Abstract

Tujuan penelitian ini untuk mengetahui bagaimanakah penegakan hukum terhadap tindak paksa debt collector dalam objek perjanjian. Teknik yang digunakan dalam penelitian ini adalah penelitian normatif atau kepustakaan yang mana data-datanya diperoleh baik dari KUHP, peraturan perundang- undangan, data arsip, data resmi pada instansi-instansi pemerintah, data yang dipublikasikan dan data-data lain lain yang juga mendukung dan memiliki relevansi dengan objek permasalahan yang diteliti dalam skripsi ini. Metode penelitian yang di gunakan dalam penelitian ini ialah yuridis normatif yang dimana bahan hukum dan informasi dianalisa secara normatif. Hasil Penelitian menunjukan pertama : dalam hal penegakan hukum dikarenakan belum adanya peraturan baku yang mengatur terkait tindak pidana pengambilan alih secara paksa kendaaan bermotor yang mengalami kredit macet/bermasalah, oleh karenanya dikenakan delik tindak pidana pencurian dengan pemebratan sebagaimana di atur dalam pasal 363 KUHP, kedua ; pentingnya penyuluhan dari instansi terkait, seperti halnya yang dilakukan olek polres sukabumi kota berkenaan prosedural penanganan kendaraan bermotor yang mengalami masalah dalam hal kredit baik terhdap masyarakat maupun debt collector berkaitan, hal demikian ini menjadi salah satu faktor terjadinya penarikan secara paksa kendaraan bermotor yang bermasalah.

Abstract

Kasus Kekerasan seksual yang terus meningkat setiap tahunnya menjadikan Indonesia harus berfikir keras menyelesaikan salah satu permasalah hukum ini, salah satu alasan tingginya angka kekerasan seksual di Indonesia adalah karena kurangnya hukum yang mengikat pelaku. Didasarkan atas hal ini pemerintah akhirnya men-sahkan, Undang-undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual pada Mei 2022 dan diberlakukan sejak Undang-Undang tersebut disahkan. Undang-undang ini berfokus pada perlindungan korban (terkhusus perempuan dan anak) agar mendapatkan perlindungan dengan sebaik-baiknya dan keadilan yang seadil-adilnya. Aparat penegak hukum memiliki tugas untuk menerapkan undang-undang. Namun pada kenyataannya, Undang-undang Tindak Pidana Kekerasan Seksual belum diterapkan sepenuhnya di Kota Sukabumi. Berdasarkan hal ini penulis mencoba untuk mencari tau apa yang menjadi problematika dalam penerapan undang-undang ini terkhususnya oleh para aparat penegak hukum di wilayah kota Sukabumi, serta bagaimana upaya penanggulangan tindak kejahatan seksual oleh aparat penegak hukum di Kota Sukabumi. Teknik pendekatan penelitian yang digunakan oleh penulis ialah metode penelitian kualitatif yang lebih berfokus pada mencari data kelapangan secara langsung kepada narasumber atau yang mempunyai data. wawancara dan observasi ini penulis rasa pas dengan rumusan masalah yang diangkat oleh penulis, selain dengan teknik pengumpulan data melalui wawancara dan observasi, penulis juga menggunakan teknik pengumpulan data lewat studi kepustakaan. Problematika dalam penerapan undang-undang tindak pidana kekerasan seksual ialah tidak terpenuhinya komponen-komponen dalam sistem penerapan hukum, komponen tersebut yakni struktural dan kultur hukumnya. Untuk upaya penanggulangan dalam mencegah tindak pidana kekerasan seksual baik secara hukum pidana ataupun non-hukum pidana sudah sangat baik.

Abstract

The study aims to analyze the judgment of a judge against the perpetrators of the violation of the sale of alcoholic beverages in Sukabumi City due to the abundance of the distribution of alcoholics and violations of the prohibition laws on alcoholic drinks. The method used in the research is the normative jurisprudence of the data used in this research is primary data in the form of court rulings and secondary data contained in legislative regulations, books and journals. The results of the research showed that a quick-check justice system was used to prosecute perpetrators of violations of the sale of alcoholic beverages. The judge takes into account legal certainty, justice, and profit when making a decision, but such a decision cannot have a criminal effect on the offender.

