilan yang berkekuatan hukum tetap.