Abstract

Pidana mati sebagai bentuk hukuman paling berat dalam sistem hukum pidana Indonesia masih menimbulkan perdebatan, terutama dalam konteks pelanggaran hak untuk hidup yang dijamin konstitusi. Penelitian ini bertujuan untuk menganalisis dasar pertimbangan Jaksa Penuntut Umum (JPU) dalam mengajukan tuntutan pidana mati, serta pertimbangan hakim dalam menjatuhkan vonis pidana mati terhadap pelaku peredaran gelap narkotika, dengan fokus pada Putusan Nomor 297/Pid.Sus/2020/PN.Cbd di Pengadilan Negeri Kabupaten Sukabumi. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus, serta didukung data empiris melalui studi dokumen dan wawancara. Hasil penelitian menunjukkan bahwa tuntutan pidana mati oleh JPU didasarkan pada jumlah barang bukti yang sangat besar dan keterlibatan jaringan transnasional. Sementara itu, hakim mempertimbangkan aspek yuridis, filosofis, dan sosiologis dalam menjatuhkan vonis pidana mati, termasuk perlindungan masyarakat. Temuan ini menunjukkan bahwa penerapan pidana mati dalam perkara narkotika masih diterapkan secara konsisten oleh aparat penegak hukum, meskipun bertentangan dengan prinsip non-derogable rights dalam hak asasi manusia. Penelitian ini merekomendasikan evaluasi terhadap kebijakan pidana mati melalui pendekatan keadilan substantif agar tidak hanya berfokus pada kepastian hukum, tetapi juga menjamin perlindungan hak asasi manusia.

Abstract

The enactment of Indonesia's Law Number 20 of 2025 on the Code of Criminal Procedure (KUHAP 2025), effective January 2, 2026, introduces a paradigmatic shift in the coordination between investigators and public prosecutors: Article 58 mandates active coordination from the investigation stage, fundamentally departing from the sequential-passive model of the former KUHAP, while Article 70 imposes a strict seven-day deadline for indictment drafting after case files are declared complete. This study examines two interconnected questions: (1) how the legal framework governing investigator–prosecutor coordination is structured under KUHAP 2025 and related legislation; and (2) how that framework is implemented in practice at the Purwakarta District Prosecutor's Office. A normative–empirical mixed-method design was employed, integrating statutory, conceptual, and case-study approaches. Data were gathered through in-depth interviews with prosecutors and investigators at Purwakarta District Prosecutor's Office and Purwakarta Police Resort, case document analysis, and field observation. The theoretical framework combines Lawrence M. Friedman's Legal System Theory and Soerjono Soekanto's Law Enforcement Theory. Findings reveal that KUHAP 2025 delivers substantial normative advancement yet harbours three critical regulatory gaps: the absence of binding technical protocols for implementing mandatory active coordination, the lack of uniform and measurable case-file completeness standards, and no formal mechanism for resolving institutional disagreements on legal interpretation. On the ground, coordination at Purwakarta still operates under the old sequential-passive pattern despite the new law: case-file returns (P-19) remain frequent, driven primarily by absent expert testimony, insufficient factual narration in examination records, and mismatches between charged articles and legal facts. A Friedman–Soekanto diagnostic reveals simultaneous dysfunction across all three legal system components substance, structure, and legal culture with the entrenched 'waiting culture' between the police and the prosecution identified as the most resistant obstacle to reform.

Abstract

The proliferation of digital commerce has enabled a new narcotics distribution mode through Cash on Delivery (COD) systems that exploit delivery couriers as intermediaries, systematically obscuring criminal trails and placing intellectual perpetrators beyond immediate risk of arrest. This study analyzes the regulation and application of criminal liability of COD couriers as narcotics intermediaries under Article 114(1) of Law No. 35 of 2009 on Narcotics, reviewed against the New Criminal Code (Law No. 1 of 2023), while critically examining the practice of proving the intent element in Bandung City. A normative-empirical legal method was employed, integrating statutory, conceptual, case-based, and comparative approaches. Empirical data were obtained from the Narcotics Criminal Investigation Unit of Polrestabes Bandung, which handled 92 cases involving 117 suspects across three monitoring periods in 2024. The research reveals that the phrase "acting as an intermediary" in Article 114(1) inherently contains an active will element requiring positive proof of intent. The New Criminal Code's Article 35 codifies the principle geen straf zonder schuld as binding positive law, while Articles 20–22 mandate proportional role differentiation among perpetrators, co-perpetrators, and accessories. In practice, however, investigators apply a presumption of knowledge derived from physical possession and uniformly categorize couriers as full perpetrators without typology assessment. This systemic gap produces over-criminalization that potentially violates suspects' constitutional rights under Article 28D(1) of the 1945 Constitution. The study recommends immediate standardization of mens rea evidentiary procedures, mandatory courier typology identification, and harmonization of the Narcotics Law with the New Criminal Code.

Abstract

Indonesia adopts a dual criminal justice system that differentiates the standards of protection for suspects' rights between the general and military justice systems. The enactment of the new Criminal Code (KUHP) and Criminal Procedure Code (KUHAP) has strengthened the protection of civil rights, while military criminal procedure continues to be governed by Law Number 31 of 1997, resulting in disparities that may conflict with the principle of equality before the law. This study aims to comparatively analyze the standards of protection for suspects' rights during the investigation stage in both systems based on the principle of justice. The study employed a normative juridical method using statutory, comparative, and conceptual approaches. The primary legal materials consisted of Law Number 1 of 2023, Law Number 20 of 2025, Law Number 31 of 1997, and the 1945 Constitution of the Republic of Indonesia. The analysis was conducted using Rawls' Theory of Procedural Justice. The findings indicate that investigations within the general criminal justice system have fulfilled the principles of procedural justice through the expansion of pretrial review and the provision of legal assistance from the outset. In contrast, military criminal investigations remain constrained by the dominance of command authority, restrictions on the role of legal counsel, and the absence of external judicial oversight. Therefore, a revision of Law Number 31 of 1997 is necessary to ensure a fair trial.

Abstract

Law Number 20 of 2025 introduced a new Indonesian Criminal Procedure Code, replacing Law Number 8 of 1981 after more than forty years of application. The previous framework was widely criticized for limited judicial oversight, arbitrary suspect designation, and insufficient protection of suspects during criminal investigations. This study examines how the new legislation restructures investigative procedures and evaluates its impact on safeguarding suspects’ procedural rights. Employing normative legal research, the study applies statutory, conceptual, and comparative approaches. Primary legal materials include Law Number 20 of 2025, Law Number 8 of 1981, and Constitutional Court Decision Number 21/PUU-XII/2014, while secondary materials consist of scholarly books, journal articles, and legal commentaries. Data were collected through document analysis and examined using descriptive and comparative qualitative methods. The findings show that the new Code establishes clearer procedural standards by regulating nine coercive measures, requiring at least two valid pieces of evidence and a formal case exposition before suspect determination, guaranteeing legal assistance from the beginning of the investigation, and requiring audiovisual recording of examinations. Although the proposal for a preliminary examining judge was omitted, Article 158 expands pre-trial review to include unlawful seizure, unreasonable investigative delay, and detention suspension. These reforms enhance due process and accountability, yet judicial supervision remains predominantly reactive, while outdated implementing regulations continue to create practical inconsistencies and normative uncertainty.

Abstract

Digital transformation has shifted conventional crime into data-driven offenses, where electronic evidence is latent, fragile, and vulnerable to manipulation. Indonesia's Law Number 1 of 2024 on Electronic Information and Transactions (ITE Law) and Law Number 20 of 2025 on the Criminal Procedure Code both recognize electronic evidence, yet they originate from different legal regimes, creating challenges in normative harmonization during digital-crime investigations. This study examines the harmonization of electronic evidence between the ITE Law and the 2025 Criminal Procedure Code and evaluates its implications for legal certainty. This normative (doctrinal) legal research employs descriptive-analytical methods through statutory, conceptual, and comparative approaches. Primary legal materials include the ITE Law and the 2025 Criminal Procedure Code, while secondary and tertiary materials consist of accredited legal scholarship, ISO/IEC 27037, and library sources analyzed qualitatively using deductive reasoning. The findings demonstrate that the two laws complement one another in recognizing electronic evidence, with the ITE Law extending evidentiary categories and the 2025 Code establishing electronic evidence as independent evidence requiring authentication. However, legal certainty remains limited because digital forensic procedures remain discretionary and no mandatory chain-of-custody standard exists, creating authentication asymmetry, particularly regarding AI-generated synthetic evidence. The study proposes operational harmonization through technical investigative guidelines, mandatory digital chain-of-custody standards, forensic certification, and mechanisms for verifying synthetic evidence to strengthen legal certainty and safeguard suspects' rights.

Abstract

Since 2 January 2026, the new Indonesian Criminal Procedure Code (Law No. 20 of 2025) has adopted a due process paradigm that strengthens the protection of suspects' rights from the very beginning of their interaction with law enforcement officers. However, the implementing regulations of the Indonesian National Police that guide Turjagwali officers at traffic accident scenes still adhere to the paradigm of the previous Criminal Procedure Code, creating a normative gap. This study aims to identify the standards for protecting suspects' rights under the new Criminal Procedure Code, evaluate the conformity of Police Regulations (Perkap) No. 15 of 2013 and No. 6 of 2019, and formulate the necessary harmonization. The research employs a normative juridical method using statutory, conceptual, and vertical-temporal comparative approaches. Data were collected through a literature review and supported by case files from the Traffic Unit of the Cimahi Regional Police, then analyzed qualitatively using a normative legal approach. The findings reveal that the new Criminal Procedure Code establishes seven standards for protecting suspects' rights at crime scenes, whereas Police Regulations No. 15 of 2013 and No. 6 of 2019 still contain seven substantive, procedural, and formal inconsistencies that may result in evidentiary defects and the application of the exclusionary rule. Normative harmonization requires the revocation of Police Regulation No. 15 of 2013, partial revision of Police Regulation No. 6 of 2019, and the formulation of a specific Operational Guideline for Turjagwali officers. The originality of this study lies in integrating the initial handling stage at crime scenes, the due process paradigm of the new Criminal Procedure Code, and the harmonization of police implementing regulations.
